Did Smartmatic go to trial against Newsmax?
No. Smartmatic and Newsmax settled their Delaware defamation case on September 26, 2024, after jury selection started. The Associated Press reported that the settlement terms were not disclosed. The case ended without a trial verdict.

Newsmax later described the resolution in a corporate statement dated August 22, 2025. The company said the court had found that allegations that Smartmatic altered or manipulated the 2020 presidential election and its results were “factually false/untrue,” and that Smartmatic was not owned by a foreign government or official. That wording is Newsmax’s account in its statement; it is not a jury verdict resulting from the case, which settled.
Is Smartmatic still suing Fox News?
Yes, the separate New York lawsuit by Smartmatic against Fox Corporation, Fox News Network, and named hosts remained active in the New York Appellate Division, First Department’s May 2026 decision. The court allowed limited additional discovery concerning criminal allegations involving Los Angeles County and the possible effect of a superseding indictment on Smartmatic’s business. It vacated the Note of Issue to allow that discovery and otherwise affirmed the lower court’s order. The opinion did not set a new trial date.

The procedural history matters when describing what is established. A 2023 appellate opinion recounting the complaint said Smartmatic technology was used only in Los Angeles County during the 2020 election. That was an account of the complaint’s allegations in a procedural decision, not a finding resolving all facts in the current defamation action.
The criminal case is separate from Smartmatic’s civil defamation lawsuit. The Associated Press reported in March 2026 on an indictment involving Smartmatic’s parent company and executives. Allegations in that criminal proceeding are not findings in the civil case against Fox.

What happened to Dominion’s cases against Fox and Newsmax?
Dominion Voting Systems is not Smartmatic. Its cases involved different parties and produced separate outcomes.

Dominion v. Newsmax
Newsmax announced on August 18, 2025, that it had reached an agreement resolving Dominion’s Delaware defamation case. Newsmax said Dominion had filed the case in 2021 and initially sought $1.6 billion; that figure was the amount Newsmax said Dominion had sought, not an award. Newsmax’s 2026 annual report disclosed the settlement total as $67 million, payable across the current and next two fiscal years.

Dominion v. Giuliani
The Associated Press reported that Dominion and Rudy Giuliani agreed to a confidential settlement in September 2025 and permanently dismissed the federal action. The public filing did not disclose an amount.
Other Dominion cases
The established outcomes above do not provide a complete current inventory of Dominion’s litigation. The current status of matters involving OAN, Sidney Powell, Patrick Byrne, Mike Lindell, or other defendants is not established by the cited records here. Those cases should not be described collectively as pending or resolved without checking the individual dockets and identifying the parties.

How to read the settlement amounts and case status
A settlement is an agreement resolving a case, not a jury verdict. A damages demand is an amount a party sought, not money a court awarded. Keep the companies and defendants distinct: Smartmatic’s settled Newsmax case does not determine the status of its Fox case, and Dominion’s settlements are not Smartmatic settlements. The disclosed $67 million for Dominion v. Newsmax is a case-specific settlement figure, not a measure of liability in any other case.
