Prediction Markets vs. Sports Betting: How the Risks and Rules Differ

Prediction markets and sportsbooks can both involve predicting a game, but their pricing, oversight, settlement and protections differ. The rules for sports event contracts remain contested, so check your location and the exact terms before participating.

A prediction-market contract on a game can look like a sports bet, but the products may operate under different rulebooks. Contracts listed on a Commodity Futures Trading Commission (CFTC)-registered designated contract market are treated by the CFTC as derivatives under federal commodity-market law; conventional sportsbooks operate under the state or tribal gaming rules and licenses that apply where they serve customers. How those frameworks apply to sports-related event contracts is contested, so neither product’s label settles whether it is legal where you live. Check your location’s current rules, then compare the contract or wager’s costs, settlement terms, protections and ways to get help if something goes wrong.

What is the difference between a prediction market and a sportsbook?

The central difference is not simply that one is called a “contract” and the other a “bet.” A prediction market may match traders buying and selling event contracts on an order book, while a sportsbook accepts wagers under its house rules and gaming license. Their legal frameworks, pricing, settlement processes and consumer protections can differ. Either can expose you to financial loss.

Leaving before the event is settled Some contracts can be sold before settlement at the price then available; fees and liquidity vary by venue and contract. Cash-out, if offered, is operator- and wager-specific; do not assume it will be available.
Safeguards and complaints Registered DCMs have federal market-integrity obligations. Check the venue’s registration, account terms and complaint channels; state gambling regulators contest the reach of federal oversight for some sports offerings. Local gaming regulators set licensing and consumer-protection requirements, which vary by jurisdiction. Check the operator’s license and the regulator’s complaint route.

For either product, examine what you pay, how you can exit, who determines the result, what can void or alter settlement, and how disputes are handled. Words such as “yes/no,” “contract,” “bet” and “investment” do not by themselves determine a product’s legal status or risk.

How the money and payout work

Prediction-market contracts

The CFTC describes event contracts as financial contracts whose value depends on the occurrence, nonoccurrence or extent of an event. Many are structured around a yes-or-no outcome. On an order-book market, buyers and sellers interact, and a quoted price may change as participants trade or new information arrives. Some contracts can be sold before the event is settled, but the price available then may be lower than the price paid, and there may not be a buyer at a reasonable price. Fees, liquidity and contract design vary.

Do not treat a displayed price as a guaranteed probability, payout or exit value. Read the contract’s own terms to learn what it pays, which outcome counts, how the market settles and whether fees apply. For binary-style contracts, the amount at risk may be the amount paid or another amount specified in the contract; there is no universal loss cap to assume without checking the contract and account terms.

Sportsbook wagers

A sportsbook’s odds and house rules determine how a wager’s potential payout is calculated. Check the stake, odds, payout calculation, eligible settlement source and event-specific rules before placing it. A promotional claim or headline price may not reflect the final return after applicable terms. Whether a cash-out is possible, and on what terms, depends on the operator and wager.

Do not compare an event-contract price directly with sportsbook odds without accounting for the different payout calculations, fees and conditions. For both, compare the amount you could receive with the total amount you could lose, and consider whether you can exit before settlement.

Who regulates them, and why legality is contested

Federal oversight of registered event-contract markets

The CFTC says DCMs must register and comply with the Commodity Exchange Act and CFTC requirements, including market-integrity obligations. The Commission says regulated exchanges must maintain rules addressing manipulation and insider trading. Its consumer guidance also tells customers to understand fees, penalties, payout terms and settlement determinations, and warns that “All speculation involves risk.” Registration and federal oversight do not make a trade safe or profitable.

On March 12, 2026, the CFTC’s Division of Market Oversight issued an advisory reminding DCMs of their obligations, including matters relevant to sports event contracts. The advisory addresses exchange responsibilities; it is not a guarantee of customer outcomes.

State gaming regulators’ position

State regulators have argued that some sports-related event contracts amount to sports wagering subject to state gaming law. Connecticut provides a specific example, not a nationwide rule: on December 3, 2025, its Department of Consumer Protection said KalshiEX LLC, Robinhood Derivatives LLC and Crypto.com lacked Connecticut sports-wagering licenses and ordered them to stop offering sports-event contracts to state residents. The department cited state requirements involving age, technical standards, integrity controls, house rules, self-exclusion and consumer remedies. In September 2026, Connecticut officials again announced actions and said the state’s licensed sportsbooks and gambling safeguards apply.

Connecticut’s notice reflects that regulator’s enforcement position. It is not a nationwide court ruling that every event contract is sports betting. The Connecticut regulator also said it had not reviewed the named platforms’ rules and could not recover consumer losses in a dispute involving those unlicensed platforms. That example shows why local licensing and complaint options matter, but it does not establish what remedies are available in every state or on every platform.

The federal-state dispute remains unsettled

The CFTC asserts that federal law gives it exclusive authority over event contracts on registered markets. State regulators have challenged sports-related offerings under state gambling laws, and the federal agency has sued states over their actions. In a March 2026 advance notice, the CFTC recorded that it had withdrawn earlier proposed rules for reconsideration amid state actions and litigation; the notice sought comments and did not resolve the dispute.

As of October 4, 2026, describe the legal status as contested and changing rather than saying prediction markets are legal in every state or that all sports contracts have conclusively been classified as gambling. The available information does not establish the current posture of every lawsuit or platform availability in every location. Check the latest state regulator notices and court developments before relying on a general description of the rules.

Risks and protections to check before participating

Potential loss, fees and ability to exit

  • Decide what you can afford to lose. The CFTC says all speculation involves risk and advises using only risk capital and monitoring positions. Do not assume a contract has a universal maximum loss; inspect its terms and your account agreement.
  • Account for the full cost. Event-contract trading or transaction fees and sportsbook payout calculations differ. Compare the total amount paid and the actual potential payout rather than a headline price.
  • Check liquidity and exit terms. A market may allow an early sale, but the price can move and a buyer may not be available. A sportsbook cash-out, if available, is product-specific.

Settlement, integrity and recourse

  • Read the settlement rules first. Identify the event definition, settlement source, deadlines, cancellation or void conditions, and who makes the determination.
  • Check oversight rather than relying on a label. The CFTC says registered exchanges must monitor for manipulation and insider trading. Connecticut alleged that the specific platforms named in its enforcement notice lacked state gaming integrity controls and could expose users to people with privileged knowledge. Those are Connecticut’s allegations about those offerings, not a finding about every event-contract market.
  • Find the complaint route. Verify the exact legal entity, registration or local license, account agreement, custody and withdrawal terms, and the regulator or dispute process available to you. Federal exchange duties do not guarantee that a particular loss can be recovered.

Age limits and responsible-play tools

Legal age thresholds and responsible-gambling protections vary by jurisdiction. Connecticut says its online and in-person gaming and sports-wagering age is 21; its regulator also said the named platforms offered access to people under 21 and to self-excluded individuals. Those statements concern Connecticut and the named platforms, not the rules everywhere. Check local age requirements and available self-exclusion tools. If gambling or speculative trading is becoming difficult to control, use local support and self-exclusion resources rather than increasing stakes to recover losses.

A practical location-and-product check

  1. Confirm where you are eligible. Check your state or tribal gaming regulator’s current notices for sportsbook rules and any actions concerning sports-event contracts. Do not infer legality from an app being accessible or from its product label.
  2. Identify the operator and its status. For an event contract, verify the specific venue and legal entity and whether it is a CFTC-registered DCM. For a sportsbook, verify the operator’s license for your location.
  3. Read the actual terms. Check the stake or contract price, fees, payout, settlement source, event definition, void rules, exit options and dispute process.
  4. Review protections that apply to you. Confirm age eligibility, self-exclusion access, integrity controls and a regulator complaint channel; these are not necessarily the same across products or jurisdictions.
  5. Set a loss limit before acting. Use only money you can afford to lose, and do not treat the market price or sportsbook odds as a reliable forecast.

What market-size figures do—and do not—show

In a 2026 Federal Register advance notice, the CFTC said DCMs certified approximately 1,600 event contracts for listing in 2025 across financial, economic, weather, political, international, scientific, cultural, current and sporting events. That is a count of contracts certified for listing, not a count of active sports contracts, customers, betting handle or market value.
