Pakistan’s 2025 Digital Presence Proceeds Tax Act set a 5% rate for certain cross-border digitally ordered goods and services. But SRO 1366(I)/2025, dated 30 July 2025, says the tax shall not apply to qualifying goods and services supplied from outside Pakistan, effective 1 July 2025. The notification uses an exemption power; it does not repeal the Act. The available sources establish what those 2025 instruments say, but do not establish whether a later official action changed or confirmed the exemption’s treatment by 8 October 2026.
What did Pakistan’s exemption change?
The Digital Presence Proceeds Tax Act, 2025 created a charge on certain supplies made from outside Pakistan by foreign vendors with significant digital presence in Pakistan. SRO 1366(I)/2025 invokes section 15 of that Act and directs that the tax shall not apply to digitally ordered goods and services supplied from outside Pakistan by persons whose supplies are chargeable under the Act. The notification states that it takes effect from 1 July 2025, although it is dated 30 July 2025. The notification transcription and linked official FBR PDF provide the text.
That is an exemption, not repeal. The Act remains in the legal framework reflected in the available sources. The notification’s reference to supplies chargeable under the Act also means the Act’s coverage conditions remain relevant to understanding the exemption’s scope.
What did the Act originally cover?
The Act addressed goods or services supplied from outside Pakistan and digitally ordered by a Pakistani user through a foreign online marketplace or e-store. Delivery could be digital or physical. The statutory concept of a Pakistani user depended on residence or establishment and electronic payment from within Pakistan. The Act also specified exceptions for certain supplies effectively connected with a Pakistan permanent establishment and supplied or rendered through that establishment. Significant digital presence
The Act’s threshold required more than five transactions in the current financial year, plus at least one additional connecting factor. Those factors included:
- A user base in Pakistan and associated data input.
- Billing or collection in local currency, or use of a local payment form.
- Responsibility for final delivery.
- Responsibility for after-sales support, repairs, or maintenance.
- Sustained marketing or sales promotion aimed at attracting customers.
Rates and collection under the Act
The Act’s schedule set a 5% rate on the payment for covered services, including social-media-platform advertising, and a 5% rate on the payment made to the foreign provider for covered goods. These are statutory rates, not proof that the tax continued to be collected after the exemption took effect. The Act assigned deduction and deposit duties to payment intermediaries for covered remittances and provided a separate deduction mechanism for specified foreign-vendor advertising payments. How the exemption fits with the Act
Section 15 authorizes the Federal Government, by Gazette notification and subject to conditions and restrictions, to exempt a country, class of goods or services, or class of persons from chargeability under the Act. SRO 1366(I)/2025 uses that authority. It does not state that the Act is repealed. The practical result described by the notification is that the tax shall not apply to the specified cross-border digitally ordered goods and services from its stated effective date. That should not be read as a waiver of other possible customs, sales, income, banking, or card charges; the exemption addresses this Act’s tax.

What is known about the exemption’s status now?
The available sources establish the Act and the wording and stated effective date of the 2025 notification. They do not establish whether a subsequent official instrument changed or confirmed how the exemption is administered as of 8 October 2026. A 2026 Oxford Academic search result describes the regime as having come into force on 1 July 2025 and its application to foreign vendors as suspended on 31 July 2025, but that is secondary analysis rather than a later official amendment or confirmation: Oxford Academic analysis.

What was reported about the exemption’s context?
Dawn reported that the exemption arose amid a tariff-related agreement with the United States. The report also quoted a senior tax official as saying, “We do not have any information about the content of the deal.” The notification itself does not state that agreement as its rationale, so a causal connection or the agreement’s terms should not be treated as established by the available reporting.
