That can reduce one kind of custody exposure, but it does not establish that the service is legitimate, appropriately regulated, secure, suitable for you, or safe to use. Before connecting an account, verify who operates the service, what authority it receives, how its strategy and controls work, what happens to your data, and how to stop it.
What does non-custodial mean for an automated investing service?
In this context, non-custodial describes where assets are held; it does not necessarily describe what a provider can do. FINRA describes auto-trading generally as a third party sending trading instructions directly to an investor’s brokerage account for immediate execution. A service can therefore lack custody of your money while still having a consequential role in trading your account.

Separate three questions that are often blurred together:
- Custody: Which institution holds the assets?
- Access and authority: What account information and actions can the service access or initiate?
- Accountability: Which legal entity operates the service, and what rules apply to that entity’s activities?
A claim about the first does not answer the other two. Do not infer safety or regulatory status from the word non-custodial, an AI label, or a polished app.

How should you evaluate a platform before connecting an account?
Use this sequence before authorizing a connection. Ask for answers in the provider’s current official documentation, not only in marketing copy or a sales conversation.
- Identify the operator. Find the legal entity behind the service, responsible people, the jurisdictions it serves, and the brokerages or other venues it connects to.
- Check the entity and activity. Independently consult the relevant regulator records for the actual legal entity and the activity it performs. The appropriate records depend on the service’s role and jurisdiction; a technology label or claim that assets are not held by the provider is not proof of authorization.
- Map account permissions. Determine what the connection allows, who executes orders, and how to monitor and revoke access.
- Understand the investment method. Ask what decisions are automated, what evidence supports claims, and what remains subject to human review.
- Review safeguards and data practices. Establish how the service detects failures, records actions, protects information, and responds to incidents.
- Check personal fit. Compare the tool’s assumptions with your full financial circumstances, not just the account you connect.
FINRA has warned about unregistered auto-trading services and unsupported AI claims, including claims about risk controls, market prediction, or returns. Treat independently verifiable details as more useful than testimonials or claims of sophisticated AI.
What account permissions are you actually granting?
Ask the provider and the brokerage to explain the complete path from account connection to order execution. The exact permission model varies by integration, so do not assume that all services use the same type of access.

| Capability to clarify | Question to ask | Why it matters |
|---|---|---|
| Read account information | Can the service see balances, positions, transaction history, or other account details? | Read access still exposes sensitive financial information and may reveal your holdings and activity. |
| Create or submit orders | Can the service prepare orders, submit them, or send instructions for immediate execution? Which party executes them? | Order authority can affect your investments even if the provider never possesses the assets. |
| Change settings | Can the provider or its software change strategy parameters, risk limits, or account connection settings? | Changes may alter behavior after you have made your initial decision to connect. |
| Move assets | Can the service withdraw, transfer, or otherwise move funds or securities? | Establish explicitly whether any transfer authority exists; do not treat it as equivalent to trading permission. |
Find out how access is authorized, where permissions can be reviewed, who can change them, and how you revoke them. Confirm what happens to open orders and future instructions after disconnection. If the provider cannot explain the permissions in plain language, do not proceed until the scope is clear.
How can you assess the AI and investment strategy?
Ask what the system does
Request a comprehensible account of the strategy: what inputs it uses, what decisions it makes, which actions are automated, and which decisions require a person’s approval. Ask how the strategy was developed, tested, validated, monitored after launch, and changed over time. A broad statement that AI analyzes the market is not enough to understand what can happen in your account.
Ask what supports performance claims
For any return or risk claim, ask for the evaluation period, the data and method used, and whether reported results account for fees, slippage, and losses. Find out whether figures are simulated or reflect actual client accounts, and what assumptions limit their relevance. The reviewed FINRA materials warn against unsubstantiated promises such as risk-free or consistently profitable trading, and claims that AI can reliably predict markets or optimize returns. They do not validate any specific platform’s performance.
Check the controls and audit trail
Ask what limits constrain the system, what conditions trigger a pause or escalation, who reviews alerts, and how a person can stop trading. Find out whether there is a record connecting a system recommendation or decision to the resulting order and any human approval. FINRA’s 2026 annual oversight report flags the risk of AI agents acting autonomously without human validation and approval; its algorithmic-trading guidance emphasizes strategy development, testing, and implementation.

Ask the provider to explain its response to conditions that could disrupt the system or its assumptions. These are due-diligence scenarios, not claims that a particular platform has experienced them.
- Unusual volatility or a disruptive market event: Does the system reduce activity, pause, or continue following its normal rules?
- Outage or broker disconnection: What happens to new instructions and orders already submitted?
- Stale, missing, or conflicting data: How does the service detect the problem, and does it fail safely or keep acting?
- Duplicate orders or unexpected behavior: What monitoring can detect repeated or out-of-scope actions, and who can intervene?
- Model or strategy changes: How are changes tested, documented, approved, and communicated to users?
FINRA’s securities-industry AI report notes that conditions outside a model’s training assumptions, including unusual volatility and major disruptive events, can undermine predictions and lead to undesired behavior. A useful answer explains controls and recovery steps, not just that the system is monitored.

How should you evaluate data privacy and security?
Before connecting an account, establish what information the service collects and how it handles it. Review its privacy notice, security documentation, and provider terms for specifics on:
- Account credentials, access tokens, personal information, and financial data collected.
- Third parties or vendors that receive the information, and why they receive it.
- Whether account data is used to train or improve models.
- How long information is retained, how deletion works, and what remains after you close the account.
- How the provider handles a suspected security incident and communicates with affected users.
FINRA’s securities-industry AI discussion identifies cybersecurity, customer privacy, data governance, and vendor management as relevant concerns. It does not establish a universal retail-platform security checklist or certify any provider. Vague answers about data use, access, retention, or deletion leave material questions unresolved.
How do you decide whether the service fits your finances?
Evaluate the service against your overall financial situation, not just the account it can connect to. FINRA’s guidance on automated investment tools cautions that a tool may not account for all of an investor’s circumstances. Consider whether its assumptions reflect:
Best Value
- Your total holdings and investments outside the connected account.
- Your goals, time horizon, investment experience, and willingness to accept losses.
- Your need for liquidity and the possibility that you will need cash on short notice.
- Your tax circumstances and the consequences of trading in the relevant account.
Automated execution does not remove investment risk or make a strategy appropriate for every person. If you cannot explain how the service’s approach fits your circumstances, do not treat automation as a substitute for that judgment.
What do FINRA rules and securities laws establish?
Keep regulatory claims tied to the entity, its activity, and the relevant jurisdiction. FINRA Regulatory Notice 24-09, published June 27, 2024, says existing FINRA rules and securities laws continue to apply when FINRA member firms use generative AI; it does not create new requirements or excuse existing obligations. That statement is not a finding that a particular platform is a FINRA member or that every non-custodial arrangement has the same legal status.
FINRA’s AI report discusses supervisory controls and other considerations in the securities industry. Separately, FINRA explains that SEC Rule 15c3-5 requires broker-dealers with market access to establish, document, and maintain risk-management controls and supervisory procedures. These materials do not show that every retail automation tool is subject to the same requirements. For a specific provider or arrangement, check the relevant entity and activity with the appropriate regulator records and seek qualified advice when needed.
