Walmart Spark Driver $100 Million Settlement: Who May Get Paid and What to Do

The $100 million Walmart Spark Driver judgment directs $79 million to drivers and $10 million to the FTC for intended driver refunds. Eligible drivers need not file a claim, but payments are not guaranteed for every Spark driver.

Walmart agreed to a $100 million judgment to resolve Federal Trade Commission (FTC) and state allegations that its Spark Driver program misrepresented driver earnings and tips. Eligible drivers may receive money without filing a claim or contacting the FTC, but not every Spark driver qualifies and the FTC has not published a fixed payment amount for each person.

What the settlement resolves

The FTC and 11 states alleged that Walmart misled Spark delivery drivers and customers about driver pay, tips, and incentives. Walmart agreed to the judgment without admitting liability, according to its SEC filing. The settlement is not a court finding that Walmart admitted wrongdoing.

The FTC says the judgment also bars Walmart from misrepresenting earnings and other material information about driver work. It requires a ten-year Earnings Verification Program. The FTC described the case and judgment in its announcement.

What regulators alleged about Spark pay

The allegations concern how offers and promotions were presented, not a finding that every driver experienced the same problem. In its complaint, the FTC alleged that Spark offers displayed inflated base pay or tip amounts and that customers were told all of their tips would go to drivers.

Tips that did not reach drivers as represented

The FTC alleged that a tip shown before delivery could fail to materialize if the customer’s payment was not successfully collected. It also alleged that Walmart did not disclose that tips might be split when an order was divided among multiple drivers.

The complaint further describes changes to batched offers that, the FTC alleged, could reduce base pay or tips without timely notice to drivers. It reports that a December 2023 Walmart internal investigation found customer “tip-baiting” in 0.4–0.9% of orders. That is a figure attributed in the complaint to Walmart’s internal investigation—not an independent measurement by regulators—and it does not establish that tip-baiting never occurred.

Incentives with conditions

The FTC also alleged that Walmart did not disclose all the conditions attached to some incentives, including referral promotions, and that some drivers were not paid despite meeting the stated conditions. These remain allegations resolved by settlement, rather than findings that Walmart admitted liability.

How the $100 million judgment is allocated

The FTC’s settlement FAQ describes three parts of the judgment:

Amount Destination What the FTC says
$79 million Drivers Walmart has made some payments and is identifying drivers who may still be eligible.
$10 million FTC The FTC intends to distribute this money to drivers.
$11 million Participating states This amount is a civil penalty for the 11 states.

The Pennsylvania Office of Attorney General described the program as involving nearly one million drivers and more than 272 million deliveries in its state announcement. Those figures describe the program’s scale; they are not the number of people who will receive settlement money.

Who may qualify for a driver payment?

The FTC says the complaint sought nationwide relief for drivers who accepted a Spark offer to deliver or shop for goods and did not receive promised payments because of Walmart’s conduct. That means potential relief is not restricted to drivers in the states that joined the case. It does not mean every person who has driven for Spark will qualify.

Eligibility depends on whether a driver was affected by the conduct covered by the case. The public information does not determine whether a particular driver qualifies, how much that person might receive, or when every payment will arrive. The FTC says individual amounts depend on factors including how many drivers were harmed.

Do Spark drivers need to file a claim or contact the FTC?

No. The FTC says drivers do not need to contact it to receive a payment. Walmart is identifying and paying affected drivers, and people determined eligible will receive an email. Drivers who have already been paid should have received an email stating the payment date or dates, according to the FTC FAQ.

  1. Watch for an official email if you may be eligible; the FTC says it will notify drivers determined eligible.
  2. Check the FTC’s Spark Driver settlement information for updates.
  3. Do not pay a person or company that promises to obtain your refund. The FTC says it never asks people to pay to receive a refund.

The FTC says accepting an FTC payment does not require a driver to give up rights they may have under federal or state law. That statement does not, by itself, answer questions about a separate lawsuit, contract, arbitration clause, or individual claim.

What the settlement means for Spark drivers going forward

The ten-year Earnings Verification Program and the prohibition on earnings misrepresentations are intended to address how driver compensation and related terms are communicated. FTC Bureau of Consumer Protection Director Christopher Mufarrige said: “Labor markets cannot function efficiently without truthful and non-misleading information about earnings and other material terms.” The settlement addresses the alleged conduct through these requirements; it does not guarantee that every future offer or dispute will be resolved in a particular way.
