Benefits are generally not taxable to the extent you paid the premiums with after-tax money. If you and your employer shared the cost, the benefits may be partly taxable.
How the tax rule works
The key question is not simply whether your disability policy is short-term or long-term. It is how the premiums were paid and treated for tax purposes. The IRS explains that disability benefits paid under an accident or health plan are generally taxable to the extent they are attributable to employer contributions that were not included in your income. See IRS Publication 525 (2025), Taxable and Nontaxable Income and the IRS disability insurance proceeds FAQ.
| How premiums were paid | General federal income-tax treatment of benefits |
|---|---|
| Your employer paid the premiums, and their cost was not included in your taxable income | Generally taxable to the extent attributable to the employer-paid premiums. |
| You paid the full premium with after-tax money | Generally not taxable. The IRS states that benefits under an accident or health policy whose premiums you paid are not taxable. |
| You and your employer both paid | Generally, the portion attributable to the employer-paid share is taxable if your share was paid after tax. |
| Premiums came from a cafeteria plan and were excluded from your income | The IRS treats those premiums as employer-paid for this purpose; benefits attributable to them are generally taxable. |
Frequently Asked Questions
Does the rule apply to short-term disability, even though the IRS FAQ discusses long-term disability?
The IRS FAQ describes the accident and health plan premium rules for disability proceeds, while Publication 525 provides the broader sickness-and-injury benefit framework. Apply the rule to your short-term plan based on its actual funding and payroll tax treatment.
Does this answer whether my state taxes short-term disability benefits?
No. The cited IRS guidance establishes the federal income-tax framework, not state-specific treatment. Check the rules for your state.
