For a Central Government civil employee, the usual dividing line is the appointment date: employees appointed before 1 January 2004 were generally covered by the defined-benefit Old Pension Scheme (OPS), while new civil recruits appointed on or after that date were generally placed in the National Pension System (NPS). A narrowly defined, one-time Central Government exception can apply where the recruitment result was declared before 1 January 2004 for a vacancy arising by 31 December 2003. State employees, defence personnel and private-sector workers must use different rules.
Your appointment order, recruitment result, vacancy record, service book, payroll deductions and any pension-option order—not an old job advertisement alone—determine the answer. The practical way to check is to identify your service category, verify the dates that control it, inspect your pension records and obtain a written determination from the competent pension or establishment authority.

What “old pension scheme” means
OPS is the defined-benefit pension arrangement provided under the applicable government pension rules. In a defined-benefit system, the pension entitlement is determined by service rules and qualifying service rather than by the investment performance of an individual retirement account.
NPS is different: it is a contributory, market-linked retirement system. Contributions are credited to an NPS account and the eventual benefit depends on contributions, investment returns and the withdrawal or annuity choices permitted by the rules. Being enrolled in NPS does not, by itself, create a right to switch to OPS.

“OPS” is commonly used in public discussion as though one nationwide rule exists. It does not. The Central Civil Services rules, each state’s pension notifications, defence pension provisions and private-sector arrangements operate under different authorities. Eligibility must therefore be tested against the employer and service category before any date is considered.
Start by identifying the employment category
Use the category that matches the post for which you are claiming coverage. Do not apply the Central Government cutoff automatically to another employer.

Central Government civil employees: the date-based test
1. Locate the actual appointment date
Find the date on which the Central Government civil appointment took effect. Use the appointment order, joining report and service-book entry. The relevant question is when the appointment was made under the service rules, not simply when an application was filed, an examination was held or a letter was issued.
For Central Government civil service, the general transition took effect on 1 January 2004. The Government’s stated position is that OPS benefits under the amended Central Civil Services (Pension) Rules are not admissible to civil servants appointed on or after that date. An appointment before the transition date is generally associated with OPS coverage, subject to the specific pension rules, qualifying service and the employee’s records.
2. If the appointment was before the transition date
Check that the post is actually a Central Government civil post and that the service-book and appointment records are consistent. Confirm which pension rules are cited in the appointment or service documents, and inspect payroll records for any NPS account or deductions that could indicate an administrative error requiring correction.

3. If the appointment was on or after 1 January 2004
Start with the presumption that NPS applies. Then test the limited recruitment exception described in the Government’s 2020 account. It concerns candidates whose recruitment result was declared before 1 January 2004 against vacancies that arose on or before 31 December 2003. Qualifying employees could be given a one-time option to move from NPS coverage to the Central Civil Services (Pension) Rules, subject to the terms and departmental process of that option.
The exception is not triggered merely because a vacancy was advertised before 2004 or because the examination was conducted before the cutoff. The Government expressly stated that the advertisement date and examination date are not, by themselves, the basis for deciding eligibility.

How to test the Central Government exception
Collect the following evidence and compare the dates rather than relying on recollection:
- Recruitment result: obtain the official result or selection list and verify that it was declared before 1 January 2004.
- Vacancy date: confirm from the requisition, vacancy statement or department record that the vacancy arose on or before 31 December 2003.
- Appointment and joining: record the actual appointment and joining dates, even if they occurred later because of litigation, verification, training or administrative delay.
- Departmental order: look for the notice or order that offered the one-time option and states how it had to be exercised.
- Option exercise: verify whether you submitted the option in the required form and within the notified time, and whether the department accepted it.
- Pension-account treatment: check whether NPS deductions were stopped, whether the accumulated account was dealt with under the applicable order and whether the service book was amended.
A result before the cutoff and a qualifying pre-2004 vacancy are both material. A pre-2004 advertisement without those facts is insufficient. If one record conflicts with another, ask the department to identify the controlling document and issue a written decision instead of treating an informal assurance as final.

- Appointment order, joining report and any order changing the effective date of appointment.
- Service-book extracts showing the post, employer, date of appointment and pension-rule entry.
- Recruitment notification, vacancy requisition, result or selection list and correspondence explaining any delayed appointment.
- Salary slips or payroll statements showing NPS deductions, a PRAN or another pension-account reference, or the absence of such deductions.
- NPS account statements and any transfer, withdrawal or closure communication.
- Written pension-option notice, the option form you submitted and the department’s acceptance or rejection.
- Orders concerning technical resignation, transfer, deputation, regularisation, absorption or a break in service, because these can affect the applicable rules.
- Any prior written reply from the establishment, personnel, accounts or pension section.
Ask the employer’s pension, establishment or personnel section to state in writing which rule applies to your service record, the facts relied upon and the procedure for correction or appeal. The official material does not establish a single nationwide online checker that can decide every employee’s status.

State Government employees: use your state’s rules
There is no safe, single OPS cutoff for every state. States have issued their own pension rules and notifications, and policy can differ by department, recruitment year, cadre and category of appointment.
Request the state’s current pension rules and any notification covering the transition from its former defined-benefit scheme to NPS. Then match your appointment date, recruitment process, substantive appointment, probation or regularisation status and any state-specific option. Use the state Gazette or the official personnel, finance or pension department publication rather than a general social-media summary.
If you moved between Central and state service, or between two states, establish which employer made the appointment in question and whether past service was counted. A previous period under one government does not automatically carry OPS coverage into a later appointment.
Defence, autonomous bodies and private employment
Defence pensions
Defence pensions follow separate provisions. A civil-service answer based on the 1 January 2004 Central Government transition should not be used to decide a military pension. Take the discharge book, service record, pension sanction and relevant defence orders to the competent defence pension authority.

Autonomous and statutory organisations
An organisation may be government-funded or government-controlled without being covered by the Central Civil Services pension rules. Check its service regulations, the appointment order and any specific government approval that extends a pension scheme to its staff.
Private-sector employment
Private-sector workers do not become OPS members through a public-sector cutoff. An eligible organised-sector employee may have coverage under the Employees’ Pension Scheme administered through EPFO, and an employer may also offer corporate NPS. Those are distinct frameworks with their own contribution, service and benefit rules.

Choosing or being eligible for UPS does not change the historical appointment date or convert an NPS employee into an OPS employee. Review the official UPS guidance and your employer’s recorded option if UPS may apply to you.
Common mistakes and how to resolve them
“The advertisement was issued before 2004, so I must be under OPS.”
Not necessarily. For the Central Government exception, the stated test uses the recruitment-result date and the date the vacancy arose. Obtain those records and do not rely on the advertisement alone.
“My examination was held before the cutoff.”
An examination date alone is also not determinative under the Government’s stated position. Check the result and vacancy evidence.

“My payslip shows an NPS deduction, so the matter is settled.”
A deduction is evidence of how payroll treated you, but it may not resolve a disputed exception or a data error. Compare payroll with the appointment order, service book and any option order, then request a written determination.
“My colleague in another state received OPS.”
That does not establish your eligibility. State rules and notifications differ, and even employees in one organisation can have different recruitment dates or service categories.
“UPS means I have OPS.”
UPS is a later option within NPS for eligible Central Government employees. It is legally and administratively distinct from OPS.

Submit a dated representation listing the disputed facts, attach the relevant documents and request a reasoned, written order. Ask which authority hears an appeal or review. Preserve proof of submission. For a continuing dispute, obtain advice from a qualified service-law or pension professional; do not stop contributions or sign a withdrawal without understanding the consequences.
A practical decision path
- Identify whether the employer is Central Government civil, state, defence, autonomous or private.
- Locate the appointment and joining dates and the pension rule recorded in the service documents.
- For a Central civil appointment before 1 January 2004, verify the service-book entry and rule citation.
- For a Central civil appointment on or after that date, test both the pre-2004 result date and the pre-2004 vacancy date, then locate the one-time option order.
- Check payroll, NPS or other pension-account records for consistency with the appointment decision.
- For state, defence or private employment, obtain the category-specific rules instead of applying the Central test.
- Request a written determination and follow the stated review or appeal route if records conflict.
Why broad scheme statistics do not answer an individual claim
Government reporting gives useful context but cannot establish personal eligibility. A 2026 Press Information Bureau explainer reported 2.17 crore NPS subscribers and 8.96 crore Atal Pension Yojana enrolments as at 31 March 2026. It reported combined NPS and APY assets under management of ₹15.95 lakh crore and APY assets of ₹51.4 thousand crore at the same date. Those totals describe participation and assets; they do not decide whether a particular employee belongs under OPS.
In a written Rajya Sabha reply reported by PIB on 24 March 2022, Minister of State Dr Jitendra Singh said: “There is no proposal to reintroduce old pension scheme to Central Government civil employees joined on or after 01.01.2004 under consideration of Government of India.” That was a dated statement about the Central Government position, not a ruling on every state, defence category or later policy option.
