Remote I-9 and E-Verify: An Employer’s Guide

Remote onboarding does not change an employer’s Form I-9 deadlines. The employee must complete Section 1 no later than the first day of employment, and the employer or its authorized representative must complete Section 2 within three business days after that day. Employers that use E-Verify must also create a case within three business days after the first day—but only after the offer is accepted and Form I-9 is complete. For remote document review, an employer may use the DHS-authorized alternative procedure if it meets the procedure’s current conditions; a video call alone is not enough.

How do Form I-9 and E-Verify fit together?

Form I-9 is the employment eligibility verification form completed for new hires. E-Verify is an online system that participating employers use in addition to Form I-9. It does not replace the form or its completion deadlines.

This guide covers the federal process as described in USCIS and DHS materials checked October 11, 2026. State requirements, federal-contractor obligations, collective bargaining terms, and employer-specific circumstances may add requirements. Check the current rules that apply to your organization before adopting a process.

What are the deadlines for a remote hire?

Task Who completes it Deadline Important condition
Form I-9, Section 1 Employee No later than the first day of employment Do not have the employee complete it before accepting a job offer.
Form I-9, Section 2 Employer or authorized representative Within three business days after the first day of employment Examine the required documentation physically or through a DHS-authorized alternative procedure, if the employer can use it and follows its conditions.
E-Verify case Participating employer Within three business days after the first day of employment Create it only after the offer is accepted and Form I-9 is complete.

These are separate steps with separate conditions. Build the schedule around the employee’s first day, and allow time to finish Section 2 and, where applicable, create the E-Verify case by their respective deadlines.

How can an employer examine documents remotely?

Employers generally examine documents physically. DHS also authorizes an optional alternative procedure for remote examination. It is not a blanket exemption from document review: the employer must meet the procedure’s current eligibility and use conditions. Confirm those requirements in current USCIS and E-Verify instructions before relying on it.

Use the complete alternative-procedure sequence

  1. Review document copies. Examine copies of the documents the employee chooses to present, or an acceptable receipt. For a two-sided document, review both sides. Determine whether the document reasonably appears genuine and relates to the employee.
  2. Hold a live video interaction. The employee first sends the copies, then presents the same documents during a live video interaction. Compare what is shown with the copies reviewed.
  3. Retain legible copies. Keep clear, legible copies of the documents examined, including both sides of two-sided documents, as required by the procedure.
  4. Complete the form and indicate the procedure. Follow the current Form I-9 instructions for recording the examination and marking use of a DHS-authorized alternative procedure.

If a document does not reasonably appear genuine or related to the person presenting it, give the employee an opportunity to present other acceptable documents. Do not treat the video interaction as a substitute for reviewing the copies or retaining them.

Physical examination remains a separate option

An employer may use ordinary physical document examination instead of the remote alternative, following current Form I-9 instructions. The choice of method does not change the Section 2 deadline or the employee’s right to choose which acceptable documents to present.

How should employers handle document choice?

The employee chooses which acceptable documentation to present. Do not demand a particular acceptable document or ask for documents to support the employee’s Section 1 information. Keep instructions and treatment consistent across employees. The Form I-9 notice warns that differential treatment based on citizenship, immigration status, or national origin may be illegal.

If the employee’s chosen documentation does not reasonably appear genuine or related to them, offer the opportunity to present other acceptable documents rather than insisting on a specific replacement.

When should an employer create an E-Verify case?

For an employer enrolled in E-Verify, case creation comes after two prerequisites: the offer has been accepted and Form I-9 is complete. Create the case no later than three business days after the employee’s first day of employment. E-Verify supplements the completed Form I-9; it is not a way to begin verification before those prerequisites are met.

Which form and records should the employer use?

Use the current USCIS Form I-9 and make its instructions available to the employee. The form surfaced in USCIS materials checked October 11, 2026, is Edition 01/20/25 and lists an expiration date of 05/31/2027. Because editions and expiration details can change, check the USCIS Form I-9 page before using a form or updating onboarding instructions. The form includes a checkbox for indicating use of a DHS-authorized alternative examination procedure.

USCIS’s Form I-9 overview covers completion, acceptable documents, retention and storage, and E-Verify. Follow the current instructions for the employer’s recordkeeping and retention obligations; the information summarized here does not establish a retention period. DHS’s E-Verify self-assessment guide recommends establishing a process to monitor compliance with both Form I-9 and E-Verify requirements.

How can HR make remote onboarding reliable?

  1. Confirm the governing requirements. Check the current USCIS form and instructions, the conditions for using the alternative procedure, current E-Verify prompts, and any applicable state or federal-contractor requirements.
  2. Assign responsibility. Designate a trained employee or authorized representative to handle Section 2 and track the deadline from the hire’s first day.
  3. Give neutral instructions. Make the current form instructions available and tell the employee they may choose among acceptable documents. Do not request a preferred document type.
  4. Document the examination method. If using the remote alternative, make sure staff complete the copy review, live presentation of the same documents, copy retention, and required form notation.
  5. Sequence E-Verify correctly. For participating employers, create a case only after offer acceptance and Form I-9 completion, and track its deadline separately.
  6. Monitor changes. Review current USCIS and E-Verify instructions and form editions periodically, and update staff procedures when the official workflow changes.

This is a federal-process overview, not individualized legal advice. Employers should confirm how current rules apply to their workforce and locations.
