Before buying an annuity, confirm what the contract guarantees, when and how it pays income, what it costs, and how much access you retain to your money. Then check the insurer’s claims-paying ability and whether the contract fits your cash needs, taxes, beneficiaries, and broader retirement plan. The details vary by contract and state, so rely on the actual contract and applicable disclosures—not a headline illustration or a general promise.
This U.S.-oriented checklist is for comparing an annuity before committing retirement savings. Annuities are insurance contracts, and their features can differ substantially. A useful review separates contractual guarantees from current rates and projections, identifies every cost and restriction, and tests the contract against the income and liquidity you actually need.

Start by identifying the contract and its purpose
First establish what kind of annuity is being offered and what job it is meant to do in your retirement plan. “Annuity” covers contracts with different payment timing, accumulation mechanics, investment risk, and guarantees. The contract—not a broad product label or sales description—sets the terms.
When does income begin?
- Immediate annuity: Payments begin soon after purchase, according to the contract’s payment terms.
- Deferred annuity: The contract is intended to accumulate value before income begins or before the owner chooses to take distributions.
Ask whether the goal is income beginning soon, income later, accumulation, or a combination. If you are considering a deferred contract for future income, pin down when you expect to use it and what needs to happen before payments start.

How is value credited or invested?
- Fixed: The contract offers fixed terms for credited value or benefits as stated in the contract.
- Fixed indexed: Crediting is linked to an index under contract rules. Caps, participation rates, spreads, or other limits can affect how much of a gain is credited.
- Registered index-linked: The contract links results to an index and uses contract terms that can limit or otherwise shape gains and losses.
- Variable: Investment performance and the contract’s guarantees and charges matter; variable annuities also have a prospectus.
These labels do not tell you the complete risk or return. Request the contract and the applicable disclosures; for a variable annuity, request and read the prospectus. Ask the seller to explain the mechanics in plain language and point to the controlling contract provisions.
Separate guaranteed income from projections
An illustration may show amounts based on current rates, assumptions, or other terms that are not guaranteed for the full period shown. A contractual guarantee is different: it applies only as written, and may depend on the contract’s conditions. Do not compare two headline projections until you know which figures are guarantees and which depend on assumptions.
For every income figure presented, ask:
- What amount is contractually guaranteed, and when can payments begin?
- How long do payments last: for a specified period, for one person’s lifetime, or under another payment option?
- Can payments continue for a spouse or another beneficiary after the owner dies, and what does that option require?
- Which figures depend on current rates, caps, crediting rules, or illustration assumptions?
- What conditions must be met to receive the stated guarantee, and what happens if you withdraw money, change an election, or end the contract?
- Are there inflation-related terms, and if so, how do they work under the actual contract?
Compare income offers on the same start date, duration, survivor choices, and other assumptions. Record each guarantee separately from any illustrated or current value. The SEC’s Investor.gov explains that an insurer’s obligations under an annuity contract are subject to its financial strength and claims-paying ability; a contract guarantee is not a substitute for checking the issuer.

Ask about every charge
- Upfront charges, if any, and ongoing contract fees.
- Fees for optional riders or benefits, including how and when they are deducted.
- Underlying investment or fund expenses when the contract offers investment options.
- Surrender charges, including the schedule and when each charge applies.
- Any market-value or interim-value adjustment that may apply to a withdrawal, transfer, or surrender.
For each item, ask whether it is deducted from account value, reflected in another contract value, or triggered only by a particular action. Get the answer in the contract or disclosure rather than relying solely on a verbal summary. The NAIC’s 2022 Buyer’s Guide to Fixed Deferred Annuities states: “Fees and charges reduce the value of your annuity.”
Understand how crediting limits affect returns
For a fixed indexed or registered index-linked contract, ask how caps, participation rates, spreads, and any other crediting rules work. Find out which terms are guaranteed and which can change, when they can change, and how a change would affect credited gains. Do not treat index-linked language as a promise that the contract will receive the index’s full return. The contract’s formula and limitations govern.
For a variable annuity, include both contract-level charges and the expenses of the chosen investment options in your comparison. Read the prospectus for the investment choices, fees, risks, and relevant contract terms. A comparison that omits underlying expenses or rider charges is not an all-in comparison.
Map access to your money before you sign
Liquidity is a central trade-off: taking money out early may trigger charges or adjustments, reduce future benefits, or end the contract. Make a written timeline of when you may need money and compare it with the contract’s surrender period and withdrawal provisions.

- Write down the surrender period and schedule. Identify how long surrender charges can apply and how the charge changes over time. Do not assume the charge disappears after a single year or applies uniformly; use the schedule in the contract.
- Identify penalty-free withdrawals. Ask what amount, if any, may be withdrawn without a surrender charge, when that allowance is available, and whether it recurs. Check the contract for limits and conditions.
- Read the waiver provisions. Find out whether the contract waives charges in specified circumstances, what proof is required, and whether a waiver is automatic or must be requested.
- Ask what happens after a partial withdrawal. A withdrawal may affect account value, future income, or optional benefits. Ask the insurer or seller to show the contract provision that explains the effect.
- Check for additional adjustments. A transfer or withdrawal before the end of a term may trigger a market-value or interim-value adjustment in addition to any surrender charge. Ask which transactions can trigger it and how the contract describes the calculation.
- Understand full surrender. Taking all the money out generally terminates the contract and the right to future income. Confirm the steps, any charges or adjustments, and what benefits end before deciding that full access is available.
Keep foreseeable spending needs outside funds you may have to withdraw early. That is especially important for expenses whose timing or amount is uncertain; a penalty-free allowance is not the same as unrestricted access to the full contract value.
Check the insurer behind the promises
The insurer is responsible for contractual obligations, so assess its current financial-strength information and claims-paying ability. Consult independent rating agencies and your state insurance department. A rating is an assessment, not a guarantee that a claim will be paid or that a contract is risk-free.
Record the insurer’s legal name from the proposed contract, not just a product or marketing name, and look at current information rather than assuming that an older rating remains unchanged. Ask how the insurer’s obligation is described in the contract. The SEC’s Investor.gov highlights the connection between an insurer’s financial strength and its ability to meet annuity obligations.

Tax treatment depends on the purchase source, account type, and distributions. Before signing, ask how the annuity will be held, when distributions are taxable, and whether an early withdrawal may also have an additional tax penalty. These are questions for your own circumstances, not outcomes that can be determined from a product label alone. Consult a qualified tax professional when needed.

Also verify the free-look deadline and the return procedure that apply to the actual contract and your state. Do not assume a generic number of days. Read the contract’s cancellation language, identify how to give notice, where to send it, and whether the deadline depends on when you receive the documents or another event. If the process is unclear, contact the insurer and your state insurance department before the deadline.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Test whether the annuity fits your retirement plan
An annuity should be considered alongside expected expenses, other reliable income, other assets, time horizon, risk tolerance, cash needs, beneficiary priorities, and taxes. A benefit that appears attractive in isolation may not fit if it restricts money you expect to need, duplicates income you already have, or conflicts with your goals for heirs.
Before committing, write down the role the contract is meant to play. For example, distinguish the expenses you want covered by dependable income from expenses you expect to meet with accessible assets. Then consider how the annuity’s start date, payment duration, survivor provisions, liquidity limits, and guarantees line up with that plan. This is a decision framework, not a substitute for an individualized recommendation.
- Cash needs: List near-term and foreseeable large expenses and identify which assets will cover them.
- Other income: Account for other dependable retirement income and note whether the annuity fills a genuine gap.
- Other assets: Consider what remains accessible if you commit money to the contract.
- Time horizon and risk tolerance: Check whether the contract’s timing, investment exposure, guarantees, and restrictions are tolerable for you.
- Beneficiaries: Confirm whether the selected payment option supports your goals for a spouse or other beneficiary.
- Taxes: Consider how the funding source and distribution choices interact with your tax circumstances.
Official investor guidance recommends evaluating whether an annuity’s features, benefits, risks, and fees fit your circumstances and goals. There is no universal best contract established by the available official guidance; suitability depends on contract terms and personal circumstances.

Ask how the recommendation and seller compensation work
Ask the person recommending the annuity how they are compensated, what alternatives they considered, and why this particular contract fits your goals, cash needs, time horizon, and other assets. Request a clear explanation of the trade-offs, including what you give up in exchange for guarantees or benefits. If the explanation depends on an illustration, ask which parts are contractual and which rely on assumptions.
NAIC model guidance describes best-interest requirements for annuity recommendations, but state adoption and details should be checked locally. Ask what rules apply where you live and how the recommendation addresses your circumstances. Do not treat a general statement that a product is “best” as a substitute for an explanation tied to your own needs.
Compare contracts on the same basis
If you are considering more than one contract, use the same assumptions and record the differences in one place. A comparison is only useful when it includes both the benefits shown and the conditions, costs, and restrictions attached to them.

- Income: Guaranteed payment, start date, duration, survivor provisions, and any inflation-related terms offered.
- Guarantees and uncertainty: What is guaranteed, for how long, under what conditions, and what depends on current rates, caps, or assumptions.
- All-in economics: Contract fees, fund expenses, rider charges, surrender schedule, adjustments, and limits on credited returns.

When a salesperson presents an illustration, ask for the matching contract provision or disclosure for each guarantee, charge, and withdrawal condition. If the explanation or document set leaves a material question unanswered, pause the purchase rather than filling the gap with an assumption.
Use a document-and-question checklist before committing
Keep the following materials together so the decision is based on the actual offer, not a summary of it:
- The proposed contract and all applicable disclosures.
- The variable annuity prospectus, if the product is variable.
- Any illustration, with the assumptions and current terms clearly identified.
- A written list of contract fees, fund expenses, rider costs, surrender charges, and adjustments.
- The surrender and withdrawal schedule, including free-withdrawal and waiver terms.
- Written answers about guaranteed income, start date, duration, survivor options, and what changes after a withdrawal.
- Current insurer financial-strength information and relevant state insurance department information.
- A clear explanation of seller compensation, alternatives considered, and why the recommendation fits.
- Tax questions resolved for your purchase source and account type, plus the contract’s exact free-look instructions.
Before signing, make sure you can explain in your own words what is guaranteed, what is not, when you can access the money, what access may cost, and what happens to income or beneficiary benefits if you change course. If those answers are not clear in the documents, request clarification before making an irreversible commitment.
What varies by state and contract
Rates, caps, fees, guarantees, surrender schedules, tax consequences, free-look periods, and state requirements can differ by contract or location and may change over time. NAIC consumer materials cited here include its annuity overview, updated September 30, 2026, and fixed deferred annuity buyer’s guide published in 2022. Check for newer consumer materials and confirm the terms in the contract available to you. A model rule or general guide does not establish every buyer’s rights or terms.
