It can also report salary or pension, house-property income, capital gains and income from other sources. The right form depends on all your income and eligibility conditions, not just whether you run a business.
What is ITR-3?
ITR-3 is an Indian income-tax return form for individuals and HUFs whose income includes profits or gains from business or profession and who cannot use ITR-1, ITR-2 or ITR-4. The Income Tax Department’s AY 2026-27 guidance allows the return to include other income heads as well, such as salary or pension, house property, capital gains and income from other sources. It is not limited to people whose only income comes from a business.

The form is a category, not a personal determination. The Department says its overview is not exhaustive, so check the current instructions against your own income, status and circumstances before filing.

For AY 2026-27, ITR-3 is the relevant form to consider if you are an individual or HUF, have income under the business or profession head, and do not qualify to file ITR-1, ITR-2 or ITR-4. Business or professional income may arise from operating a business or providing professional services; the presence of other income does not by itself rule out ITR-3.
#1 Best Overall
By contrast, the Department describes ITR-2 as the broad form for individuals and HUFs who do not have profits or gains from business or profession. When that income head is present, the choice turns on whether a simpler applicable form—particularly the optional, conditional ITR-4—is available.
Should you file ITR-3 or ITR-4?
ITR-4, also called Sugam, is an optional simplified return for eligible taxpayers reporting specified presumptive income. It is not automatically available to every small business or every taxpayer using presumptive taxation. For AY 2026-27, the Department describes eligibility for qualifying resident individuals, HUFs and resident firms other than LLPs, subject to income limits, eligible income types and exclusions. A filer who meets ITR-4 conditions may choose it; if not eligible, a person with business or professional income generally needs to consider ITR-3.

Check the ITR-4 limits and exclusions
The Department’s AY 2026-27 business and profession guidance describes ITR-4 for qualifying presumptive income under sections 44AD, 44ADA or 44AE and total income up to ₹50 lakh. The taxpayer must also satisfy the residence and entity conditions: the guidance specifies resident individuals and HUFs other than those “not ordinarily resident,” and resident firms other than LLPs.
The guidance lists exclusions that can make ITR-4 unavailable even when the taxpayer has presumptive income. These include being a company director; having short-term capital gains; having section 112A long-term capital gains above ₹1.25 lakh; holding unlisted equity shares; certain foreign assets, foreign accounts, signing authority or foreign-source income; deferred tax on employee stock options; carried-forward losses; income above ₹50 lakh; and certain retirement-benefit-account cases. Review the exact AY form instructions for the full conditions and how they apply to your facts.

What ITR-3 filing involves
ITR-3 may require more than reporting a business profit figure. The AY 2026-27 validation rules cover business and profession schedules, firm-income shares, balance-sheet disclosures and audit-related reporting. The applicable entries depend on the taxpayer’s circumstances and the form’s current instructions.
- Balance-sheet reporting: The validation rules identify balance-sheet disclosure when business or professional income exceeds ₹2.50 lakh and require balance-sheet particulars in specified presumptive-income cases.
- Audit-related reporting: The rules include reporting related to audit provisions, including references to sections 44AB and 92E. Whether a requirement applies depends on the taxpayer’s facts and current legal thresholds.
- Loss carry-forward: The rules state that filing after the section 139(1) due date generally prevents carrying forward current-year losses, except for house-property loss and specified-business loss.
These are validation-rule notes, not a substitute for checking the current statutory requirements and filing instructions for your return.
