Where an NLRB Judge Said Amazon CEO Andy Jassy’s Union Comments Crossed the Line

Administrative Law Judge Brian D. Gee distinguished Jassy’s lawful comments about changed workplace relationships from predictions he found coercive.

In a May 2024 administrative law judge decision, Brian D. Gee found that Amazon CEO Andy Jassy could describe how union representation changes the relationship between employees and management. But Gee said Jassy crossed the line when he predicted that unionized workers would be less empowered, would have more trouble getting things done quickly, and would be better off without a union. The judge found those predictions coercive because they went beyond describing the change in relationship and lacked objective factual support.

What did Andy Jassy say about unions?

The case concerned public interviews Jassy gave on April 14, June 8 and November 30, 2022. The union filed charges in June and December 2022. The parties submitted a stipulated record and waived an evidentiary hearing.

In decision JD(SF)-12-24, Administrative Law Judge Brian D. Gee separated statements about the effect of representation itself from predictions about what unionization would do to workers’ influence and workplace decisions.

Which comments did the judge find lawful or unlawful?

The decision’s distinction is narrow. Gee did not rule that criticism of unions is always unlawful, nor that an employer can never say workers would be better off without a union. His finding turned on the specific predictions and the context in which the opinion was expressed. He wrote: “I thus conclude that Jassy’s words relied on coercion to dissuade employees from supporting unions.”

What did the judge recommend?

Gee recommended that Amazon cease and desist from the specified coercive statements and post and electronically distribute a notice nationwide. This was an administrative law judge’s recommended order, not itself a final ruling by the National Labor Relations Board. Under the Board’s procedures, findings and an order may be adopted if no exceptions are filed.

GeekWire reported on May 2, 2024, that Amazon spokesperson Mary Kate Paradis said the company strongly disagreed and intended to appeal. That was Amazon’s position at the time; it does not establish the outcome of any later appeal.

Is the case resolved?

The available docket material does not establish the final Board disposition of the Jassy-comments proceeding. An NLRB docket listing for a different case, 03-CA-302172, shows an amended ALJ decision dated July 23, 2025, while a related Amazon docket lists a transfer-to-Board entry on that date. Those entries are not enough to establish the final disposition of the specific proceeding about Jassy’s comments. The 2024 decision should therefore be described as Gee’s finding and recommendation, not as a final Board ruling or a currently enforceable order.

How this differs from the NLRB’s captive-audience ruling

The Board’s November 13, 2024 decision about mandatory captive-audience meetings is a separate case addressing a different question. It held that an employer violates the National Labor Relations Act by requiring employees, under threat of discipline or discharge, to attend meetings about unionization. The Board said employers may hold such meetings with reasonable advance notice if attendance is voluntary and no attendance records are kept. That ruling was not the decision about Jassy’s public interviews.
