The reported reason for withholding the benefit was her failure to opt for retirement at 60. The case-specific account comes from a news report; the underlying order was not available to verify its full reasoning or the dates used to calculate interest.
What happened in Raisa Khan’s case?
The Lawyers Post reported that Raisa Khan served as a teacher from August 1992 until her retirement in March 2019, when she was 62. It said authorities paid her other retirement benefits but withheld gratuity because she had not opted to retire at age 60. The report identifies the matter as Raisa Khan v State of Uttar Pradesh and dates the decision to 30 September 2026. It says the High Court directed payment of gratuity with 6% interest. The report does not establish the case number, judge, detailed grounds, precise operative wording, or the start and end dates for interest. Accordingly, the 6% rate and the account of why payment was withheld should be attributed to the report, rather than treated as verified quotations or a complete statement of the judgment.

Why does retirement at 62 matter?
The reported dispute is not simply whether Khan retired later than 60. It is whether continuing to work beyond 60, without selecting the earlier retirement option, could be used as a reason to deny gratuity. The news account says that was the authorities’ reason for withholding the benefit and that the High Court directed payment. It does not provide enough of the judgment to state the court’s full legal analysis or the precise rule governing Khan’s employment.

How does the separate 2024 teacher-gratuity ruling provide context?
An official Allahabad High Court publication concerning separate teacher-gratuity petitions explains that the Payment of Gratuity (Amendment) Act, 2009 widened the Act’s definition of “employee” to include teachers, retrospectively from 3 April 1997. In that litigation, the court also held that the statutory provisions prevailed over the Government Orders at issue. Allahabad High Court, Indian Law Reports, October 2024
The 2024 ruling is relevant legal context, but it is not Khan’s case and does not establish the precise basis of the 2026 decision. The official report records the court directing gratuity payment to the petitioners with interest at 6% per annum on arrears, from superannuation until actual payment. That direction applied to those petitioners in the 2024 case; it should not be presented as the verified wording or calculation in Khan’s matter.

What does the 6% interest mean here?
The Lawyers Post report gives a 6% interest rate for Khan’s case, but does not specify the dates from which interest runs or how the amount is to be calculated. The separate 2024 ruling expressly used 6% per annum from superannuation until actual payment. That is a term of the 2024 order only; the available account does not confirm that the same period applies to Khan.

- The case number and the judge who decided it.
- The judgment’s detailed reasoning and the exact legal provisions applied.
- The operative directions, including any deadline for payment.
- The dates from which interest accrues and the date through which it is payable.
These details matter if a reader needs to calculate an individual entitlement or rely on the ruling in another dispute. The reported outcome can be described, but those specifics should not be inferred from the 2024 case.
