Tell the lender whether the income problem is temporary or ongoing, ask for the exact amount required to bring the account up to date, and request any proposed repayment change in writing. Do not assume that a lower EMI, new due date, waiver or payment holiday applies until the lender formally confirms it.
Before the conversation, collect your loan agreement, latest statement, repayment schedule and any notices. Prepare a realistic household cash-flow summary so you can distinguish an affordable temporary arrangement from a change that only postpones a larger problem.

What to do in the first 24 hours
- Use an official lender channel. Call the customer-care number on your statement or lender website, visit a branch, or use authenticated online banking. Keep the complaint or service-request number, date, time and the employee’s name.
- Describe the shortfall clearly. State the EMI amount, the date you expect to be unable to pay (or the date already missed), the reason for the income disruption, and whether you expect income to recover. Avoid promising a payment date that your cash flow cannot support.
- Request an account-status statement. Ask for the scheduled due date, days overdue, unpaid principal and interest, normal interest continuing on the unpaid amount, each charge, taxes if any, and the total needed to regularise the account as of a specified date.
- Ask what assistance is available. The lender may consider regularising arrears or restructuring, but RBI guidance does not guarantee a concession to an individual borrower. Ask for eligibility conditions, documents, fees, revised EMI, revised tenure and total repayment in writing.
- Confirm every change in writing. A telephone assurance is not a revised contract. Continue following the existing schedule unless the lender confirms a different arrangement and its effective date.
RBI directions say the loan agreement should specify repayment dates, frequency and the principal-interest breakup, and that borrowers should be informed about due dates and subsequent changes in terms. Use those documents to check what the lender tells you.
Build an accurate picture of the account and household budget
Documents to have ready
- Signed sanction letter and loan agreement, including the interest-rate and charge clauses.
- Latest loan statement and repayment schedule.
- Bank statements showing recent EMI debits or failed mandates.
- Messages, emails and notices from the lender or collection agent.
- Proof of an income interruption or expense shock if the lender requests it.
- A list of essential monthly costs, other debt payments, available savings and reliable income.
Questions that prevent misunderstandings
- What is the contractual EMI and exact due date?
- How many days overdue is the account, calculated from which date?
- How much of the unpaid amount is principal, normal interest, penal charge and other disclosed fees?
- Will an arrangement change the interest rate, EMI date, tenure or total amount payable?
- Will a partial payment be accepted, and how will it be allocated?
- What document makes the arrangement effective, and when must it be signed or paid?
Do not rely on an app balance alone if it conflicts with a formal statement. Ask the lender to reconcile the figures and preserve copies of every document.

How missed-EMI charges work
The Reserve Bank of India’s Fair Lending Practice – Penal Charges in Loan Accounts: Frequently Asked Questions says a repayment default may attract a penal charge rather than penal interest. The charge should be reasonable, related to the amount in default, applied under a board-approved policy and not added to principal in a way that causes further interest to be charged on the penal charge. RBI’s circular dated August 18, 2023 describes penal charges as a credit-discipline measure, not a revenue-enhancement tool.
This does not mean that an unpaid EMI stops accruing all amounts. The FAQ states that normal interest at the contracted rate may continue on unpaid amounts, including an unpaid EMI, until the default is remedied. Ask the lender to show the penal charge as a separate line and explain its calculation. The actual amount depends on your agreement, the lender’s disclosed policy and the account history; no universal percentage can be applied to every Indian home loan.
Ask for a dated “amount to regularise” because charges and contracted-rate interest can change while an amount remains unpaid. If you believe the calculation conflicts with the agreement or the lender’s policy, raise a written query and retain the response.

What overdue days mean—and what they do not prove
RBI’s Resolution of Stressed Assets – Revised Framework (June 7, 2019) describes these overdue stages:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
| Stage | Overdue period in the framework | How to use the information |
|---|---|---|
| SMA-0 | 1–30 days overdue | Use it as an early-warning point and contact the lender before arrears grow. |
| SMA-1 | 31–60 days overdue | Ask for a written cure amount and discuss a sustainable arrangement promptly. |
| SMA-2 | 61–90 days overdue | Escalate the request to the lender’s appropriate resolution or grievance team. |
The same 2019 framework contains a CRILC reporting provision for borrower entities with aggregate exposure of ₹50 million or more. That threshold is not a universal consumer-home-loan credit-reporting cutoff. The stages above do not, by themselves, establish what a particular bureau will show, when a lender will report, or what enforcement action will follow. Ask your lender how it reports your account and check current bureau rules for your circumstances.
Do not wait for a particular stage before asking for help. Earlier contact generally gives more time to verify figures, provide documents and assess a workable payment.
Possible ways to resolve the arrears
Pay the overdue amount and regularise
If the income shock is short-lived, ask for the exact cure amount and the final date on which it is valid. Confirm how the payment will be allocated and when the account will show as current. Obtain a receipt or updated statement rather than assuming that a transfer has closed the arrears.

Restructure the loan
RBI’s stressed-assets framework identifies restructuring as a possible resolution action. Depending on the lender’s policy and your circumstances, a proposal could alter EMI, tenure, rate or other terms. It is not an automatic right, and requesting it does not guarantee approval.
Rank #3
Compare the proposal against your existing contract. A lower EMI can result from a longer tenure and a higher total repayment. Ask for an amortisation schedule showing principal and interest over the revised term, all one-time or recurring charges, the effective date and any consequences of missing the revised payment.
Consider a temporary arrangement only if the end point is credible
If the lender offers a short-term deferment, reduced payment or catch-up plan, identify when the deferred amount becomes due and whether it is added to later EMIs or the loan balance. Test the future payment against conservative income, not an optimistic forecast. Reject an arrangement that merely moves an unaffordable lump sum to a later date unless you have a documented plan to fund it.
Settlement or closure discussions
If regularisation or restructuring is not feasible, ask the lender to explain any settlement or enforcement path in writing and obtain independent legal or financial advice before signing. The supplied RBI material does not establish a standard settlement amount or the legal consequences for a particular property, borrower or co-borrower.
How to compare a lender’s proposal
Put the current loan and every proposed arrangement in one table. Use figures supplied by the lender for your account, not generic calculators.
Rank #4
| Comparison point | What to verify | Why it matters |
|---|---|---|
| Immediate cash required | Overdue EMI, normal interest, penal charge and other disclosed amounts through a stated date | Shows whether you can actually start the arrangement. |
| New EMI and due date | Amount, debit date, frequency and whether the first revised payment differs | Prevents a second failure caused by an overlooked date. |
| Tenure | Additional months and final maturity date | A longer term can reduce the instalment while increasing total interest. |
| Total repayment | Principal, contracted interest and every disclosed charge over the full revised term | Measures the true cost rather than judging by EMI alone. |
| Interest and reset terms | Rate, benchmark, spread and reset frequency, if applicable | Future EMIs may change even after approval. |
| Account consequences | How the lender will classify, report or monitor the account | Requires account-specific confirmation; RBI staging alone is not a universal reporting rule. |
Ask for a signed or otherwise authenticated offer and a copy of the revised schedule. Do not pay an intermediary that promises guaranteed approval; deal with the lender through verified channels.
If collection calls or visits become abusive
RBI Fair Practices guidance says lenders should not use undue harassment in recovery. It gives “persistently bothering the borrowers at odd hours” and “use of muscle power for recovery of loans” as examples. A missed EMI does not remove your right to respectful communication.
- Keep a log with date, time, number, agent name, agency, words used and any witness.
- Save messages, emails, voicemails and visit details. Do not edit the originals.
- Tell the agent that future communication should follow the lender’s documented process and provide your official complaint reference.
- File a written complaint through the lender’s existing grievance channel, attaching the log and evidence.
- If the lender does not address the issue, follow the next escalation route stated in its grievance policy and seek appropriate local legal help where safety is threatened.
RBI’s recovery-grievance FAQ says lenders should address such complaints promptly and may use their existing customer-grievance process; it does not prescribe a guaranteed resolution time or require a separate mechanism.

What not to do
- Do not ignore calls, notices or statements; silence removes opportunities to correct a mistake early.
- Do not assume a failed auto-debit is the same as an approved payment holiday.
- Do not pay a collector’s personal account or an unverified link.
- Do not conceal a co-borrower or guarantor from a proposed change; ask how each party must consent.
- Do not use expensive short-term borrowing without comparing its full cost and repayment date with the home loan.
- Do not sign blank forms or accept an oral promise that is absent from the written proposal.
Practical scripts for contacting the lender
First call or message
“My home-loan EMI due on [date] is unaffordable because of an income shortfall. I expect the problem to be [temporary/ongoing]. Please confirm my account’s overdue days, the amount required to regularise it as of [date], each charge and the available repayment or restructuring options. Please send any proposal, revised EMI, tenure, total repayment and effective date in writing.”
Best Value
- It can be a gift option
- Comes with secure packaging
- Helpful in various ways
Keep variable details such as dates and amounts inside your own message; the lender’s statement must supply the actual figures.
Written dispute about a charge
“Please identify the contractual clause and board-approved policy basis for the charge of [amount], show the calculation and confirm that no further interest is being capitalised on the penal charge. Please also state the normal contracted-rate interest applied to the unpaid amount.”
When to seek additional help
Consider independent advice if you cannot understand the revised schedule, several debts compete for the same income, a co-borrower disagrees, the lender threatens enforcement, or collection conduct raises safety concerns. Bring the agreement, statements, notices and complaint record. Advice cannot guarantee a waiver or stop contractual consequences, but it can help you understand documents before signing.
RBI materials do not provide a statistic showing how many Indian borrowers miss EMIs or the probability that a particular borrower will receive relief. They also do not establish a named lender’s current fee, an individual’s credit-bureau outcome or the legal result of enforcement against a particular property. Those questions require current account documents and lender communication.
