A DBA is a name your business uses that differs from its legal name. To file one, identify the government office that handles assumed-name, fictitious-name, or trade-name registrations where you operate, then follow that office’s current instructions. There is no single nationwide DBA form or filing process: the right office and rules depend on your state, locality, and business structure.
What is a DBA?
DBA stands for “doing business as.” It describes a business name used instead of the owner’s or entity’s legal name. Government offices may use different terms for the same general type of registration, including “trade name,” “assumed name,” and “fictitious name.”
For example, a sole proprietor whose legal name is Jordan Lee might use “Lee Home Repair” as a business name. A company organized as Lee Services LLC might operate under a different public-facing name. Whether either must register that name depends on applicable state and local rules.
A DBA is not a type of business entity, and registration does not create an LLC or corporation. It also does not, by itself, provide trademark protection. The U.S. Small Business Administration explains that registering a DBA does not provide legal protection by itself, while the Texas Secretary of State similarly notes that an assumed-name certificate does not itself offer trademark protection. Where do you file a DBA?
The filing authority depends on where you do business and your legal structure. A filing may be handled at the state, county, or city level, and more than one office may be involved. The SBA’s state registration resource can help you find a state portal, but it does not replace checking the relevant county or city office.
Start with official government sources for each place where you operate or maintain business premises. Search the state’s business-registration agency and the appropriate county clerk or city office for “DBA,” “assumed name,” “fictitious name,” or “trade name.” Do not assume that a filing in one jurisdiction satisfies requirements in another.

Why the rules differ: examples
- Texas: The Secretary of State FAQ describes county-clerk filings for individuals and unincorporated entities that maintain business premises, and filings with the Secretary of State and appropriate county clerk for corporations, LLCs, and limited partnerships. Texas materials also reflect a legislative change affecting specified filing entities, so readers should consult the current Secretary of State instructions and county clerk rather than rely on a broad summary. - Florida: State guidance says a fictitious name must be registered before conducting business and advertised at least once in a newspaper in the county of the principal place of business. Check Florida’s current instructions and any applicable exceptions before filing. Florida fictitious name registration.
- Delaware: Beginning February 2, 2026, the Division of Revenue administers a statewide DBA registry through Delaware One Stop. The state page describes a business-license requirement for the new online process and says older county court records remain recognized. Confirm the current application details on the official page. How to file a DBA
- Identify your legal structure and locations. Determine whether you are a sole proprietor, partnership, LLC, corporation, or another entity, and list the places where you operate or maintain business premises. The applicable filing route can depend on both.
- Find the official filing offices. Check the state registration agency and relevant county or city government offices. Use the SBA’s state registration resource to locate a state starting point, then verify local requirements directly.
- Check the name and restrictions. Use the filing authority’s name-search process and review restrictions on names. A DBA registration is not a trademark clearance search; the SBA recommends checking the USPTO trademark database as part of choosing a business name. SBA: Choose your business name.
- Complete the current official form or portal application. Follow its directions for the owner or entity name, address, signature, fee, and any notice or publication requirement. These details are jurisdiction-specific; Florida’s newspaper-advertising rule is one example, not a nationwide requirement.
- Save proof of filing and note follow-up dates. Keep the confirmation and record any renewal or update deadline stated by the filing authority. There is no universal DBA duration or renewal interval established by the national guidance.
- Keep tax records aligned with the legal entity. Use the legal name and DBA consistently as required for tax documents, and follow IRS instructions if you apply for an EIN. A DBA filing alone does not automatically mean you need an EIN.
Does a DBA create an LLC, protect a name, or require an EIN?
It does not create a legal entity
Registering a DBA records a business name under applicable local or state rules. It does not form an LLC, corporation, or partnership. If you want an LLC or corporation, that entity must be formed separately with the state.
It does not grant trademark rights by itself
Business-name registrations, trademarks, entity names, and domain names serve different purposes. A DBA filing should not be treated as proof that you have the right to use a name everywhere or that another party cannot challenge it. An EIN is separate
An EIN is a federal tax identifier, not a DBA registration. The IRS says to form an LLC, partnership, or corporation with the state before applying for an EIN. Its Form SS-4 instructions distinguish the legal name from a DBA or trade name entered separately when different, and say to use the legal or trade name consistently on returns. A name change alone does not require a new EIN. Whether your business needs an EIN depends on IRS rules for its structure and circumstances.

Do you need a DBA?
There is no universal rule that every business must file a DBA, or that every business can skip one. Some rules may not require a separate filing when an owner does business only under their own legal name, but the answer depends on the jurisdiction and business structure. Check the rules where you operate before using a different name publicly. The SBA notes that most states require registration when a business uses a DBA, but the specific requirement is local to the business’s circumstances. SBA: Choose your business name.
What to verify before submitting
- The exact government office or offices that accept the filing for your structure and locations.
- The current official form, portal, fee, accepted payment methods, and processing expectations.
- Whether the name must be advertised, published, or otherwise publicly noticed.
- Whether the registration must be renewed or updated after a change in ownership, address, or business details.
- Whether the name raises trademark or other legal-rights concerns beyond the registration office’s name check.
Fees, processing times, publication steps, and renewal periods are not uniform nationwide. Use the current instructions from the government office responsible for your filing rather than relying on a generic estimate or an out-of-state guide.
