How U.S. CFTC Regulation Could Affect Prediction Markets and Event-Contract Traders

U.S. prediction markets operate under the CFTC derivatives framework, but 2026 rulemaking and state litigation leave contract and state availability unsettled.

Prediction markets that offer event contracts to the U.S. public operate inside the federal derivatives framework. The Commodity Futures Trading Commission (CFTC) says a contract with a payoff tied to whether an event occurs can be a swap or futures contract. A venue offering those instruments publicly generally must register as a designated contract market (DCM), meet continuing market-integrity and listing obligations, and follow the Commodity Exchange Act (CEA). That federal framework does not settle every question for every state, contract or venue: the CFTC withdrew a 2024 proposal, launched new rulemaking in 2026, and is litigating with several states over jurisdiction.

What CFTC regulation means for prediction markets

“Event contract” is common industry language, not a standalone defined term in the CEA or CFTC regulations. The legal classification depends on the contract’s structure. In the markets discussed by the CFTC, event contracts can fall within the statutory definitions of swaps or futures. A typical contract has a binary payoff: it pays according to whether a specified event occurs by a stated deadline.

The venue’s audience matters. The CFTC’s March 2026 advance notice of proposed rulemaking (ANPRM) distinguishes public trading on a DCM from swap trading on a swap execution facility (SEF). SEF trading is described as serving eligible contract participants rather than the general public. A platform that makes covered swaps or futures available to ordinary U.S. customers therefore faces a different regulatory path from a private institutional market.

What a registered DCM must do

Registration is an operating framework, not a government endorsement of every product. A DCM must comply with CEA requirements and the CFTC’s Part 38 rules, including core principles for fair trading, surveillance and market integrity. Product listings also have to satisfy applicable submission procedures. A central test is whether the contract is “readily susceptible to manipulation.” The CFTC’s Division of Market Oversight reiterated that obligation in its March 12, 2026 staff advisory, including for sports-related contracts.

Section 5c(c)(5)(C) of the CEA gives the CFTC authority to prohibit certain event contracts when the Commission determines that they are contrary to the public interest. That authority operates alongside the ordinary listing process. A DCM must analyze the contract it wants to list; registration alone does not make every possible event contract lawful or permanently available.

Why prices matter to the CFTC’s description

The March 2026 ANPRM quotes the CFTC’s 2008 Concept Release describing prediction markets as information-aggregation vehicles because “the contract prices will reflect the market participants’ aggregate beliefs regarding whether the events will occur.” That explains the economic function of a market price, not a promise that the price will be accurate, stable or profitable to trade.

How much the market has grown

The CFTC’s ANPRM gives counts of contracts listed or certified, not counts of traders, trades, dollars wagered or market size. The figures show why product-by-product oversight has become more consequential.

Period CFTC figure What the number measures
2006–2020 average Approximately five event contracts per year Average number described by the CFTC as event contracts during that period
2021 131 event contracts Newly listed contracts
2025 Approximately 1,600 event contracts Contracts certified for listing

Certification or listing does not measure trading volume or tell a trader that a contract is available in every state. It is also not a performance statistic.

What changed during 2026

Date CFTC action Legal status and practical meaning
February 6, 2026 Withdrawal of the 2024 proposed event-contract rule Final agency action withdrawing that proposal. The CFTC said it would not finalize rules from the 2024 proceeding.
March 12, 2026 Division of Market Oversight staff advisory Staff guidance reminding DCMs about CEA, Part 38, Core Principle 3 and product-submission duties, with discussion of sports contracts. It is not a newly enacted statute.
March 16, 2026 Prediction Markets ANPRM Information-gathering notice seeking views on core principles, public-interest restrictions, inside information and contract types. It is not a final rule.
April 2, 2026 Lawsuits concerning Arizona, Connecticut and Illinois actions against registered DCMs The CFTC asserted a federal-jurisdiction position in court filings. The announcement itself is not a judicial decision and does not resolve the law in every state.
June 10, 2026 Proposal addressing contracts involving enumerated activities Proposed amendments to Regulation 40.11 and proposed Appendix F. The proposal describes a contract-by-contract public-interest process, including a proposed 90-day review, for categories such as terrorism, assassination, war, gaming and conduct unlawful under federal or state law.
June 25, 2026 Proposal on reporting for certain fully collateralized event contracts Proposed reporting changes for reporting markets and certain intermediaries. The announcement does not say that individual traders must personally file these reports.
September 22, 2026 Division of Market Oversight advisory on “mention markets” Staff described limited circumstances in which contracts about words a person will say, attendance or appearances, or interactions might be listed consistently with the CEA and rules. The advisory stresses manipulation risk and contract-specific review.

In a June 10 announcement, CFTC Chairman Michael S. Selig said, “The CFTC will protect the integrity of our regulated markets without standing in the way of responsible innovation.” That is a policy statement about a proposal, not operative regulatory text.

Which rules are binding, and which are still being developed?

Material What it does How a trader should treat it
CEA and existing CFTC regulations, including Part 38 Set the statutory and regulatory framework for registered DCMs and listed derivatives. Binding requirements for covered markets, subject to interpretation and enforcement.
March 2026 staff advisories Explain staff views on DCM obligations, sports contracts and mention markets. Important compliance guidance, but not a new statute or Commission rule.
March 2026 ANPRM Requests information that may inform future rulemaking. Not a final rule; do not treat its questions or possibilities as current prohibitions.
June 2026 enumerated-activities proposal Would create a proposed public-interest process for specified categories. Proposal only unless and until a final rule takes effect.
June 2026 reporting proposal Would revise reporting for certain fully collateralized contracts and intermediaries. Proposal only; it does not establish a personal filing duty for traders by itself.
Agency lawsuits against states Present the CFTC’s argument about federal jurisdiction and state actions. Litigation position, not a court holding or a nationwide answer.

Are prediction markets legal in my state?

There is no reliable one-line answer based only on the words “prediction market.” The CFTC filed cases against Arizona, Connecticut and Illinois after actions those states took against CFTC-registered DCMs. The agency’s announcements express its view that federal law controls the markets at issue. They do not establish that every state restriction is preempted, and the cited announcements do not report final court decisions resolving those cases.

State treatment can depend on the venue, the exact contract, the state’s action and the current procedural posture of litigation. A contract listed yesterday may be unavailable today because of a venue decision, a state directive, a compliance change or a product-specific review. Treat “legal in my state” as a current, contract-level question rather than a permanent label.

Can you trade event contracts in the United States?

Before depositing money or submitting an order, work through the following checks:

  1. Identify the legal venue. Verify whether the operator is a CFTC-registered DCM, rather than relying on a generic “prediction market” description.
  2. Verify the exact listing. Check that the particular contract is currently listed or certified, not merely that the venue has listed other products.
  3. Read the contract terms. Confirm the event definition, closing time, settlement source, payout formula, cancellation rules and treatment of ambiguous outcomes.
  4. Assess manipulation exposure. Ask who can influence, verify or report the event and whether the wording creates incentives to affect the outcome. DCM listing analysis focuses on susceptibility to manipulation.
  5. Check your location at the time of trading. Review the venue’s current state restrictions and any relevant state regulator action. Availability can be state- and contract-sensitive while litigation continues.
  6. Separate current law from proposals. A proposed rule, ANPRM or staff advisory may affect future listings or compliance without changing what a trader is legally required to do today.
  7. Save the operative documents. Keep the contract specification and settlement terms that applied when you traded; later amendments or delistings may not answer what happened to an earlier position.

These checks reduce avoidable surprises but cannot guarantee access, a particular settlement or a profit. Federal oversight addresses market and product obligations, not the investment outcome of an individual position.

Why contract wording and settlement controls matter

A contract’s subject is only one part of the regulatory analysis. The settlement event must be sufficiently defined for the market to determine whether the outcome occurred, and the process must limit opportunities for a participant to manipulate the result. The March 2026 sports advisory and the September 2026 mention-market advisory both illustrate why the CFTC looks at the precise wording and evidence for each product.

Sports and other measurable events

Sports contracts can involve readily observable results, but that does not eliminate manipulation concerns. The DCM still has to submit and monitor the product under applicable rules, identify reliable outcome information and address circumstances such as postponements, disputes or changes to the event.

“Mention markets”

The September advisory discusses contracts asking whether a person will say specified words, attend or appear at an event, or interact with someone. Staff indicated that some narrowly designed contracts may be listed consistently with the CEA and CFTC rules, while emphasizing that permissibility turns on the particular contract and its manipulation risks. A broad label such as “social prediction” therefore tells you little about a specific listing.

How the 2026 proposals could affect contract selection

The June 10 proposal would address contracts involving enumerated activities, including terrorism, assassination, war, gaming and conduct unlawful under federal or state law. Its proposed process would evaluate products individually and allow a proposed 90-day review. Because this is not a final rule, traders should not treat the listed categories as an automatic current ban or assume that every contract touching one category will receive the same outcome.

The separate June 25 proposal concerns data reporting for certain fully collateralized event contracts, reporting markets and intermediaries. It is aimed at market reporting architecture; the announcement does not impose a new form that every retail participant must submit. If finalized, its effect would depend on the final text, effective dates and the role a person plays in the market.

What federal registration does not promise

  • It does not guarantee that a contract is legal in every state.
  • It does not mean the CFTC has endorsed the contract as a sound investment or predicted its outcome.
  • It does not ensure that a product will remain listed, liquid or available to a particular customer.
  • It does not eliminate losses, settlement disputes, technical risks or the possibility of manipulation.
  • It does not convert a proposal or staff statement into a final regulation.

How to keep a current answer as the rules move

The 2026 record is changing on several tracks at once. For a live availability or state-legality decision, consult the latest court docket for the relevant lawsuit, the CFTC rulemaking page and Federal Register entry for any proposal or final rule, the CFTC’s DCM and product records, and the relevant state regulator’s current action. Confirm effective dates and operative contract terms rather than relying on an older article, archived screenshot or a platform’s broad marketing label.

The practical standard is simple: identify the registered venue, confirm the exact contract, read its settlement mechanics, and treat geographic legality as unsettled unless current authoritative materials establish otherwise.
