This guide covers appeals under India’s Central Goods and Services Tax (CGST) framework. It is not the Canadian GST/HST process or any other country’s procedure. In India, a person aggrieved by an appealable adjudicating authority order generally files a first appeal with the Appellate Authority within three months after the order is communicated. A delay of up to one additional month may be condoned only when sufficient cause is established. The exact route depends on the order, the issuing authority, the statutory provision and the communication date shown in your records.

Before paying or filing, read the entire order, identify the provision under which it was issued, record the communication date and check the current GST Portal instructions and statutory text. An assessment demand and a refund-related decision can follow different provisions and may not use the same portal choices.

What a GST appeal challenges

A GST appeal is a statutory challenge to a decision or order made by an adjudicating authority. The first appellate level is generally the Appellate Authority under section 107 of the CGST Act. The appeal is not a general request to reopen every disagreement with the department: the challenged document must be an appealable decision or order, and the filing must satisfy the applicable limitation, payment and document rules.

The order itself should answer the questions that determine the route:

  • Which officer or authority issued it?
  • Which section and rule are cited?
  • When and how was it communicated?
  • What tax, interest, penalty, refund or input tax credit amount is admitted and what amount is disputed?
  • Does it contain a demand, a rejection or reduction of a refund, a penalty, or another decision?

The GST Portal FAQ gives examples of demand orders that can be selected for an Appellate Authority filing, including assessment orders under sections 62, 63 and 64, specified decisions concerning section 64(2), certain penalty orders, remanded matters and orders in listed demand proceedings. That list is not a ruling that every GST decision is appealable. For a refund rejection or reduction, verify the exact form, statutory provision and issuing officer before choosing an appeal route.

First check the limitation period

Ordinary three-month period

The GST Portal FAQ states that a taxpayer or an unregistered person aggrieved by an adjudicating authority’s decision or order may appeal within three months from communication of the order. The clock is tied to communication, not necessarily the date printed on the order or the date you happened to open it. Keep evidence such as the portal posting, email, electronic service record or other delivery record.

One-month condonation is not an automatic extension

The Appellate Authority may condone a delay of up to one further month when sufficient cause prevented timely filing. This is a limited discretionary power, not a guaranteed fourth month. A late filing should include the facts and evidence explaining the delay and a specific request for condonation. Do not assume that paying the pre-deposit or starting an application after three months preserves limitation.

Build a deadline record

  1. Write down the date on which the order was legally communicated.
  2. Count the three-month period using the applicable statutory method and confirm the result against current official guidance.
  3. Allow time for obtaining a certified copy, preparing grounds, arranging payment and resolving portal or digital-signature problems.
  4. If the ordinary period has expired, determine whether the remaining condonable period is still open and prepare the cause-of-delay evidence before filing.

An adviser can calculate limitation for a particular order, but no one can create an extension beyond the authority’s statutory power. If the document is unclear about communication, obtain clarification immediately rather than relying on an informal date.

Calculate the payment needed before a first appeal

Admitted dues and disputed tax

The GST Portal FAQ states that at least 10% of the disputed tax must be paid as a pre-deposit before a first appeal is filed. CBIC explanatory material describes the condition as payment of admitted dues plus 10% of the remaining disputed tax. “Disputed tax” is not automatically the same as the total figure on the demand notice: the calculation depends on what you admit, what you challenge, earlier payments and the order’s component amounts.

Item What to establish from the order and payment records
Admitted dues Tax, interest or penalty that you accept as payable and that the applicable rule requires you to pay.
Disputed tax The tax portion you challenge, separated from interest and penalty where the law requires.
First-appeal pre-deposit The GST Portal FAQ describes a minimum of 10% of disputed tax, subject to the current law and case calculation.
Earlier deposits or credits Amounts already paid or credited that may affect the balance; verify how the portal applies them.

Do not calculate a personal amount from the 10% headline alone. Reconcile the demand order, electronic liability ledger, payment challans, any recovery already made and the grounds of appeal. If the order includes several tax periods or heads, document the disputed amount for each so that the total in the form matches the payment evidence.

What happens after admission

The GST Portal FAQ says that after an appeal is admitted, the portal flags the balance disputed amount as non-recoverable. That protection is conditional on admission. Filing an application, receiving a provisional acknowledgement or paying the pre-deposit does not by itself mean that every recovery action has stopped. Monitor the appeal status and respond to any recovery communication.

File FORM GST APL-01 on the GST Portal

Portal path for a demand-order appeal

For a demand-order application, the GST Portal FAQ gives this path:

  1. Sign in to the GST Portal.
  2. Open Services.
  3. Select User Services.
  4. Open My Applications.
  5. Choose Application Type: Appeal to Appellate Authority.
  6. Select New Application.
  7. Choose Demand Order as the order type.
  8. Complete the application in FORM GST APL-01.

Portal labels can change and the FAQ is specifically framed around demand orders. If your matter concerns a refund decision or another order type, use the current application choices shown for that document and confirm the route before submitting.

Complete the form from the order, not from memory

Enter the order number, date, issuing authority, relevant tax periods and amounts exactly as shown. State the grounds in a logical sequence: identify the finding challenged, explain the factual or legal error, identify the evidence supporting your position and state the relief requested. Separate jurisdictional objections, limitation arguments, classification or valuation disputes, credit issues, computation errors and penalty arguments instead of combining them into an undifferentiated narrative.

Attach a schedule that reconciles the order’s figures with the amount admitted, the disputed tax and the pre-deposit. If only part of a multi-period order is challenged, mark each period and tax head clearly. A reviewer should be able to trace every figure in APL-01 to the order or a payment record.

Sign and submit correctly

The FAQ describes signing with a digital signature certificate (DSC) or electronic verification code (EVC). A DSC is mandatory for companies and limited liability partnerships. Confirm the authorised signatory, certificate validity, mobile number and email access before starting the final submission. A technical failure after the limitation date can leave you with an incomplete filing, so do not wait until the last day.

Documents, certified copies and the acknowledgement that proves filing

Provide the challenged order and supporting evidence

CBIC’s rules require the certified copy of the challenged order and supporting documents under the specified procedure. The GST Portal FAQ says that where the order is not uploaded, a self-certified copy must be submitted within seven days. Follow the current portal instructions for your order type, because the interface may require an upload, a later submission or both.

Understand the seven-day rule

The rules describe submission of the certified copy and supporting documents within seven days and issuance of a final acknowledgement in FORM GST APL-02. They state that the appeal is treated as filed only when the final acknowledgement indicating the appeal number is issued. Where the documents arrive within seven days, the filing date is the provisional acknowledgement date; when they arrive later, the filing date is the document-submission date.

This makes the acknowledgement more than a receipt. Save the provisional acknowledgement, uploaded files, payment challans, the final APL-02 and the appeal number. If the order was not available on the portal, preserve proof of the self-certified copy submission and its date. If no final acknowledgement appears, contact the appropriate portal or departmental channel promptly and retain the error record; do not assume that a draft or provisional number establishes a valid appeal.

Refund decisions need separate verification

A refund rejection, partial sanction, or decision affecting input tax credit can arise under a different provision and may not fit the GST Portal FAQ’s demand-order examples. Read the refund order for its statutory section, issuing officer, appeal instruction and communication date. Confirm whether the document is an appealable adjudicating order, whether a different remedy is prescribed, and which application type the current portal displays.

CBIC explanatory material says an Appellate Authority may, after giving the appellant a reasonable opportunity to show cause, reduce a refund or input tax credit. That describes a power exercised in an appeal; it does not establish that every refund rejection follows the same appeal route or that an appeal will increase an entitlement. Your grounds should identify the refund claim, relevant invoices or export evidence, conditions allegedly not met, correspondence, and the precise relief sought.

Do not relabel a refund dispute as a demand appeal merely because the portal offers a familiar demand option. If the order or portal instructions are ambiguous, obtain a written clarification or professional advice before the limitation period expires.

What to expect after submission

Admission and departmental response

Check the portal for the final acknowledgement and appeal number, notices, hearing dates and orders. The Appellate Authority may seek a response, additional documents or clarification. Meet each deadline in the notice and keep proof of upload and delivery. Organise a hearing bundle with the order, APL-01, acknowledgement, payment evidence, key exhibits and a short index.

Recovery and disputed amounts

Until admission and the applicable statutory conditions are satisfied, do not treat the disputed balance as automatically protected. If recovery action continues, compare it with the appeal status and payment conditions and raise the issue through the prescribed channel. Keep the admitted amount and pre-deposit calculations consistent in every communication.

Further appeal to the GST Appellate Tribunal

A party dissatisfied with an appealable Appellate Authority decision may have a further remedy before the GST Appellate Tribunal (GSTAT), subject to the applicable statute, limitation and transitional notifications. CBIC’s rules identify FORM GST APL-05 for an electronic appeal to the Appellate Tribunal and describe provisional and final acknowledgement steps, supporting documents and a rule-based fee. The cited rule describes a fee of ₹1,000 per ₹1 lakh of the relevant amount, subject to a maximum of ₹25,000. Verify the current rule and notifications before relying on that figure or submitting payment.

Tribunal requirements are not simply a repeat of APL-01. Compare the order being challenged, the date limitation starts, required pre-deposit, form, supporting documents, acknowledgement and the next appeal level. The CBIC explanatory material describes an additional 20% pre-deposit at the Tribunal stage within the overall statutory framework; the amount must be calculated from the actual order, prior deposits and current law.

The 31 July 2026 GSTAT date is historical

In a Ministry of Finance press release dated 30 June 2026, the Government said it extended a specific section 112(1) read with section 112(3) GSTAT filing deadline from 30 June 2026 to 31 July 2026. That date had elapsed by 9 October 2026. It is not a current future deadline and does not automatically extend the ordinary limitation period for a new appeal. The same release reported 30,000 appeals in the final 15 days and a peak of 5,500 appeals per day; those figures describe reported filing activity during that period, not the likelihood of success or the present backlog.

India is not Canada’s GST/HST appeal process

This article uses India’s CGST framework. Canada generally requires an objection to the Canada Revenue Agency before a Tax Court appeal in the situations covered by its guidance, with 90 days to appeal to the Tax Court after specified CRA decisions. That comparison is included only to prevent a jurisdictional mistake: do not import Canada’s objection-first steps, forms or deadlines into an Indian GST appeal.

Common filing failures and how to prevent them

  • Using the order date instead of communication date: preserve the service record and calculate from the legally relevant communication event.
  • Assuming three months plus one month is automatic: file on time or submit a supported condonation request within the limited additional period.
  • Paying 10% of the total demand without reconciliation: separate admitted dues, disputed tax, interest, penalty and prior payments.
  • Stopping at a provisional acknowledgement: obtain and save the final APL-02 acknowledgement and appeal number.
  • Uploading an uncertified or incomplete order: follow the seven-day document instruction and keep the self-certified or certified copy evidence.
  • Selecting Demand Order for a refund matter: verify the refund order’s provision and current portal application type first.
  • Ignoring digital-signature requirements: companies and LLPs need a valid DSC; test the authorised signatory before final submission.
  • Assuming filing alone blocks recovery: confirm admission and the statutory pre-deposit conditions, then monitor recovery notices.
  • Relying on an expired GSTAT extension: check current notifications rather than using the July 31, 2026 date as a live deadline.

Practical filing checklist

  • Original order and proof of communication.
  • Section, rule, issuing authority and order type.
  • Limitation calculation and, if needed, a documented condonation explanation.
  • Statement of admitted dues, disputed tax, interest, penalty and earlier payments.
  • Evidence of the required pre-deposit and any admitted payment.
  • Completed FORM GST APL-01 and concise, numbered grounds.
  • Certified or self-certified order copy as required, plus relevant invoices, returns, ledgers, correspondence and calculations.
  • Valid DSC or EVC and authorised-signatory details.
  • Saved copies of the submission, provisional acknowledgement, final FORM GST APL-02 and appeal number.
  • Calendar reminders for notices, hearings, document requests and any further appeal period.

When individualized advice is warranted

Consider a qualified GST practitioner or tax lawyer when the order covers multiple periods, the communication date is disputed, the limitation period has expired, the pre-deposit is substantial, recovery is active, the matter concerns a complex refund or input-tax-credit chain, or the order’s appealability is unclear. An adviser can work from the actual order and current notifications; a general guide cannot determine those case-specific questions.

Sources and currency of the procedure

The procedural points above are drawn from the GST Portal FAQ, CBIC’s GST appeal rules and explanatory material, and Ministry of Finance information on the 2026 GSTAT extension. Portal screens, notifications and statutory text can change. Before submitting, compare the order and current official instructions with the steps here, especially for refund decisions, Tribunal appeals, fee amounts and limitation.
