The right choice depends on your state’s law, the facts of the death, and the lawyer’s relevant experience, case plan, communication, and written fee terms. Compare several candidates when practical, ask each the same questions, and get local legal advice promptly: deadlines and procedures vary by jurisdiction.
Start with fit, not advertising or a referral alone
A recommendation can help you find candidates, but it cannot establish that a lawyer is suited to your family’s case. The American Bar Association (ABA) cautions that a lawyer who worked well for someone else may not fit your particular legal problem. Look for a lawyer who can explain the relevant experience and approach in terms of your circumstances—not just a slogan, advertised result, or broad claim of specialization.
You can ask trusted people for names, contact your state or local bar association, or use a local lawyer-referral service that organizes referrals by practice area. Treat any listing as a starting point, not an endorsement. For ABA-reviewed referral programs, standards include objective experience requirements for panel lawyers, a client feedback or complaint mechanism, and verified malpractice insurance. ABA review concerns the program’s standards; the ABA says it does not individually review every panel lawyer’s qualifications. Check the program’s current status and independently assess each lawyer.
Compare candidates on the work they would do
Ask each lawyer the same questions so you can compare substance rather than presentation. You are assessing whether the lawyer has relevant skills, a plausible plan, time and capacity to handle the matter, and a communication style your family can work with. A lawyer should be able to discuss what is known, what needs investigation, and what remains uncertain without promising a result.

Relevant experience and role
Ask whether the specific lawyer who would manage the case has handled wrongful-death matters or closely related complex civil litigation. Ask what their role was, including whether they investigated, negotiated, or tried the case. Prior experience may help you evaluate fit, but a past outcome does not predict what will happen in your case.
Investigation and case plan
Ask what facts, records, and evidence the firm would seek first; whether experts may be needed; and what obstacles the lawyer sees. The answer should be tailored enough to show how the lawyer thinks about your situation, while recognizing that a lawyer may need more information before assessing the claim fully.

Responsibility and capacity
Find out who will be your day-to-day contact, who will make key decisions and appear in court, and whether co-counsel or another firm may participate. Ask how the work and any fee division would be handled. You should know who is responsible for the matter rather than assuming the lawyer you meet will do all of the work.
Communication and confidence
Ask how often the firm expects to provide updates, by what method, and who will respond to questions. Notice whether the lawyer explains options plainly and answers difficult questions candidly. A respectful working relationship matters in a long, emotionally difficult case; your family should feel able to speak openly.

Use a consultation checklist
Bring these questions to each meeting. If you do not know an answer yet, say so; the purpose is to understand the lawyer’s approach and identify what needs follow-up.
- Who will personally manage my case, and who will handle day-to-day questions?
- What wrongful-death or similar cases have you handled, and what was your role?
- What facts or documents would you investigate first in a case like mine?
- Which parts of a possible claim are uncertain or difficult to prove?
- What fee percentage applies at settlement, trial, or appeal?
- Are expenses deducted before or after the fee is calculated?
- If there is no recovery, which case expenses might I still owe?
- Will co-counsel be involved, and how will any fee division work?
- How will you update me, and whom should I contact with questions?
- Which state’s law and filing deadline may apply, and what facts could affect that analysis?
Ask whether the introductory consultation is free before you book it. The ABA notes that many lawyers offer a brief initial meeting without charge, but this is not guaranteed.

Many injury and wrongful-death matters are handled on a contingent-fee basis, but there is no single percentage that applies to every lawyer or case. Review the proposed agreement in writing and ask the lawyer to explain any term you do not understand. The ABA Model Rule 1.5 says a contingent-fee agreement should be written and signed and describe how the fee is calculated, including percentages at settlement, trial, or appeal; which litigation expenses are deducted from a recovery; and whether those expenses come out before or after the fee is calculated. It also addresses expenses for which the client remains liable regardless of the outcome. The Model Rule is not automatically the law in every state, so the applicable state rule and your contract matter.
Separate the attorney’s fee from case expenses. Filing fees, deposition costs, and similar charges may still be owed even when there is no recovery. Ask which costs the firm advances, which costs you could ultimately owe if the claim fails, and how potentially substantial expert, record, filing, or deposition costs are handled. Do not assume that “contingency” means there can never be an out-of-pocket bill.

Verify credentials and act promptly on local law
Confirm the lawyer’s current license status and any public discipline history with the relevant state bar or licensing authority. Membership in a professional association or placement on a referral panel is not, by itself, proof that a lawyer is the right fit.
Wrongful-death rules are state-specific. Who may bring a claim, the limitation period, required notices, available damages, and procedure can depend on the jurisdiction and the facts, defendant, and type of claim. A general article cannot determine the deadline for your family. Contact a lawyer licensed in the relevant jurisdiction promptly and ask which law may govern; do not wait to compare candidates if a filing or notice deadline may be approaching.
