How to Check Whether a Tax Deduction or Exemption Is Allowed Under Indian Tax Law

A practical way to verify an Indian tax claim: identify the right tax period, check regime and eligibility, then reconcile evidence with your return.

To check whether an Indian tax deduction or exemption is allowed, first identify the tax period and applicable law, then confirm that the benefit applies to your taxpayer type and tax regime. Read the provision’s conditions, match them to your payment or income and supporting records, and report the claim in the correct return schedule. An employer’s estimate or a prefilled tax record is useful evidence, but neither by itself establishes legal eligibility.

Start with the tax period, not the claim’s name

Write down the transaction or payment date, the financial year, and the assessment or tax year shown on the return. Those details determine which Act, amendments, rules, forms, and transition provisions to check. A claim described simply as “rent,” “insurance,” or “donation” is not enough to establish that it qualifies.

The Income-tax Act, 2025 says it comes into force on 1 April 2026, except where otherwise provided. CBDT’s 1 April 2026 press release says it replaces the Income-tax Act, 1961, and that the Income-tax Rules, 2026 were notified on 20 March 2026. For an earlier period, check the law and transition rules applicable to that period rather than applying a newer Act’s section labels automatically.

Year-specific guidance can help orient you, but it may address a different period. For example, the Department’s AY 2026-27 filing guidance still presents salary and return instructions under the 1961 Act. Check the effective date and year attached to every rule, form, FAQ, and threshold you use; do not carry an older rupee limit into a later year without verifying it.

Confirm who is claiming and which tax regime applies

Check the taxpayer’s status, residence, income type, and relevant tax regime. A rule for a salaried resident individual may not apply in the same way to a non-resident, business taxpayer, Hindu undivided family, or another taxpayer. The Department’s AY 2026-27 guidance describes the new regime as the default for eligible taxpayers and explains the choice and opt-out procedures for that guidance’s stated year.

Regime choice can change whether a benefit is available at all. The Department’s tax-regime FAQ says HRA exemption under section 10(13A) is unavailable under the new regime. It also describes Chapter VI-A deductions as generally restricted there, subject to specified exceptions, including sections 80CCD(2), 80CCH, and 80JJAA under the cited section 115BAC rules. Some FAQ answers are framed for earlier assessment years, so treat them as examples of regime sensitivity and verify the law for the period you are filing.

Under the AY 2026-27 guidance, non-business cases may choose annually in the return by the applicable due date. Eligible taxpayers with business or professional income use Form 10-IEA to opt out and face additional restrictions on switching back. These are year-specific instructions; confirm the current procedure and deadline for your return year.

Read the provision’s full eligibility test

Find the provision in the official Act, then check the rules, notifications, and official guidance that apply to the same period. Use an FAQ to navigate, not as a substitute for the legal text when the claim is significant or the FAQ addresses another year.

Turn the provision into a practical checklist before deciding whether to claim:

  • Eligible claimant: Does the provision cover your taxpayer category and circumstances?
  • Qualifying payment, income, or event: Does your specific transaction meet the legal description?
  • Calculation: What limit, percentage, base, or other calculation applies for that period?
  • Exclusions and interactions: Are there conditions that disqualify the claim or affect another benefit?
  • Timing and procedure: Is there a deadline, election, certificate, or prescribed form?
  • Return reporting: Which schedule, fields, and supporting details must accompany the claim?

For example, the Department explains that not every donation earns a 100% deduction: the treatment depends on the recipient category and applicable conditions. A receipt alone does not establish the rate or entitlement. Check the provision and recipient’s status for the relevant period before entering the claim.

Gather evidence that supports the particular claim

Keep contemporaneous records that show what was paid, to whom, when, and by whom. The Department’s salary and deduction guidance and its ITR-2 help give examples such as insurance receipts, donation receipts, rent receipts, tuition-fee receipts, and loan details. Which records matter depends on the provision and your facts; these examples are not a universal document list.

Some claims also call for particular identifiers, declarations, or forms. In the specified return guidance, section 80GG claims involve Form 10BA before claiming; other claim examples request policy, insurer, or loan details. Check the instructions for your own return year and claim instead of assuming the same form or field applies universally.

Reconcile the claim with tax records and the return

Employer and portal records help you check what has already been reported, but they do not decide whether a deduction is legally available. The Department describes Form 12BB as employee claim particulars furnished to an employer and Form 16 as a salary and tax-deduction certificate. Form 26AS reports tax deducted or collected, while the Annual Information Statement (AIS) can include tax information and specified financial transaction information.

Compare those records with your underlying evidence and return. The Department’s salary guidance and ITR-2 instructions describe the records and claim details taxpayers may need to review. Ensure income is reported, tax deducted is claimed as credit in the appropriate place, and the deduction or exemption is entered under the correct provision and schedule. A payroll calculation may affect withholding during the year; it is not a legal ruling on the final return.

A practical verification sequence

  1. Identify the period. Note the payment or transaction date, financial year, and assessment or tax year on the return.
  2. Identify the taxpayer and regime. Confirm taxpayer type, residence, income category, and applicable regime.
  3. Locate the controlling law. Consult the official Act and the rules, amendments, notifications, and transition provisions effective for that period.
  4. Test each condition. Check claimant, qualifying transaction, calculation, exclusions, timing, and any form or certificate requirement.
  5. Collect supporting records. Keep the evidence relevant to that specific claim and any required identifiers or declarations.
  6. Reconcile and report. Compare evidence with Form 16, Form 26AS, AIS, and other relevant records; enter the claim and any required details in the correct return schedule.
  7. Get case-specific advice if needed. If a condition is unclear, a transition issue affects the claim, or the amount is material, ask a qualified Indian tax professional to review your facts and documents.

This process can establish what to verify, but it cannot determine an individual’s entitlement without the relevant year, taxpayer details, transaction, regime, and records.
