How to Respond to a GST Notice for an ITC Mismatch Between GSTR-2A and GSTR-3B

A GSTR-2A and GSTR-3B difference is not automatically proof of ineligible ITC. Identify the notice, check the law for its tax period, reconcile each disputed invoice and reply through the specified channel.

Start by identifying the exact notice or intimation, tax period, allegation, reply deadline and filing route. Then reconcile the disputed input tax credit (ITC) invoice by invoice against the applicable GSTR-2B and GSTR-3B data and your underlying records. Explain each variance with evidence and file through the process specified for that communication. A difference between GSTR-2A and GSTR-3B does not, by itself, establish that the credit is ineligible.

First identify what kind of GST communication you received

“GST notice” can refer to different proceedings, with different reply processes. Read the complete communication and annexures rather than choosing a form based on the mismatch alone.

Communication What to check Response route
FORM GST DRC-01C mismatch intimation Tax period, stated difference, reply date and any portal instructions. The GST Portal FAQ directs taxpayers to respond in Part B of DRC-01C. The FAQ also warns that failure to respond to a previous-period DRC-01C may block later GSTR-1 or IFF filing.
Show-cause notice under section 73, potentially accompanied by a DRC-01 summary The notice’s allegations, tax periods, proposed amounts, reply deadline and procedural directions. Reply according to the notice and the applicable statutory process. Do not assume that a DRC-01C response answers a separate show-cause notice.
Audit discrepancy communication The discrepancies identified, the audit stage and the time allowed for your explanation. Follow the audit communication’s process. CGST Rules Rule 101 provides for a reply to audit discrepancies before findings are finalised.
Another form or communication The issuing authority, legal provision, form, annexures and stated instructions. Use the route specified for that communication; obtain professional advice if the route or consequence is unclear.

Save the complete communication, annexures, date of service and the portal acknowledgement for your records. Note the deadline stated in the actual notice; do not infer one from a different form or proceeding.

Why a GSTR-2A and GSTR-3B difference needs period-specific review

GSTR-2A and GSTR-3B do not answer every legal question about ITC eligibility. The applicable test depends on the tax period and the law in force for that period. Under current CGST Act section 16(2)(aa) and CGST Rules Rule 36, supplier furnishing of invoice or debit-note details and their communication to the recipient are relevant; Rule 36 refers to FORM GSTR-2B. Older periods may be subject to earlier legal text or period-specific measures.

Do not apply current requirements retroactively without checking the law applicable to the period under dispute. Nor do the official materials establish one universal numerical tolerance that makes every GSTR-2A/GSTR-3B variance acceptable or disallowable. A changing GSTR-2A screen is not a substitute for preserving dated extracts and explaining the period and transaction involved.

Reconcile the disputed ITC invoice by invoice

Build a period-wise working that lets the officer follow each disputed item from the notice to your records. Include only explanations that your documents support; a numerical variance and a failure of a legal eligibility condition are different issues.

Reconciliation field What to record
Supplier and document Supplier GSTIN, invoice or debit-note number and date.
Amounts Taxable value and each relevant tax head, including the amount alleged and the amount you calculate as disputed.
Period and return treatment Period in which ITC was claimed, GSTR-3B claim or reversal, and the relevant supplier-reporting or GSTR-2B appearance.
Explanation The supported reason for the variance, such as timing or supplier filing, a clerical difference, duplicate entry, reversal, import documentation or potentially ineligible credit.
Evidence reference Annexure or record that supports the explanation and the relevant eligibility facts.

Recheck the workings against the notice’s annexures and your books. Separate items you accept from those you dispute, and do not label a line as a timing issue or clerical error unless the records support that explanation.

Choose evidence that answers the allegation

There is no single attachment list prescribed here for every ITC mismatch notice. Select records that substantiate the particular facts and conditions at issue. Depending on the allegation, useful evidence may include:

  • Tax invoices or debit notes and the purchase register.
  • Dated GSTR-2B and GSTR-3B extracts relevant to the disputed periods.
  • Records showing receipt of goods or services and the corresponding accounting entries.
  • Supplier correspondence and evidence of a correction or later filing, where supplier reporting is disputed.
  • Payment records, if relevant to the allegation.
  • Bill of entry or other import records for import-related credit.
  • Workings and records for a reversal, subsequent correction or other return treatment.

CGST Rules Rule 36 addresses documents for availing credit, while section 16 sets out eligibility conditions, including receipt and supplier communication. Match each attachment to a reconciliation line so the response can be checked without guesswork.

Draft a specific reply and file it through the correct route

  1. Address the communication. Identify the GSTIN, form, reference number, date, tax period and stated reply deadline. Confirm which notice or intimation the response answers.
  2. Answer each discrepancy separately. For every item, state the figure alleged, your reconciled figure, the reason for the variance and the evidence reference. Explain the relevant tax-period treatment rather than relying on a general assertion that the credit is valid.
  3. Distinguish accepted and disputed amounts. Explain the calculation for any amount accepted and identify the items you contest. Do not make a blanket admission or denial that your records cannot support.
  4. Make a clear request. Ask that differences supported by the reconciliation and evidence be considered accordingly. Where the applicable proceeding permits it and the facts warrant it, consider requesting a personal hearing.
  5. Submit as instructed and retain proof. For DRC-01C, use Part B through the GST Portal. For a statutory notice or audit proceeding, follow that communication’s stated process. Keep a copy of the filed reply, attachments and acknowledgement.

This is a drafting framework, not a ready-to-file legal reply. Do not insert calculations, dates, notice references or factual explanations unless they match your records.

Decide separately whether to pay, dispute or seek advice

A mismatch is not an automatic reason to pay, and a payment facility is not a decision on whether a proposed demand is correct. The GST Portal has listed an ITC-mismatch reason for voluntary payment through FORM GST DRC-03; that functionality does not establish that payment is appropriate in a particular case. The portal note is a historical functionality announcement, so check the current portal presentation before relying on the route.

If you accept an amount, verify the calculation and obtain advice on the tax, interest, payment route and any penalty consequences applicable to that proceeding. Section 73 includes a notice and pre-notice payment framework for cases within its scope, but whether it applies depends on the actual notice and facts. If the credit is disputed, support the position with the period-specific law and transaction records. Consider a qualified Indian GST practitioner for a material demand, contested legal interpretation, multiple periods, or a matter that may proceed to adjudication or appeal.
