The dye does not make the fuel legal for every vehicle that leaves the pavement: ordinary highway use generally requires undyed, taxed diesel, and eligibility depends on the specific use and applicable state rules.
What red-dyed diesel means
Red-dyed diesel is diesel fuel colored to identify it as intended for a nontaxable use under federal fuel-tax rules. The Internal Revenue Service (IRS) describes undyed diesel as fuel sold for highway-use vehicles, with excise tax collected at the time of sale. Dyed diesel is designated for qualifying uses that are not taxed in the same way.

The dye is a marker for the fuel’s tax treatment, not a general discount available to anyone who buys it. A buyer’s occupation, the vehicle’s location at the time of purchase, or the fact that a task supports a farm or business does not by itself establish eligibility. What matters is whether the fuel is used in a category recognized by federal rules and whether any state requirements are met.
“Red diesel” and “off-road diesel” are common names for dyed fuel, but the phrase “off road” is not a complete legal test. Some nontaxable-use categories depend on the nature of the work and the type or registration status of the equipment. Conversely, a vehicle may do work for a farm or contractor and still be a highway vehicle for tax purposes.

Who can legally use it
Federal tax rules identify several nontaxable-use categories. IRS materials include fuel used on a farm for farming purposes and qualifying off-highway business use, along with categories that include some buses, commercial fishing, exports, certain government uses, and fuel used other than as propulsion fuel in a diesel highway vehicle. Each category has its own conditions; the list does not mean every person or vehicle associated with those activities can use dyed fuel.
Farm machinery and farm work
Fuel used in qualifying farm equipment for farming purposes may fall within a nontaxable category. The farm connection must relate to the actual use of the fuel, not merely the user’s job or ownership of a farm. A tractor performing eligible field work is different from a road truck making a trip on a public highway, even if both are owned by the same farmer and the truck’s trip supports the farm.
Off-highway business equipment
The IRS Form 720 instructions describe off-highway business use as business use other than in a highway vehicle registered, or required to be registered, for highway use, subject to the detailed categories and exceptions in the instructions. That makes the equipment’s legal status and its actual use relevant. A machine that operates away from public roads is not automatically eligible if the particular use does not qualify.

Other defined uses
Federal materials also provide for other specified nontaxable uses, including some government and commercial activities. These are defined categories, not broad permissions based on a buyer’s identity. Check the applicable IRS category and state requirements before using dyed fuel for a use outside the familiar farm-equipment example.

Can you use red diesel in a truck or on a public road?
For ordinary highway driving, use undyed, taxed diesel unless you have confirmed that a specific federal and state exception applies. A vehicle’s connection to a farm or business does not generally make dyed fuel lawful in its tank for highway use. The IRS Farmer’s Tax Guide gives a direct warning: “you shouldn’t use dyed diesel fuel in a truck that is used both on the farm for farming purposes and on the highway, even though the highway use is in connection with farm business.”
This warning is especially important for mixed-use vehicles. If a truck goes between farm property and public roads, the fact that one trip carries farm supplies—or that most of its work takes place on the farm—does not itself authorize dyed diesel in the truck. Do not assume that a vehicle can switch between dyed and undyed fuel depending on the trip unless the relevant authority confirms that arrangement is allowed.
Some federal and state exceptions do exist, but they are specific. Washington, for example, describes a licensing route for approved government agencies and organizations using dyed special fuel in licensed vehicles on public roads. California’s statute states a general prohibition on operating a motor vehicle on a public highway with dyed diesel in its supply tank, while preserving specified exceptions for federally lawful uses by certain registered users. Neither example creates a blanket exception for farmers, contractors, or government-associated drivers elsewhere.

Before buying or using dyed fuel, work through the facts of the particular vehicle and task. If any answer is unclear, ask the tax authority for the state where the fuel will be used, or a qualified tax professional, before relying on an exception.

- Identify the actual use. Describe what the equipment will do and whether it falls within a defined nontaxable-use category, such as qualifying farm work or off-highway business use. Do not stop at labels like “farm truck,” “work vehicle,” or “off road.”
- Check the vehicle’s highway status. Determine whether it is a highway vehicle registered—or required to be registered—for highway use. This is a central distinction in the IRS description of off-highway business use.
- Separate work-site use from road use. Consider every use of the vehicle, including travel on public highways. A business or farm purpose for a road trip does not, by itself, turn that trip into eligible off-highway use.
- Look for a specific exception. If the vehicle will be used on a public road with dyed fuel, verify the exact federal and state provision and any user-class, registration, or license conditions. Do not treat an exception for one jurisdiction or user type as a national rule.
- Check the state where the fuel will be used. Confirm any licensing, purchase documentation, or other requirements with that state’s tax or licensing authority. Federal eligibility alone may not resolve state-law requirements.
- Use undyed fuel if eligibility is not established. For ordinary highway use, undyed, taxed diesel is the appropriate default. Keep the fuel choice aligned with the established use and any applicable documentation obligations.
Dyed fuel versus undyed highway diesel
| Question | Dyed diesel | Undyed diesel |
|---|---|---|
| Intended tax treatment | Marked for uses treated as nontaxable under applicable fuel-tax rules. | Sold for highway-use vehicles, with federal excise tax collected at the time of sale, according to IRS Publication 225 (2025). |
| Typical situation | A qualifying farm or off-highway business use, if the specific facts meet the category’s conditions. | Ordinary use in a vehicle driven on public highways. |
| Does the user’s job decide eligibility? | No. The actual use and applicable category matter. | It is the ordinary choice when highway use does not qualify for a specific exception. |
| Can an exception change the answer? | Potentially, but it must be confirmed under the applicable federal and state rules. | Undyed fuel is not a substitute for checking a special rule when one applies. |
The table is a practical distinction, not a complete statement of every fuel-tax category. The IRS lists other nontaxable uses, and state law may impose additional requirements.
How the dye is regulated
IRS Publication 510 describes federal dyeing requirements: the fuel must be indelibly dyed through mechanical injection and contain Solvent Red 164 at the prescribed concentration, or another approved dye at its approved concentration. The dye is therefore a regulated marker, rather than a visual color added casually by a retailer or user.
These specifications explain how qualifying fuel is identified; they do not decide whether a particular buyer or vehicle may use it. A red appearance is not a substitute for checking the purpose, vehicle status, and jurisdictional rules that govern the use.
Penalties and tax recovery
Penalty for unlawful use
IRS Publication 225 (2025) states that the federal penalty for an unlawful use of dyed fuel is the greater of $1,000 or $10 per gallon involved. The IRS says the $1,000 component increases according to the number of violations after the first. State penalties may apply separately, so this federal figure is not a statement of the total possible cost in every state.

The amount is tied to the gallons involved, not just to whether the vehicle was used for a short trip. Do not use a small quantity, a work-related purpose, or a mistaken assumption about eligibility as a reason to treat the fuel as lawful. Verify the rule before filling a vehicle that may be used on public roads.
Buying taxed fuel for an eligible use
Dyed fuel is not the only possible tax treatment for an eligible use. Publication 225 explains that a qualifying user who bought undyed fuel may in some circumstances claim a credit or refund. Whether a claim is available depends on the applicable rules and facts; it is not an automatic refund for every off-highway purchase. Follow the current IRS form instructions and retain whatever records the claim requires.
Section 6435 claims for certain dyed-fuel removals
IRS Schedule 5 instructions revised in May 2026 describe section 6435 claims for certain diesel or kerosene that was previously taxed and later removed from a terminal as eligible dyed fuel. The instructions apply to eligible dyed-fuel removals on or after December 31, 2025. This is a narrow procedure for recovering tax on qualifying fuel; it does not authorize highway use of dyed diesel. Anyone filing should consult the current instructions to confirm the fuel and transaction meet the requirements.
State rules: examples of why location matters
Federal rules do not answer every state-law question. Washington, California, and Texas illustrate different requirements, but these examples are not a survey of all states and should not be applied outside their jurisdictions.
- Washington: The Department of Licensing calls dyed diesel “marked fuel” or “farm fuel,” lists common non-highway uses, and says approved on-road users need a license. It also warns that recent federal notices do not change Washington requirements.
- California: Revenue and Taxation Code section 60101 generally prohibits operating a motor vehicle on a public highway with dyed diesel in its supply tank. The statute preserves specified exceptions for federally lawful uses by certain registered user classes.
- Texas: The Comptroller describes dyed diesel as intended for off-highway use and explains that some bulk deliveries into a storage tank require end-user statements or numbers. Texas forms and thresholds are not rules for other states.
These differences matter when a business buys fuel in bulk, operates across state lines, or has an approved user status. Check the authority for the state where the fuel is used, not only the rules where it was purchased or where the vehicle is registered. Do not assume that a federal notice, another state’s license, or a supplier’s description settles the local requirements.
Quick Recap
Common mistakes to avoid
- Treating “off-road” as enough: Eligibility depends on a specific tax category and the equipment’s use; physical location alone is not a complete test.
- Assuming farm ownership authorizes road use: A mixed-use truck can remain a highway vehicle even when its trips support farm work.
- Generalizing an exception: A licensing or registered-user exception in one state does not authorize the same use in another state or for a different type of user.
- Confusing a refund with permission: A credit or refund process for tax paid on eligible fuel does not mean a user may put dyed fuel in a highway vehicle.
- Relying on a tank or bulk purchase to establish eligibility: Storage and delivery arrangements do not change the legal category of the eventual use. Texas documentation requirements for some bulk purchases are state-specific.
