The House had passed the measure 417-3. The bill would have required state utility regulators to consider standards for charging large electricity users, including AI data centers, for incremental infrastructure costs. It did not guarantee an immediate reduction in household power bills.
What happened in the Senate?
The Senate’s Sept. 30 vote was a procedural failure to advance the bill, not a final enactment or a ruling that settled who must pay for data-center-related grid upgrades. The measure was S. 5028, the Ratepayer Protection Act, sponsored by Sen. Jon Husted, a Republican from Ohio. Husted said the Senate was considering the House-passed version.
The House approved the measure 417-3 on Sept. 16. In the Senate, a separate attempt to move it by unanimous consent was blocked on Sept. 17 after a Democratic objection. The later 57-43 vote on Sept. 30 was a distinct action and fell short of the 60 votes required to advance.
What would the Ratepayer Protection Act have changed?
The proposal focused on how electricity and infrastructure costs are allocated when utilities serve large-load customers such as data centers. Husted described it as requiring state utility regulators to consider standards under which those customers would pay the full incremental infrastructure costs needed to serve them. That could include financial assurances to protect customers and communities from stranded costs if a planned project were delayed or abandoned.

The Associated Press summarized the bill as requiring regulators to consider adopting a federal standard. Husted presented that step as a way to make states confront cost shifting. Critics argued that the measure did not require regulators to adopt a rule or guarantee that data centers would pay every cost associated with serving them.

So the bill was not a direct cap on electricity prices, a promise of savings, or a requirement that every household’s bill fall. Its potential effect would have depended on what regulators considered and any standards they adopted.
Why did supporters and critics disagree?
Supporters said large users should cover the costs they create
Husted argued that companies driving new electricity demand should pay the related power and infrastructure costs rather than shifting them to households, seniors, and small businesses. He said, “The company that is creating enormous new demands for electricity should pay the costs required to serve them.” These were the bill’s stated aims, not measured savings or a guarantee of lower bills.

Critics said the proposal did not make payment mandatory
Sen. Martin Heinrich, a Democrat from New Mexico, argued that asking states to consider making data centers pay for grid upgrades was not enough: “It’s not enough for us to tell states to consider making data centers pay for grid upgrades.” He called instead for legislation with mandatory force. Sen. Chris Van Hollen, a Democrat from Maryland, called Husted’s bill “a bill with no teeth” and objected to proceeding without a guarantee that his amendment would be considered.
The disagreement was about the mechanism, not simply whether large electricity users should bear costs. Supporters said a federal standard for regulators to consider would address cost shifting; critics wanted a stronger requirement. Neither the failed vote nor the competing political claims establishes how much, if anything, the bill would have changed a household’s bill.

What alternatives did Democratic senators raise?
Heinrich offered the GRID Savings Act during the Sept. 17 Senate proceedings, but a Republican senator objected to that unanimous-consent request. Van Hollen separately sought consideration of his Power for the People Act and criticized the lack of an opportunity to consider it alongside Husted’s proposal.
Those are different bills, not two names for one alternative. The cited Senate remarks establish the senators’ objections and the consider-only-versus-mandatory distinction, but do not support treating every proposal as covering the same costs or providing the same protections.

What did Sen. Heinrich say about electricity prices?
In Senate floor remarks, Heinrich cited estimates of electricity-price increases of 2–6%, a projected 20–30% increase by 2028, and an additional $840 per year per family in the mid-Atlantic within two years. He attributed the estimates to the Federal Reserve Bank of Dallas. Those figures are Heinrich’s claims in his remarks; the underlying Dallas Fed publication is not independently established here, so they should not be read as verified forecasts or as an estimate of the Ratepayer Protection Act’s effect.
Was there a separate federal action on data-center grid costs?
Yes. On June 18, 2026, the Federal Energy Regulatory Commission said it had ordered all six regional grid operators to justify their existing tariffs or file reforms for data centers and other large users. The listed issues included preventing cost shifting, improving transparency into transmission costs, accommodating co-location and behind-the-meter generation, providing new service for flexible large loads, and studying generation intended to serve large loads.

FERC described tailored orders rather than a single uniform approach. That agency process is separate from the Ratepayer Protection Act and continued independently of the Senate vote.
