Before Wisconsin’s April 1, 2025, Supreme Court election, Elon Musk’s political action committee, America PAC, offered registered Wisconsin voters $100 for signing a petition and another $100 for each registered voter they referred who also signed. The offer raised questions under Wisconsin’s election-bribery law, but contemporaneous legal commentary described the petition payment as a gray area—not a settled violation.
What America PAC’s $100 offer required
America PAC announced its “Petition in Opposition to Activist Judges” on March 20, 2025. Anyone could sign the petition, but the cash incentive was for registered Wisconsin voters: $100 for a signature and an additional $100 for every registered Wisconsin voter they referred who signed. The petition argued that judges should interpret laws as written rather than rewrite them. Its text said: “Judges should interpret laws as written, not rewrite them to fit their personal or political agendas. By signing below, I’m rejecting the actions of the activist judges who impose their own views and demanding a judiciary that respects its role—interpreting, not legislating.” That was the PAC’s framing, not an established finding about any judge. Why the offer raised an election-law question
Wisconsin’s election-bribery statute addresses offering or giving anything of value to induce an elector to go to or stay away from the polls, vote or refrain from voting, or vote for or against a person. The legal question was whether paying people for petition signatures was intended to induce voting conduct—not simply whether money changed hands.

In a March 28, 2025, Wisconsin Watch explainer, Bryna Godar, a staff attorney with the University of Wisconsin Law School’s State Democracy Research Initiative, called the payment a “gray area.” She said it “definitely falls into a gray area because (America PAC) is paying people to sign the petition,” and explained that “[t]he question is whether the payment is being given in order to induce anyone to vote or refrain from voting.” This was contemporaneous expert analysis, not a court ruling. The Crawford campaign and its representatives alleged that Musk was “buying votes.” That characterization should be understood as their accusation; the petition-signing offer itself did not establish that a court found vote-buying or an election-bribery violation. Associated Press

How the offer fit into the Crawford–Schimel race
The election pitted Susan Crawford against Brad Schimel. Musk and America PAC backed Schimel. Musk had posted on X: “Very important to vote Republican for the Wisconsin Supreme Court to prevent voting fraud.” The post showed his political position; it was not evidence that fraud had occurred. Spending figures reported during the campaign cover different periods and categories and should not be treated as interchangeable totals. In March 2025, the Associated Press, citing the Brennan Center for Justice, reported that America PAC and Building for America’s Future had spent more than $13 million to help elect Schimel. Separately, a March 30 court-filed amicus brief said America PAC’s Wisconsin reports disclosed over $8 million in express-advocacy communications supporting Schimel or opposing Crawford at that time. Crawford won by 10 percentage points. A 2026 Associated Press report described total spending on the race as more than $100 million, making it the most expensive judicial race in U.S. history. Associated Press

A separate matter concerned Musk’s promise of $1 million checks to people who voted in the 2025 election. On July 14, 2026, PBS Wisconsin’s Associated Press report said the Wisconsin Elections Commission found probable cause that Musk likely broke state law over that voter-linked promise and referred two complaints to the Brown County district attorney, who could decide whether to bring charges. The commission’s probable-cause finding concerned the separate $1 million promise. It was not a final adjudication of that matter, and it did not determine whether the $100 petition-signing offer violated the law.
