After the DMV said Tesla had changed its California marketing, the company filed a petition in Los Angeles County Superior Court seeking to set the order aside. The petition states Tesla’s arguments; the available records do not establish a later court ruling.
What the California DMV found
The dispute concerned how Tesla marketed driver-assistance features—not a finding that Tesla vehicles had caused a particular crash or a decision about whether a specific driver could safely use them. The DMV said the terms “Autopilot” and “Full Self-Driving Capability” misleadingly described systems that could not operate as autonomous vehicles. The DMV’s position was that the names and claims could mislead consumers about the systems’ capabilities. The agency adopted the administrative law judge’s findings that Tesla’s marketing violated state law. That is the DMV’s administrative finding, not a court judgment.

The 30-day suspensions were recommended penalties, not suspensions that ultimately took effect. The DMV’s modified order created a way to avoid them through corrective action, and the agency later said Tesla had complied.

Why Tesla is still challenging the DMV
Compliance resolved the immediate threat of license suspensions; it did not mean Tesla agreed with the underlying decision. In February 2026, Tesla filed a verified petition in Los Angeles County Superior Court asking for a writ of administrative mandamus and declaratory and injunctive relief to set aside the DMV order. The petition argues, among other things, that the agency’s findings were flawed on consumer understanding, the legal standard, and due process. Those are Tesla’s allegations, not findings by a judge. Tesla’s petition states: “The Order is factually wrong, legally flawed, unconstitutional, and should be set aside.” That sentence describes the company’s position in its pleading; it does not establish that a court has accepted it. What is known about the court case—and what is not
The records establish that Tesla filed the petition and identify the relief it requested. They do not establish a later ruling in that Los Angeles County case. The DMV’s February announcement addressed corrective action and the threatened suspensions, not the outcome of Tesla’s court challenge. Tesla’s June 2026 quarterly filing discusses a separate Ninth Circuit appeal in consumer litigation over driver-assistance systems; its reported August 31, 2026 oral argument date is not a hearing date for the DMV writ case. As a result, the careful answer to “Is the fight over?” is: the threatened license suspensions were avoided, but Tesla also sought judicial review of the DMV’s decision. The available records do not show what the court did afterward, so they do not support saying Tesla won, that the order was overturned, or that the case is still active.

Autopilot, Full Self-Driving, and driver supervision
The DMV case concerned whether marketing names and claims accurately conveyed the capabilities of driver-assistance systems. The DMV said the systems at issue could not operate as autonomous vehicles; its February 2026 announcement said Tesla had changed the Full Self-Driving name to “Full Self-Driving (Supervised)” to make driver supervision clear. California’s autonomous-vehicle permit listings concern testing authorization, not the marketing dispute or Tesla’s court petition. The DMV page listed Tesla Robotaxi LLC as holding a testing permit with a safety driver as of September 17, 2026. Its driverless-testing list, updated April 3, 2026, did not list Tesla.
