Uber sued DoorDash in San Francisco Superior Court on February 14, 2025, alleging that DoorDash used its delivery marketplace to pressure restaurants into choosing DoorDash for restaurant-direct deliveries. The dispute is about whether restaurants can freely select a delivery provider for orders placed through their own channels—not a court finding that DoorDash broke the law.
What is the lawsuit about?
In its complaint, Uber says DoorDash used restaurants’ reliance on its third-party marketplace to secure exclusive or preferred arrangements for first-party delivery. Uber alleges DoorDash threatened to raise fees, lower restaurants’ visibility in DoorDash search results, or remove them from the marketplace if they did not agree.
Uber argues that these arrangements can keep competing delivery providers from winning individual restaurant-direct orders by offering better speed, reliability, or price. That is Uber’s position in the litigation; the complaint’s assertions are allegations, not established facts.
Uber’s complaint describes the alleged tactics this way: “DoorDash’s tactics include threatening multimillion-dollar penalties and/or to remove or demote restaurants’ positions on the DoorDash App unless the restaurants agree to exclusive or near-exclusive use of DoorDash for behind-the-scenes first-party restaurant delivery.”

What do first-party and third-party delivery mean?
The difference is who takes the customer’s order. A restaurant can receive an order through its own app or website and hire a delivery company to fulfill it behind the scenes. That is first-party delivery. Alternatively, the customer can place an order through a marketplace such as DoorDash or Uber Eats; that is third-party delivery.

Uber’s complaint centers on whether a restaurant that takes an order directly can choose among delivery providers, or whether access to DoorDash’s marketplace allegedly gives DoorDash leverage over that separate choice. Uber says restaurants benefit when providers compete for those deliveries; that argument has not been established as a court finding.

What is Uber asking the court to do?
The complaint pleads six claims: tortious interference with contract; tortious interference with prospective economic advantage; violations of California Business and Professions Code section 17200 et seq.; violations of section 16600 et seq.; non-restitutionary disgorgement based on unjust enrichment or quasi-contract; and declaratory relief.
Uber asks for damages, disgorgement, injunctive relief, and a declaration, among other remedies. These are requests in the complaint, not relief shown to have been awarded.

What do the market-share figures show—and not show?
Daily Journal reported Earnest Analytics estimates for the U.S. delivery market in November 2024 of 62.7% for DoorDash, 25% for Uber, and 6.2% for Grubhub. These are dated estimates reported by a secondary source, not court findings or current market-share figures.
Separately, Uber’s complaint alleges that DoorDash is responsible for “over 50%” of U.S. third-party deliveries and says DoorDash self-reported control of first-party delivery for “over 90%” of the largest enterprise restaurants on an exclusive or preferred basis. Those are statements attributed to Uber’s pleading, not independently established statistics.

Where does the case stand?
Uber filed the case in San Francisco Superior Court on February 14, 2025, as case CGC-25-622395. DoorDash filed a memorandum supporting its demurrer on April 25, 2025; that filing listed a July 11, 2025 hearing date.
Later records identified in Trellis.Law search results refer to briefing on DoorDash’s motion to compel arbitration, with a March 3, 2026 hearing listed, and an appeal filing dated January 6, 2026. Those references do not establish the outcome of those proceedings or the complete docket position as of October 8, 2026. The current San Francisco Superior Court docket is needed to confirm whether the case is pending, stayed, dismissed, or decided.
