That concern does not establish that a particular person traded ahead of any campaign announcement. The rules depend on the platform, contract and applicable law, and political event contracts have been the subject of disagreement within the Commodity Futures Trading Commission (CFTC).
Why can a campaign event contract create an insider-trading concern?
Some campaign information is valuable before it becomes public
A contract tied to a campaign development may become more likely to pay out when a private decision or plan becomes known. For example, people involved in arranging an endorsement, planning a rally, negotiating a candidate’s withdrawal or preparing a debate could learn relevant details before the public does. A trade made using confidential information could give that trader an advantage over people relying on public reporting and other information.

The concern is about the structure of the opportunity, not proof of a particular trade. The available reporting does not establish that a named person traded ahead of any specific endorsement, rally, dropout or debate.
Influence can matter as well as inside knowledge
A person who can affect whether an event occurs may face a different conflict from someone who only learns about it early. A trader able to influence an endorsement, a candidate’s participation or another contract condition might have an incentive to act in a way that changes the outcome. Whether a particular person’s information or influence violates a platform rule or law depends on the facts and the applicable rules.

What does a contract price tell you?
The CFTC describes an event-contract price as reflecting traders’ perceived probability of an event. It is a market price, not a guarantee that the event will happen, a poll result or proof that traders possess inside information. Prices can move as participants revise their expectations.
Before trading, customers should be able to review the contract’s wording, payout and settlement procedures, along with fees and other costs. Those details matter especially for campaign events: the contract’s definition of an endorsement or dropout, for instance, determines what counts for settlement. The CFTC’s prediction-market overview describes these customer disclosures and the agency’s general oversight role.

What rules do platforms and regulators apply?
Exchange rules and surveillance
The CFTC says designated contract markets must establish and enforce rules against fraud, manipulation and unfair trading practices, including insider trading. The agency also says it conducts surveillance and enforces applicable laws and regulations. These statements concern designated contract markets; they do not establish that every operator offering event contracts is CFTC-regulated.

On March 23, 2026, the Associated Press reported that Kalshi said it would ban political candidates from trading on their own campaigns, while Polymarket revised its rules to bar trading by users who might possess confidential information or influence an event. Those are reported platform policies as of that date, not a guarantee that the rules remain unchanged or are identical across platforms. The legal treatment of political contracts has been contested
In a May 2024 statement concerning a proposed rule, then-CFTC Chair Rostin Behnam said the proposal would treat event contracts on political contests such as elections as contrary to the public interest. That was a position about a proposal, not a final rule. In 2023, Commissioner Summer K. Mersinger dissented in a matter involving congressional-control contracts, illustrating disagreement among commissioners about the statutory basis and treatment of those contracts. Neither the proposal nor the dissent, by itself, settles the legal status of every political event contract today. The relevant documents are the CFTC’s May 2024 statement and Mersinger’s 2023 dissent.
So the answer to whether political prediction markets are regulated like futures or gambling is not a single rule that applies to every market. The CFTC describes oversight and duties for designated contract markets, while the legal status of particular political contracts and operators can depend on the specific market and jurisdiction. The cited agency materials do not establish one universal classification for every platform or contract.

Could election-market trades affect more than the contract payout?
Prices can be visible beyond the market itself, which raises a broader concern: officials and analysts have worried that market prices could be pushed to influence public perceptions, turnout, fundraising or endorsements. The AP has also described some manipulation scenarios as abstract. These concerns are not evidence that political markets have changed election outcomes. See the AP report on election markets for the reported concerns and qualifications.

What should you check before trading a political event contract?
- Identify the operator and its status. Do not assume that every event-market platform is a CFTC-regulated designated contract market.
- Read the specific contract. Check what event qualifies, how it is defined, which source or process determines settlement, and what happens if circumstances are ambiguous.
- Review the platform’s current rules. Look for restrictions on confidential information, ability to influence an event, and who may trade. Policies reported on a particular date may later change.
- Account for costs and payout terms. Review fees and other costs alongside the payout and settlement procedure; a displayed price alone does not describe the full contract.
- Separate market odds from certainty. A price reflects traders’ perceived probability, not a promise of an outcome or a verified account of what campaign insiders know.
- Consider jurisdiction. The legal treatment of a specific operator or contract may vary. The cited sources do not resolve every state’s rules or every contract’s status.
