A freelancer provides services independently to clients, often on a project-by-project or assignment basis, rather than working in one ongoing employee role. Freelancing describes a way of working, not a legal status: whether someone is legally an employee or an independent contractor depends on the actual working relationship and the law that applies.

What does freelancer mean?

A freelancer is someone who offers services independently to clients. A freelancer may take on separate projects for different clients or continue working with one client on recurring assignments. The defining idea is independent service work—not a particular occupation, schedule, or number of clients.

The everyday word “freelancer” does not, on its own, determine legal classification. In the United States, the IRS describes an independent contractor as someone in an independent trade, business, or profession who offers services to the public. How does freelancing work?

A typical freelance engagement starts when a client needs a service and a freelancer agrees to provide it. They arrange what work will be done, the expected result, timing, and payment. The freelancer completes the work and is paid under their agreement. Assignments can be one-time projects or continuing work, and a freelancer can serve multiple clients.

These are common practical arrangements, not a universal legal test. For federal tax classification, the IRS considers the degree of control over how the work is done, financial details, and the nature of the relationship. The more a business has the right to direct the details of how work is performed, the more that may point toward employee status; the full circumstances still matter. Agree on the work and payment

Before starting, clarify the scope of the assignment, deadline or schedule, payment amount and timing, and what will count as completed work. Clear terms help both sides understand what they have agreed to; a written contract can document those terms.

Track business income and expenses

Keep records of payments and work-related expenses. For U.S. tax purposes, people treated as independent contractors are generally self-employed, and freelance work can carry tax responsibilities distinct from employee withholding. What are examples of freelance jobs?

Freelancing is not limited to creative or online work. The IRS lists doctors, dentists, veterinarians, lawyers, accountants, contractors, subcontractors, public stenographers, and auctioneers as examples of people who may work in an independent trade, business, or profession. These are examples of occupations that can be practiced independently; an occupation alone does not establish a person’s legal status.

Can I freelance part-time?

Yes. Freelance work can be a person’s main work or a side activity alongside an employee job. The IRS gives the example of someone who works as an employee in one role and runs a self-employed graphic-art business on weekends. Freelancer versus employee: what determines the difference?

There is no single freelancer-versus-employee test that applies to every legal question. Under U.S. federal tax guidance, the IRS weighs evidence in three broad categories. It says, “There is no ‘magic’ or set number of factors that ‘makes’ the worker an employee or an independent contractor and no one factor stands alone in making this determination.” IRS classification guidance

  • Behavioral control: Whether the business has the right to direct how the work is done, including instructions or training.
  • Financial control: How business expenses, investment, payment, and opportunity for profit or loss are handled.
  • Type of relationship: What the parties’ arrangement indicates, including its terms and whether the work is ongoing.

For Fair Labor Standards Act (FLSA) purposes, the U.S. Department of Labor uses an economic-realities analysis of the entire working relationship. It warns that “What the worker is called is not relevant—a worker may be an employee under the FLSA regardless of the title or label they are given.” A contract label or Form 1099 alone therefore does not establish independent-contractor status under that law. In practice, useful questions include who controls how the work is performed, who bears business expenses and financial risk, whether the work is ongoing or assignment-based, and which law’s protections and tax rules apply. These considerations do not form a universal checklist, and rules vary by jurisdiction.

Does a 1099 make me a freelancer?

No. Receiving a Form 1099 or signing an agreement that calls you an independent contractor does not, by itself, decide your worker status. The IRS and Department of Labor each look at the actual relationship for their respective legal purposes. A tax form or contract is one part of the circumstances, not a substitute for the relevant analysis.

What should freelancers keep in mind about taxes?

In the United States, people treated as independent contractors are generally self-employed for federal tax purposes. Their obligations differ from employee withholding, but the details depend on individual circumstances and the tax year. IRS guidance covers freelance work as part of the broader gig economy; for a specific situation, consult current IRS information or a qualified tax professional. These federal sources do not establish tax rules for other countries, where requirements can differ.
