To apply for unemployment benefits after a layoff in the United States, file a claim promptly with the unemployment agency for the state where you worked, then follow that state’s instructions for verification and ongoing weekly certifications. State law controls eligibility, deadlines, filing methods, and required steps, so use the official agency’s current guidance rather than assuming one rule applies nationwide.
Where to file after a layoff
Unemployment insurance is a joint federal-state program, but each state administers its own program and sets eligibility rules under state law. The U.S. Department of Labor advises people to file with the state where they worked and to contact the state program as soon as possible after unemployment begins. Start at the Department of Labor’s unemployment insurance page or go directly to the relevant state labor agency.

If you live in a different state from the one where you worked, or your work was in several states, contact the unemployment agency where you now live for instructions on filing across state lines. It can explain which state should handle the claim and what information it needs.
How to apply: a state-by-state process
- Check your state’s current rules. On the official state agency website, find its unemployment claim instructions, filing methods, and eligibility information. Depending on the state, you may be able to apply online, by phone, or in person. There is no universal filing deadline or application method.
- Gather your personal and work-history details. Be ready to provide identifying and contact information, employer names and addresses, and accurate dates for past employment. Use the state’s checklist for its complete document and information requirements. The Department of Labor recommends giving complete, correct answers; missing or inaccurate information can delay processing. See its application guidance.
- Submit the initial claim and save the instructions. Complete the state application carefully, keep any confirmation details, and read the agency’s messages. Respond to requests for identity verification, documents, or additional fact-finding. These requirements differ by state; the Department of Labor’s state UI resources provide a route to state program information.
- Continue certifying for each period you claim. Filing the initial application does not automatically certify every later week. Complete each required certification on your state’s schedule if you are seeking benefits for that period.
What a layoff means for eligibility
A layoff commonly reflects a lack of available work, which is consistent with the Department of Labor’s general criterion that unemployment be through no fault of your own. But being laid off does not by itself establish eligibility. The state agency also applies its wage and work-history requirements and any other tests under state law.

As a general pattern, the Department of Labor says most states use a base period that is usually the first four of the last five completed calendar quarters before a person files. This is not a universal rule, and your state’s agency determines how your work history is evaluated. Check the state’s eligibility guidance before relying on a general description.
How to complete ongoing certifications accurately
Weekly certification questions may ask about work-search activity, wages or other income, and whether you were able and available to work. Questions and schedules vary by state. Answer for the specific week being claimed, report information accurately, and follow your agency’s instructions if a question is unclear. The Department of Labor’s weekly-certification guidance emphasizes accurate reporting of work-search activities, wages earned, income received, and ability and availability for work.

Do not assume the same job-search rules or certification day apply in every state. A missed or inaccurate certification can delay or affect benefits; contact the state agency promptly if you realize an answer was wrong or you miss a required step.

When to expect a first payment
The Department of Labor says a first benefit check generally takes two to three weeks after a claim is filed. That is a general estimate, not a guaranteed payment date; the page does not state a publication year for the estimate. Verification requests, fact-finding, or other state-specific processing can affect an individual claim.
