In India, a fixed deposit (FD) remains an asset after its depositor dies; it does not automatically disappear or become the bank’s property. The bank handles the claim according to the FD’s nomination or joint-holder instructions and its deceased-depositor procedure. A nominee or eligible survivor can generally claim the money after providing satisfactory proof of death and identity, unless a court order restrains payment. The senior-citizen status of the depositor does not, on the available RBI guidance, create a separate claim route.
What should the family check first?
Start with the FD receipt, deposit advice or account statement. Confirm the issuing bank, deposit number, names of all holders, nominee, maturity date and the exact operating instructions. These details determine who may approach the bank and whether a survivor can act alone. Do not rely on a passbook entry or a family member’s recollection if the bank’s recorded mandate can be checked.

- Single-holder FD: Look for the registered nominee. If there is no nominee, the claim will generally have to be made by the legal heirs under the bank’s deceased-customer process.
- Joint FD: Check the order of holders and instructions such as “either or survivor,” “anyone or survivor” or “former or survivor.” Also check whether the holders gave a separate instruction about premature withdrawal after one holder’s death.
- Multiple deposits: Check each FD separately. Different deposits may have different maturity dates, holders, nominees or instructions, even if they belonged to the same person.
Notify the bank and ask for its current deceased-depositor claim form and document checklist. Ask the bank to confirm in writing when it considers the claim complete. That date matters because the RBI’s 15-day service standard runs from receipt of the claim, not from the date the depositor died.

When there is a valid nominee
A nominee is usually the person the bank can pay after verifying the depositor’s death and the claimant’s identity. Under the Reserve Bank of India’s Master Circular on Customer Service in Banks, section 20, payment to a valid nominee can discharge the bank’s liability when the bank is satisfied with the proof and identification and has no court order restraining payment. RBI guidance says the bank should not insist on probate, a succession certificate, letters of administration, an indemnity bond or surety for this nominee claim, subject to those checks and the court-restraint condition.

That makes nomination a practical way to simplify the bank-facing claim; it does not necessarily decide the final inheritance between family members. RBI says the nominee receives the money as trustee for the legal heirs. A legal heir’s claim against the nominee is not extinguished merely because the bank paid the nominee.
When there is a surviving joint holder
The surviving holder’s ability to receive the proceeds depends on the mandate recorded for the FD and the contract with the bank. A survivorship instruction may permit the survivor to claim the balance, subject to proof of death and identity. It is not safe to assume that every joint FD permits the survivor to close it early without consulting the deceased holder’s heirs. The RBI’s joint-term-deposit guidance addresses the contractual basis for payment to survivors; the actual instructions on the account and the bank’s policy matter.
When there is no nominee or survivorship instruction
The legal heirs must use the bank’s deceased-depositor claim process. RBI guidance calls for a simplified procedure and allows banks to set a value threshold below which a claim may be settled with limited documentation. The required papers can vary with the bank, claim amount, whether there is a will, whether anyone disputes the claim and whether a court has issued an order.

For example, Indian Bank’s published FY 2026–29 policy sets a ₹15 lakh threshold for a simplified procedure in eligible no-nomination cases. Its route is conditional, including that there be no will, no contesting claim and no known court restraint, and it describes documents such as a legal-heir certificate or an acceptable declaration by an independent person alongside bank forms. This is Indian Bank’s policy, not a nationwide RBI threshold or a checklist that applies at other banks.
What documents and checks should claimants expect?
There is no single document list established for every bank and every family situation. The bank will tell claimants which version of its form and evidence it requires. Ask for the list in writing before submitting papers, and request a receipt or acknowledgment that records the date and any documents still outstanding.
- For a nominee or survivor: Ask what proof of death and identity the bank accepts and whether it needs the original FD advice or other account records. RBI says the bank should not add succession documents, indemnity or surety to this claim category, subject to its verification and the absence of a court restraint.
- For legal heirs without a nominee or survivor route: Ask which simplified or full legal-heir process applies to this claim value. The bank may require its claim forms and evidence establishing who the heirs are; a will, dispute or court order can change what the bank needs.
- For a joint FD with an early-closure request: Ask whether the recorded mandate is sufficient or whether the bank requires consent from the deceased holder’s legal heirs, as well as the surviving depositors.
- For any claim: Keep copies of forms and submitted documents, the bank’s acknowledgment, and correspondence about missing items or its calculation of the proceeds.
Do not assume that a document accepted by one bank, or a threshold published by one bank, will be accepted by another. If heirs disagree or a court has restrained payment, the bank may not be able to release the funds through an ordinary claim route.

Can the FD be closed before maturity?
Death does not necessarily mean the FD must remain untouched until its maturity date. RBI customer-service guidance says banks must provide in their term-deposit forms for premature termination following the depositor’s death, without a penalty, subject to conditions set out in the form. The claimant should ask the issuing bank how that provision applies to this FD and who is entitled to request early closure.

For a joint FD, the survivor’s ability to close it early may be narrower than the ability to receive funds at maturity. Indian Bank’s FY 2026–29 policy, for example, says premature termination after one holder’s death requires the surviving depositors’ and deceased holder’s legal heirs’ consent unless all depositors gave a specific mandate allowing the survivor to withdraw without the heirs’ concurrence. That example illustrates why the account’s own mandate and issuer’s policy should be checked rather than treating every survivorship clause as an early-withdrawal authorization.
When asking for closure, specify whether the claimant is requesting premature termination or payment at maturity. Ask the bank to show the amount payable under each available route, including the interest treatment and any applicable conditions, before choosing.

What happens to interest if the depositor dies before or after maturity?
The balance is not always just the original principal plus a single obvious interest figure. The death date, FD maturity date, claim date, deposit terms and bank policy can affect the calculation. RBI customer-service guidance leaves each bank to set a transparent, board-approved policy for interest on matured term deposits after a depositor’s death. Therefore, there is no one post-maturity interest answer that can safely be promised for every FD.
An older RBI term-deposit master circular describes interest treatment for certain circumstances, including cases in which a depositor dies before maturity and the deposit is claimed after maturity, as well as claims made before maturity and a specified case of simple interest after maturity. Those examples should not be read as a blanket guarantee for all present-day deposits: the customer-service guidance makes matured-deposit treatment dependent on the bank’s policy. Ask the issuer for a written calculation tied to the relevant dates and the terms of this FD.
- Tell the bank the date of death and identify whether the FD had already matured.
- Ask for a calculation for payment at maturity and, if available, for premature closure.
- Ask which current bank policy and FD terms govern interest after maturity, and request the calculation in writing.
- Compare the written amounts and conditions before signing a closure or settlement instruction.
How long should a complete claim take?
RBI’s Master Circular on Customer Service in Banks, issued in 2015, says banks should settle deceased-depositor claims and release payment to survivors or nominees within a period not exceeding 15 days from receipt of the claim, subject to proof of death and satisfactory identification. This is a service timeline for a qualifying claim, not a promise that every inheritance dispute or incomplete legal-heir claim will be resolved within 15 days.

For practical purposes, preserve the bank’s acknowledgment of the complete claim and its checklist. If the bank says a document is missing, ask what is outstanding and whether the 15-day period has begun. If a complete qualifying nominee or survivor claim is not settled within the stated period, use the bank’s grievance process and keep the acknowledgment and all correspondence.
Which route applies to this FD?
| Situation | Who approaches the bank? | What controls the claim? | Key point |
|---|---|---|---|
| Single holder, valid nominee | Registered nominee | Proof of death, identity, valid nomination and no court restraint | RBI says succession certificate, probate, indemnity and surety should not be demanded for this claim category, subject to checks. |
| Joint FD with survivor instruction | Surviving holder or holders | Recorded operating mandate, deposit terms and the requested action | Payment at maturity and premature closure may have different requirements. |
| No nominee or survivor route | Legal heirs | The bank’s simplified or full claim procedure, amount, will, disputes and any court order | Thresholds and document lists are bank-specific; Indian Bank’s ₹15 lakh threshold is one named-bank example for eligible claims. |
| FD already matured | Nominee, survivor or legal heirs, depending on account setup | Bank’s board-approved interest policy and the FD terms | Request a written calculation based on death, maturity and claim dates. |
What to do next
- Locate the FD advice or statement and note the holder names, nominee, mandate, deposit number and maturity date.
- Contact the issuing bank for its current deceased-depositor form and checklist; ask for the applicable route based on the account mandate and claim value.
- Submit the requested death and identity evidence and any other documents applicable to the claim. Obtain written acknowledgment and confirmation of whether the submission is complete.
- Decide whether to request payment at maturity or premature closure, if the claimant is eligible to choose. Get the bank’s interest calculation and required consents in writing first.
- Track the bank’s response from the date it acknowledges a complete qualifying claim. If it is delayed, use the bank’s grievance channel and retain the record of submissions and replies.
The exact checklist and amount payable cannot be determined without the issuing bank, FD terms, holder mandate, maturity and death dates, claim value and any will, dispute or court order. The bank’s written procedure and calculation for this specific deposit are the appropriate next step.
