Compare more than a sales pitch: ask what options fit your facts, who will handle the work, what the fee covers, and whether the professional will stay available if the IRS follows up. You may be able to resolve the debt without hiring anyone, and no professional can guarantee a particular outcome.
First, decide what kind of help you need
“Tax resolution” can describe very different work: getting current on unfiled returns, setting up payments, responding to collection notices, requesting penalty relief, or applying for an offer in compromise. A useful first conversation should identify the actual problem and explain which steps may address it—not assume that every person with back taxes needs the same service.

You can contact the IRS or explore its free resources yourself. A representative may be valuable if you have a complicated financial picture, several years of unresolved filings, a time-sensitive collection issue, or simply need someone qualified to communicate with the IRS for you. The decision depends on your circumstances, comfort with handling paperwork, and the complexity of the matter. Hiring help does not make you ineligible for IRS options or guarantee that the IRS will accept a request.
This guide concerns federal tax debts handled by the IRS. State tax agencies have separate processes and rules, so verify a professional’s authority and relevant experience with the particular state if your debt is not federal.

Know who can represent you before the IRS
For representation in all IRS matters—including collections and appeals—the IRS identifies attorneys, certified public accountants (CPAs), and enrolled agents (EAs) as having unlimited representation rights. The IRS’s Topic No. 254 puts it this way: “Only attorneys, CPAs, and enrolled agents can represent taxpayers before the IRS in all matters, including audits, collections, and appeals.” Confirm that the person you hire actually holds the credential; a job title or firm website alone is not verification.
| Credential | How the credential is issued or maintained | What to verify for a back-tax case |
|---|---|---|
| Enrolled agent (EA) | Licensed by the IRS. The IRS describes the credential as requiring a three-part Special Enrollment Examination and continuing education. | Confirm current enrollment and ask how often the EA handles IRS collection matters like yours. |
| Certified public accountant (CPA) | Licensed through a state accountancy board. | Check the license with the relevant state board and ask about direct experience representing clients in IRS collections. |
| Attorney | Licensed through a state court or bar authority. | Check the attorney’s status with the relevant bar authority and ask whether their practice includes federal tax collection work. |
| PTIN holder without one of these credentials | A Preparer Tax Identification Number (PTIN) is a federal identifier for paid federal return preparers. | A PTIN allows a person to prepare federal returns, but by itself it is not the same as the unlimited IRS representation rights held by EAs, CPAs, and attorneys. |
A credential establishes an important baseline, not a specialty. A CPA who mainly prepares business returns, for example, may not routinely negotiate collection cases. Ask about the person who will actually work on your file, not just the credentials of the firm owner or the person conducting the sales call. Some firms use a team; if so, find out who will make decisions, communicate with you, and appear or correspond on your behalf.
Find candidates, then verify them independently
Use more than one discovery route
The IRS Directory of Federal Tax Return Preparers with Credentials and Select Qualifications is one place to find credentialed professionals. You can also ask trusted people or relevant professional organizations for referrals. A directory listing or referral is a starting point, not an endorsement or proof that the person is a good fit for your particular collection problem.

Check the credential and available history
- Ask for the professional’s full name and credential. Confirm whether you are speaking with the person who will represent you or with a salesperson or intake coordinator.
- Verify the status with the credential issuer. For a CPA, check the relevant state accountancy board; for an attorney, check the relevant bar or licensing authority; for an EA, confirm enrollment through the IRS’s available verification resources.
- Look for complaint or disciplinary information. Review what is available from the licensing authority or other relevant professional body. A clean search result does not prove a person will handle your case well, but an unresolved disciplinary issue deserves a clear explanation.
- Compare the person’s experience to your issue. Ask about collection cases similar to yours, including the kind of IRS notice or relief you are considering. “Tax experience” is too broad to answer this question.
The Taxpayer Advocate Service advises taxpayers to do their homework before entrusting someone with personal tax information. Treat verification as part of choosing a representative, not as an accusation against a candidate.
Compare candidates on the work, not the promise
Speak with more than one qualified candidate if you can. Use the same questions so the answers are comparable, and write down who gave each answer. The IRS recommends checking qualifications and history, asking about fees, and choosing someone who will be available after filing season; for a resolution matter, those checks should extend to the proposed route and the people assigned to the case.
| What to compare | Questions to ask | What a useful answer should make clear |
|---|---|---|
| Collection-case experience | “How often do you handle IRS collection cases like mine? Which parts of this work have you personally handled?” | Whether the person has relevant, direct experience rather than only general tax-preparation experience. |
| Who does the work | “Who will be my main contact? Who will review the records and communicate with the IRS?” | The role of the person you meet, any other team members, and how responsibility is divided. |
| Assessment of your options | “Based on what you know so far, what routes might fit? What facts could change that view?” | A preliminary explanation tied to your circumstances, with important unknowns identified instead of a guaranteed result. |
| Fees and scope | “What work is included, how is the fee calculated, and what additional charges could arise?” | What you will pay for, what is excluded, when payment is due, and what may trigger added costs. |
| Availability after the first step | “Will you be available if the IRS asks for more information or follows up after a filing or negotiation?” | Who handles later correspondence and whether that work is included or billed separately. |
| Records and privacy | “What documents do you need, how should I send them, and how will my information be handled?” | A clear, secure process for collecting sensitive financial and tax records. |
Ask for the proposed scope and fee terms in writing before agreeing. Compare what each candidate will actually do, not just the headline price. A low initial fee may cover only an evaluation or a limited filing; a larger quote may include more work. The useful comparison is the written scope, the person responsible, and the likely additional costs—not an unexplained number.

Understand the possible IRS routes before accepting a recommendation
An offer in compromise (OIC) is one option, not the default solution for back taxes. The IRS lists payment in full, short- or long-term payment plans, temporary collection delay, penalty relief, an OIC, and other situation-specific help among possible paths for people unable to pay in full. Filing conditions matter: many payment and relief options require tax returns to be filed. Ask how your filing status and ability to pay affect the recommendation.

An OIC allows a qualifying taxpayer to settle tax debt for less than the full amount. In assessing an application, the IRS considers income, expenses, equity in assets, and ability to pay. A professional should be able to explain how those facts relate to your case and what information is still needed before judging whether an offer is realistic.
IRS Tax Tip 2026-40 states that an OIC application requires a $205 fee and an initial payment, with waivers for qualifying low-income taxpayers. Those terms and waiver conditions can change; check the current Form 656-B instructions before applying. The IRS also provides a free pre-qualifier tool. A result from that tool is not a guarantee that the IRS will accept an offer, and neither a professional nor a marketing claim can guarantee acceptance.

Payment plans and other relief
A payment plan may be more appropriate than an offer if you can pay over time. Temporary collection delay or penalty relief may be relevant in different circumstances. The IRS lists these as possible avenues, but eligibility and application requirements depend on the facts. Ask a candidate to explain why a recommended route is preferable to the alternatives, what returns must be filed first, and what could make the recommendation change.
Be wary if the first conversation jumps straight to an OIC without examining your income, expenses, assets, filed returns, and ability to pay. The IRS warns about “OIC mills” that make aggressive or misleading claims, promise cheap settlements, charge high fees, or market to people who do not qualify. Before paying for a service, compare the pitch with the IRS’s free eligibility resources and ask the professional to connect the recommendation to your facts.

Recognize warning signs before you sign or pay
- A guaranteed settlement or promised debt reduction. The IRS decides whether an application qualifies and what relief is available. A candidate can discuss possibilities, not promise an IRS decision.
- Pressure to act immediately or pay before explaining the work. Ask for time to review the engagement terms and verify credentials. A sales deadline is not a substitute for a reasoned assessment of your case.
- A pitch that treats an OIC as the answer for everyone. The IRS lists multiple routes, and an OIC depends on financial facts and eligibility.
- Unclear fees or a refusal to define the scope. Do not assume that an initial quote includes later IRS correspondence, appeals, or work on additional tax years. Get the inclusions and possible extra charges in writing.
- Requests to sign blank or incomplete forms. Never sign a document before you understand what it says and have reviewed the completed information.
- A return that is unsigned by the paid preparer or lacks a PTIN. The IRS flags these as warning signs. Review the return yourself, ask questions about entries you do not understand, and keep a copy.
- False or unsupported information. Do not let anyone invent expenses, omit income, or otherwise falsify records to make you appear eligible for relief.
- Fees based on a percentage of your refund, or a refund sent to the preparer’s own account. The IRS identifies both practices as warning signs. Your refund should not be routed through a preparer’s account.
These precautions apply even if the person has a credential. You remain responsible for reviewing documents you sign and for retaining copies of returns and other important paperwork.

Prepare for the first consultation
Bring enough information for a meaningful initial assessment, but do not send sensitive records to a candidate until you have checked their identity and credentials and understand how the documents will be handled. The IRS says good preparers ask to see records and receipts rather than relying on unsupported estimates.
Gather the core records
- IRS notices and letters, including the dates and response deadlines shown on them.
- Recent IRS account information and a list of the tax years involved.
- Copies of filed returns and a clear list of any years that remain unfiled.
- Income records and records of regular household or business expenses relevant to your situation.
- Information about assets and debts, such as property, accounts, loans, and other obligations.
- A short timeline of important events, prior contact with the IRS, payments made, and any earlier arrangements or applications.
If you cannot locate everything, say so. Do not guess at amounts to make the consultation feel complete. Ask which documents are essential for the next step and how to provide them securely. A simple folder or document organizer can help keep notices, returns, and financial records together, but it is optional and does not replace professional advice or IRS requirements.
Use the meeting to test the working relationship
Describe the issue plainly, including what you know and what remains uncertain. Ask the candidate to distinguish an initial view from a final eligibility determination. Before ending the meeting, make sure you understand the likely next step, what you are expected to provide, who will contact you, and how and when you will hear about progress. If the explanation relies on urgency or slogans rather than your records and the IRS criteria, continue comparing candidates.
Make the decision and protect your role in the case
Choose the candidate whose credentials are verified, experience matches your issue, answers are specific, fees are understandable, and responsibilities are clear. A polished website, referral, or confident presentation cannot substitute for those checks. If no candidate can explain why a proposed route fits your facts, you can pause and use the IRS’s own resources to learn more before committing.
Once you hire someone, keep copies of the engagement terms, tax returns, applications, records submitted, and communications. Read every form before signing, correct mistakes, and keep your own calendar of IRS deadlines and promised follow-ups. Representation gives a professional authority to assist you; it does not remove your need to understand what is being submitted in your name.
The IRS reports that more than half of taxpayers use a paid tax professional to help prepare federal tax returns, according to IRS Tax Tip 2026-11, dated February 10, 2026. That statistic concerns tax-return preparation generally; it does not show how many taxpayers hire someone for tax-resolution representation.
