What to Do When Your Mortgage Is Transferred to a New Servicer

A mortgage servicing transfer changes who handles your account, not the other loan terms by itself. Use the notice to redirect payments, check the first statement, and understand the federal 60-day protection for timely payments received by the former servicer.

If your mortgage servicer changes, read the transfer notice, note the effective date, redirect payments as instructed, and check the first statement from the new company. The transfer changes who handles your account; by itself, it does not change the other terms of your mortgage. A federal rule also protects a payment that the former servicer receives on time during the first 60 days after the transfer.

What does it mean when your mortgage servicer changes?

Your mortgage servicer is the company that performs administrative work on your loan, such as collecting payments and keeping account records. A transfer means a different company will handle those servicing functions. It does not, by itself, mean your mortgage has been paid off, that you have a new loan, or that you can stop making payments.

The transfer notice should tell you when responsibility moves and where to send payments. Treat that notice as the routing guide for your account, while continuing to meet the payment schedule in your loan documents. The federal rules discussed here are general U.S. requirements under CFPB Regulation X; they do not address every state-specific notice rule or the details of an individual loan.

What should you do first?

  1. Read both transfer notices and keep them. The former servicer and the new servicer generally send notices around the transfer. A single combined notice is also permitted. Keep the notices with your mortgage statements and payment records so you can verify dates, contacts, and payment instructions later.
  2. Write down the handoff dates. Record the effective date, the date the former servicer stops accepting payments, and the date the new servicer starts accepting them. Also save the contact information for both companies. The effective date is the key reference point for the federal 60-day payment protection.
  3. Redirect payments due on or after the handoff. Use the new servicer’s payment address or method in the notice for payments due on or after the stated transfer date. If you pay by mail, allow time for delivery and processing; do not wait until the due date to change the destination.
  4. Change any recurring payment instructions. Update bill pay at your bank or credit union and any other automatic payment arrangement. Check whether a payment already scheduled around the transfer will go to the old or new servicer, and adjust it if needed.
  5. Save proof of what you paid. Retain payment confirmations, bank records, mailed-payment documentation, and statements from both servicers. This gives you a record of the amount, date, and recipient if a payment later appears missing or late.
  6. Review the first statement from the new servicer. Compare the payment amount and posting date with your records. Review the principal, interest, and escrow amounts, along with any fees, and raise a discrepancy promptly in writing.

When do the notices have to arrive?

Federal Regulation X sets ordinary notice timing, with exceptions that can permit a longer notice period in specified circumstances. The periods below are federal requirements, not estimates of when a particular letter will arrive.

Notice or protection Federal timing What it tells you or does
Notice from the former servicer Generally at least 15 days before the effective transfer date Identifies the transfer and payment transition details.
Notice from the new servicer Generally no more than 15 days after the effective transfer date Provides information about the new servicing arrangement.
Combined notice May be sent at least 15 days before the effective transfer date Can provide the transfer information in a single notice.
Old-servicer payment protection 60 days beginning on the effective transfer date A qualifying on-time payment received by the former servicer cannot be treated as late.
Initial escrow statement after a qualifying change Within 60 days after transfer Required if the new servicer changes the monthly payment amount or the method of escrow accounting.

The regulation allows a longer notice period in certain cases, including a servicing contract termination for cause or some insolvency or conservatorship proceedings. So if notice timing differs from the ordinary periods above, do not assume the transfer is invalid based on timing alone; check the notice and contact the servicers using the information it provides.

A transfer notice must identify the effective date, when the former servicer stops accepting payments, when the new servicer begins accepting them, and contact details for both companies. It also addresses whether the transfer affects optional mortgage life or disability insurance and what action you must take to maintain that coverage, if applicable. Read any coverage instructions rather than assuming the policy will continue unchanged.

Can you still pay the old mortgage company?

Use the new servicer’s instructions for payments due on or after the transfer date. However, a specific federal protection applies if the former servicer receives a payment during the first 60 days beginning on the effective transfer date. If the former servicer receives it on or before the due date, including any grace period provided by your loan documents, the payment may not be treated as late for any purpose. The CFPB’s interpretation of the rule says this also bars a late fee for that payment.

This protection is not a payment holiday: your regular obligation remains, and you should still follow the transfer notice and make each payment on time. Its condition matters: the former servicer must actually receive the payment by the applicable due date, counting any contractual grace period. It does not excuse a late payment sent to either company after the applicable deadline.

If the former servicer receives a payment that should have gone to the new servicer, it must promptly either forward the payment to the new servicer for application or return it and tell you the proper recipient. Keep the record of the payment and watch your account to confirm that it is credited or returned.

What changes—and what does not?

The servicing company and payment destination change. Under the federal transfer-notice rule, the transfer does not affect a mortgage term or condition except for terms directly related to servicing. A transfer alone therefore is not a change to your interest rate, principal balance, maturity date, or other substantive loan terms.

Compare the new account information with your existing loan documents and statements, and distinguish a servicing handoff from a separate loan event or modification. If you receive a separate notice proposing or documenting a change to loan terms, assess that document on its own; the transfer itself does not establish that such a change has occurred.

How should you check your first statement and escrow?

Use the first statement from the new servicer as an account check, not just a bill. Compare it with the most recent statement from the old servicer and your payment records. Confirm the amount due, the payment’s posting date, the principal and interest allocation, the escrow figures, and any listed fees. Make a note of a mismatch before contacting the servicer, including the statement date and the amount you believe is incorrect.

If your loan has escrow, compare the balance and payment information with prior statements. A servicing transfer is a reason to review those entries, but the transfer alone does not prove that an escrow error occurred. If the new servicer changes your monthly payment amount or its escrow accounting method, it must send an initial escrow account statement within 60 days after the transfer. Review that statement against the prior account information and ask for an explanation if a transaction or balance does not reconcile.

What if a payment, notice, or assistance application goes missing?

Contact the servicer relevant to the problem, and create a written record when you are reporting an error or requesting account information. CFPB guidance identifies cases where contacting both servicers may be appropriate: you never received a transfer notice, payments appear to have been applied incorrectly, or the new servicer is not handling a loss-mitigation application you submitted to the old servicer.

For an alleged servicing error

Use the servicer’s designated address for a notice of error under Regulation X. Describe the specific issue—for example, a payment not credited or an incorrect escrow transaction—and include enough account and transaction detail for the servicer to identify it. Keep a copy of the notice and proof of delivery. Regulation X provides error-resolution procedures and response periods for covered notices; the rules do not guarantee that every dispute will be resolved in your favor.

For account information

Use the servicer’s designated address for an information request when you need records or an explanation rather than reporting a specific error. State what information you are seeking, such as payment history or an account entry, and preserve a copy and delivery record. A phone call can be useful for quick contact, but do not assume an oral conversation creates the same record as a written notice sent through the applicable process.

For a pending loss-mitigation application

If you had already submitted an application to the old servicer and the new servicer does not appear to be working with it, contact the servicers and state when and where you submitted it. Keep copies of the application, delivery confirmation, and any responses. Ask what records or next steps are needed to confirm its status; do not assume that the transfer itself means the application was denied or completed.

Which records are most useful to keep together?

Keep one transfer file, paper or digital, with the old and new notices, recent statements, payment confirmations, bank bill-pay records, written requests, and delivery proof. Track the effective transfer date, the old servicer’s last acceptance date, the new servicer’s first acceptance date, each payment’s amount and posting date, the escrow balance and payment, and the status of any pending assistance application. These details let you compare what each servicer says with what you actually sent and when.

The CFPB’s model transfer notice in Appendix MS-2 to Regulation X uses the standard language, “Nothing else about your mortgage loan will change.” Treat that as the notice’s description of the effect of the servicing transfer itself, not as a promise about a separate modification or other unrelated event affecting your loan.
