Do not move the bitcoin, delete records, reset devices, or try to hide keys. First determine whether an exchange has imposed an internal restriction, a court has frozen a wallet, or law enforcement has seized assets under legal process. Save the complete notice and delivery details, preserve ownership and transaction records, and contact a lawyer who handles asset forfeiture and digital assets in the jurisdiction named in the papers.
“Frozen” is not a single legal event. The response, deadline and available challenge depend on who restricted access, where the provider or wallet is located, and whether the matter is a civil forfeiture, criminal case or another proceeding.

What to do in the first 24 hours
- Save the complete notice. Keep the original email or letter, every page and attachment, the envelope or electronic delivery record, the date and time received, case or reference numbers, and contact details for the issuing authority or provider. Export the notice to a read-only format, but do not alter the original.
- Identify who restricted access. Ask the exchange or custodian whether the restriction is an internal compliance action, a law-enforcement request, a warrant, a court order or another legal instrument. Ask which authority issued it and request a copy or the information the provider can lawfully disclose. A provider may be unable to reveal some details, but the question helps establish whether this is a platform restriction or government process.
- Preserve financial and blockchain records. Download account statements, deposit and withdrawal histories, transaction IDs, wallet addresses, screenshots of balances, identity-verification records, invoices, tax records and communications. Keep records showing how the bitcoin was acquired and who owns it.
- Protect evidence without changing it. Do not delete messages, wipe phones or computers, reset a hardware wallet, change relevant account data, or discard a device. Make ordinary safety copies and record where they are stored. Do not move bitcoin that may be covered by an order.
- Call qualified counsel promptly. Give a lawyer experienced in asset forfeiture and digital assets the complete papers, not just a screenshot of the first page. Counsel can identify the governing jurisdiction, calculate the correct deadline, communicate with investigators and decide whether a claim, appeal, motion or other response is available.
- Follow the notice exactly. Use the address, portal, form, oath and service method stated in the actual notice. Missing a signature, sworn statement or service requirement can be as damaging as missing the date. A general article cannot calculate your deadline without the documents and procedural posture.
Is your bitcoin restricted, frozen by court order or seized?
The words used by an exchange or agency do not by themselves establish what happened. Use the document and the custodian’s explanation to classify the event.

The same wallet can be affected by more than one step—for example, an exchange can lock an account after receiving a warrant, followed by a separate forfeiture notice. Treat each document as a distinct event and keep a dated timeline.

Work out the custody and location questions
Exchange-held bitcoin
When a U.S.-based virtual-asset service provider holds the bitcoin, the U.S. Department of Justice Asset Forfeiture Policy Manual describes an agency obtaining and serving a seizure warrant on that provider. The manual is guidance for prosecutors and agents, not a complete statement of every federal or state remedy available to an owner. Read the warrant and any later notice to learn exactly which property, account or transaction is covered: DOJ Asset Forfeiture Policy Manual 2025, Chapter 4.
Self-custody bitcoin
For self-custodied cryptocurrency in the United States, the same manual describes obtaining a seizure warrant and serving the owner or the owner’s counsel. The legal process may concern the coins, a device, private keys or evidence connected with the wallet. Do not transfer funds to a new address merely because you still can; counsel should examine the warrant’s language before any action.
Foreign-located providers
A provider incorporated or operating outside the country handling the investigation can require a different service method and international legal assistance. The DOJ manual discusses foreign-located providers separately and notes that cross-border assistance may be necessary. A U.S. notice does not automatically tell you how another country’s custodian will respond: DOJ Asset Forfeiture Policy Manual 2025, Chapter 4.

Who has legal control?
List every participant: the exchange, a lending or staking service, a hardware or software wallet, a joint owner, an estate, and any intermediary that transferred the bitcoin. Ownership evidence may differ from control of a private key. Your lawyer needs that chain to identify the correct claimant and respondent.
Build an ownership and transaction file
Organize the evidence chronologically and keep an untouched copy. Include:
- Purchase confirmations, payroll or business records, gifts, inheritance documents and tax filings showing acquisition.
- Exchange statements and deposit or withdrawal records, including transaction IDs, timestamps, network fees and destination addresses.
- Wallet addresses, public keys and screenshots of balances captured before the restriction, without exposing a private key or recovery phrase.
- Contracts or messages explaining beneficial ownership when an account was held for a company, family member or client.
- Identification and address records that connect you to the account, while sharing sensitive material only through a secure channel approved by counsel.
- Every call, email and chat with the provider or investigators, with dates, names and the exact wording used.
Do not manufacture a provenance narrative after the fact. Mark gaps honestly; a lawyer can decide whether independent blockchain analysis, accounting records or witness statements are appropriate.

Deadlines are controlled by the notice and jurisdiction
There is no universal “bitcoin seizure deadline.” The date can depend on whether the government filed a civil forfeiture case, began a criminal prosecution, obtained a freezing order, or a provider imposed a contractual restriction. Service method and the type of property also matter.
United States: federal civil forfeiture
Forfeiture.gov explains that filing a claim contests the seizure and requests court proceedings. Its FAQ says the claim must describe the seized property, identify the claimant’s interest and be sworn. Use the official instructions for the notice you received: Forfeiture.gov FAQs for Online Claims.
Federal civil-forfeiture notice and claim rules appear in 18 U.S.C. § 983, but the applicable route and timing depend on the process and the actual notice. Read the current statutory text and have counsel check whether the agency used administrative or judicial proceedings: 18 U.S.C. § 983 (2024). Do not import a deadline from another person’s case or assume that filing a claim guarantees a hearing or return of the bitcoin.

United Kingdom: a specific statutory example
UK Home Office circular 005/2024 summarizes cryptoasset civil-forfeiture provisions inserted into the Proceeds of Crime Act 2002 by the Economic Crime and Corporate Transparency Act 2023. In the described regime, a judicial authority can make a crypto wallet freezing order, and an affected person may apply to vary, set aside or recall it. The circular also describes possible exclusions for reasonable living expenses, continuing a business and legal expenses, subject to the court and statutory conditions: Home Office circular 005/2024.
For the forfeiture decisions covered by that circular, an appeal must be lodged within 30 days of the court order. That is a UK-specific period under the described provisions—not a general deadline for challenging a bitcoin seizure elsewhere. The order and current UK law control.
Civil forfeiture versus criminal confiscation
Documents may refer to civil forfeiture, criminal confiscation, restraint, seizure or freezing. Those labels can change who must prove what, which court hears the matter and when a challenge is due. Ask counsel to identify the exact proceeding rather than treating every government hold as the same case.

How to communicate without harming your position
- Keep provider communications factual: ask what assets and dates are affected, the legal or contractual basis, and where to send a formal claim or appeal.
- Do not speculate about other people, explain transactions informally to investigators or sign a statement without legal advice.
- Do not post the notice, wallet addresses, identity documents or theories about the investigation publicly. Public disclosures can expose personal data and may complicate the case.
- Beware impersonation scams. A genuine authority or exchange should not require a “release fee,” a new deposit or your recovery phrase to unfreeze bitcoin.
Prepare for the lawyer’s first review
Send counsel a short chronology with the restriction date, last unrestricted balance, every notice received and all known deadlines. Attach the complete papers and identify whether the bitcoin was exchange-held, self-custodied, jointly owned or held for a business. Explain any cross-border connection, previous investigation, loan, gift or sale that could affect ownership.
Ask the lawyer to answer four practical questions:
- What authority and proceeding caused the restriction?
- Which assets, addresses, devices and records are actually covered?
- What claim, appeal, motion or response is available, and what are the filing and service requirements?
- Can counsel request access for legal fees, living expenses or business operations where the applicable law permits it?
A lawyer may also coordinate with the exchange, a forensic accountant or a blockchain investigator. Those professionals should work under a clear scope and evidence-preservation plan; do not independently alter wallets or devices to assist an investigation.
Can seized bitcoin be recovered?
Sometimes an owner can contest the government’s interest, prove a lawful ownership stake, obtain a release or succeed on an appeal. In other cases, a court may order forfeiture or criminal confiscation, or a provider may maintain a restriction under its terms. The result depends on the evidence, the notice, the court and the law governing the case. No general article can promise recovery, and a filed claim alone does not guarantee a hearing or the return of the coins.

Keep monitoring the docket or provider correspondence after filing; silence from an exchange or agency does not necessarily mean the hold has ended.
When the restriction is lifted
Obtain written confirmation of what was released, what remains restricted and whether any reporting or preservation obligation continues. Reconcile the released balance and transaction history with your records. Before moving funds, confirm with counsel that no order, consent agreement or continuing investigation covers the addresses, devices or proceeds. Update account security only after evidence has been preserved and your lawyer confirms that the changes will not interfere with the case.
