Reuters reported the settlement was disclosed in federal court in August 2023, after one day of trial. The reported settlement is not a jury verdict or an admission of liability.
What happened to Nathaniel Foster Jr.?
On February 8, 2019, Foster was being assisted off United Flight 4193 at Monroe Regional Airport in Monroe, Louisiana. A federal court order filed before the settlement says Foster used a power wheelchair and required a tracheal tube and ventilator. During deboarding, his tracheal tube was dislodged, leaving him unable to breathe for a significant period; the order says he remained in a coma.
Foster was traveling with his mother, Pamela, father, Nathaniel Sr., and sister, Natalie, who later joined him as plaintiffs. Their itinerary included a United flight from San Francisco to Houston, followed by a flight to Monroe operated by ExpressJet as United Express.
What did the lawsuit and court order say?
The family sued United Airlines, ExpressJet, DAL Global Services, and United Airlines Holdings. The court order describes the claims and the case’s procedural status; it does not decide that any defendant caused Foster’s injury or was legally responsible.

The order records that United Airlines Holdings was dismissed because the operative complaint did not adequately allege an alter ego claim. By the time of the order, the remaining claims had been streamlined to negligence and negligence per se against all defendants, breach of contract against United and ExpressJet, and negligent misrepresentation against United.
The companies had distinct roles
- United Airlines: The airline associated with the first flight and the defendant named in the case.
- ExpressJet: Operated the second flight under the United Express brand.
- DAL Global Services: Provided United ground and ramp services at Monroe, according to the court order.
These roles should not be conflated: the United Express brand, the operating carrier, and the ground-services contractor were not the same entity.

How much was the settlement?
Reuters reported on August 24, 2023, that United agreed to a $30 million settlement with the Foster family after one day of trial. Reuters also reported that about $12 million was allocated to legal fees and $3 million to other costs. Those figures are Reuters’ reported amounts; the cited court order does not provide an itemized settlement allocation.
The available reporting does not establish the complete settlement agreement, whether it contains confidential terms, or any further allocation. The court order predates the settlement and is not evidence of a jury verdict. The sources do not establish an admission of fault by United or the other defendants.

What did United say?
As quoted by Reuters after the settlement was reported, United said: “Our top priority is to provide a safe journey for all our customers, especially those who require additional assistance or the use of a wheelchair,” and, “We are pleased to share that this matter has settled.” Reuters did not identify an individual speaker.
