Poppi was sued over how it marketed its prebiotic soda, not over a court ruling that the drink is unhealthy or unlawful. Plaintiffs alleged that calling the soda “gut healthy” overstated what its prebiotic fiber could do. Poppi denied wrongdoing, and the case ended in a court-approved class settlement of $8.9 million. The court did not decide who was right.
What the lawsuit challenged
The case is about advertising claims. Kristin Cobbs filed the first complaint in May 2024. Related consumer cases were later brought together in the U.S. District Court for the Northern District of California. The operative complaint described Poppi’s beverages as marketed “gut healthy” because they contain prebiotic fiber. Plaintiffs argued that the amount of fiber in each can and the drink’s sugar content undercut the health benefit that the marketing implied.
Those points are allegations made in a complaint. They were never tested in court and were not found to be true or false. The complaint’s scientific claims, including its statements about how much fiber a can contains and how many sodas a person would need to drink to see an effect, belong to the plaintiffs. They are not established findings about Poppi or about prebiotics in general.
The legal theories
- California consumer-protection and false-advertising claims
- Fraud and misrepresentation
- Unjust enrichment, meaning that consumers paid more than they should have because of the marketing
- Express and implied warranty claims, which relate to what the product was represented to do
How Poppi responded
Poppi denied that the allegations had a factual or legal basis. The company said its labeling was truthful and accurate, and it denied liability and any injury to consumers. Shortly after the suit was filed, the Associated Press quoted the company in June 2024: “We believe the lawsuit is baseless, and we will vigorously defend against these allegations.” That was Poppi’s position at the time. It was not a court finding.

How the case ended
The parties negotiated a settlement after mediation rather than going to trial. The court held a fairness hearing on November 20, 2025, and granted final approval. The final approval order was filed April 14, 2026. A fairness hearing is the court’s check that a class settlement is fair, reasonable and adequate to the people it covers, and it is the step that binds class members to the outcome.
The settlement’s own FAQ states the legal effect plainly: “The Court has not determined who is correct.” Readers should treat the settlement as an agreement to resolve the claims, not as a ruling that Poppi’s marketing was misleading or that the company owes damages on the merits.

Settlement terms that affect your money
The settlement fund is $8.9 million. Out of that fund, the administrator pays approved claims, administration expenses, attorneys’ fees and costs, and incentive awards for named plaintiffs. What remains goes to class members. Because the fund is limited, the court described payments by package size and noted that the actual amounts depend on how many claims are filed and how much money is available for distribution.
Who was in the class
The class covers people in the United States who bought any flavor or package size of Poppi beverages in the United States for household use, not for resale or distribution. The purchase window runs from January 23, 2020 through July 18, 2025.

These are the amounts stated in the court’s final approval order and the settlement terms. They are subject to the adjustment rules and to the money actually available, so an individual payment may be lower than the listed figure.
Checking whether you can still claim
- Go to the settlement administrator’s website, which hosts the class definition, FAQ and claim forms.
- Look for the claim deadline. Do not assume a claim is still open because the settlement was approved in April 2026.
- If you bought Poppi during the class period, gather any receipts, order confirmations or retailer loyalty records that show the purchase. These help if you file a claim with proof of purchase.
- For questions about your specific claim, contact the settlement administrator. For the court’s record, check the docket in the Northern District of California case.
What the settlement does and does not establish
The settlement resolves the claims of the people in the class. It does not establish that Poppi’s “gut healthy” marketing was false, and it does not confirm the plaintiffs’ fiber or sugar theories. Nothing in the approval order changes the scientific question of what Poppi’s prebiotic fiber does in the body.

For a personal-finance reader, the more useful question is whether a claim is worth filing. The answer depends on how much you bought during the class period, whether you have proof of purchase, and how many people file. A small payment is the likely outcome for most households, and a payment is not compensation for any health effect.
If you are comparing prebiotic sodas or other functional beverages, rely on the current label and the manufacturer’s published nutrition information rather than on claims made in this lawsuit.
