The Income Tax Appellate Tribunal (ITAT) reviews eligible direct-tax appeals after the first appellate stage; it is not the first stop for a disputed assessment or a routine refund-status problem. If the Tribunal changes the underlying tax determination, that decision may affect a refund, but a refund is not automatic. The applicable law and filing process depend on the tax year, the proceeding’s status, and the order being challenged—especially because the Income Tax Act, 2025 took effect on 1 April 2026 while many earlier matters remain governed by the 1961 Act.

Where ITAT fits in a tax dispute

The ordinary direct-tax appeal route in India is Assessing Officer → Joint Commissioner of Income Tax (Appeals) or Commissioner of Income Tax (Appeals) → ITAT → High Court → Supreme Court. The Income Tax Department says the 2025 Act did not structurally change this sequence. ITAT is therefore the second appellate tier in the ordinary route, not a substitute for the first appeal.

The Tribunal is a quasi-judicial body. Its decisions are generally final within the tribunal hierarchy, but a further appeal may lie to a High Court when a substantial question of law arises. A taxpayer cannot assume that every disagreement, factual or otherwise, qualifies for a High Court appeal; the appropriate route depends on the nature of the issue and applicable law.

For a reader concerned about a refund, the key question is what decision produced the refund amount—or the reduction, denial, or tax demand—and where that decision sits in the appeal sequence. A refund dispute can be part of a wider challenge to an assessment or appellate order. Merely waiting for a payment, finding a bank-validation problem, or checking a processing status is a different kind of problem.

First identify which Income Tax Act governs

The Income Tax Act, 2025 came into operation on 1 April 2026. That date is important, but it is not a date-only test for deciding which Act applies to a particular appeal. The Department’s transition guidance says that pending proceedings and proceedings concerning tax years beginning before 1 April 2026 continue under the repealed Income Tax Act, 1961. A particular matter must still be checked against the transition provision and its facts.

This matters because section numbers, forms, and procedures cited for one Act should not automatically be applied to a matter governed by the other. Before relying on an appeal form or a statutory section, establish the tax year, whether the proceeding was pending at the transition, the type and date of the order, and the stage the matter has reached. If any of those facts are unclear, confirm the governing track before preparing a filing.

Use the transition as a case-specific check

  • Tax year: establish which year or years the disputed tax determination concerns and when those tax years began.
  • Procedural status: determine whether a proceeding was already pending when the new Act took effect.
  • Order and appeal stage: identify the decision being challenged and whether the matter is still before the Assessing Officer, has gone through the first appeal, or is at ITAT.
  • Applicable provision: verify the transition rule and the governing Act before naming a section, form, or deadline.

This check prevents a common mistake: treating every filing made after 1 April 2026 as a new-Act case, or assuming that every older tax matter must use the same procedure without checking its status.

What an ITAT decision can mean for tax relief

At a high level, the Department describes appellate powers under the 2025 Act as including confirming, reducing, enhancing, or annulling an assessment; admitting additional grounds; calling for a remand report; rectifying mistakes; and granting a stay subject to conditions. This describes the appellate framework generally. It does not mean every listed power applies identically in every ITAT proceeding, that a party will obtain the particular relief it requests, or that the Tribunal automatically orders a refund whenever a taxpayer appeals.

For proceedings under the 1961 Act, an ITAT Patna Bench order reproduces section 254(1), under which the Tribunal may, after giving both parties an opportunity to be heard, pass such orders on the appeal as it thinks fit. The same order reproduces section 254(2), concerning rectification of mistakes apparent from the record. It also describes a notice safeguard where a proposed amendment would enhance an assessment, reduce a refund, or otherwise increase the assessee’s liability. The order is reproducing statutory text; it is not a substitute for checking the official legislation that applies to a specific case.

In practice, a request for relief has to be considered in the context of the challenged order, the grounds raised, the evidence in the record, the governing law, and the Tribunal’s eventual decision. A change to the underlying tax determination can have a consequential effect on the amount payable or refundable. The precise result—including the treatment of interest—cannot be inferred from the fact that an appeal was filed; it depends on the applicable provisions and the case record.

How a tax appeal can affect a refund

The Income Tax Department’s refund-status manual defines a refund as an amount initiated when tax paid exceeds the actual tax due. The tax payments that may contribute to an excess include tax deducted at source (TDS), tax collected at source (TCS), advance tax, and self-assessment tax.

An assessment or appellate decision can affect the calculation of tax due and, consequently, whether a refund is payable. If an appeal changes the underlying determination, that change may lead to a refund consequence or alter an amount previously treated as refundable. The specific effect follows from the decision and applicable provisions; ITAT does not grant every requested refund automatically, and no single refund outcome follows from a particular type of appeal in every case.

Separate a challenge to a tax decision from a payment problem

Start by asking whether the complaint is about the correctness of an order or about the administration of a refund that has already been determined. A challenge to a tax determination may belong in the appeal process, subject to the proper stage and law. A delay, failed credit, bank-account validation issue, or request to reissue payment is not, on its own, established as an ITAT appeal. Those matters should first be distinguished from the underlying tax decision rather than treated as interchangeable.

This distinction can save a taxpayer from pursuing the wrong route. If the amount was reduced because of an assessment or appellate determination, identify and assess that order. If the tax decision is not in dispute but the payment has not reached the account, the issue may instead concern refund administration. The available official refund manual explains what a refund represents and the types of tax payments that can produce one; it does not establish that ITAT handles every delayed or uncredited payment.

Which forms apply to an ITAT filing in 2026?

The notified Income-tax Rules, 2026 prescribe Form 115 for an appeal under section 362 of the Income Tax Act, 2025. Form 116 is for a memorandum of cross-objections under section 362(4). These are new-Act references. They should not be carried over to a proceeding governed by the 1961 Act without first checking the applicable statute and rules.

A cross-objection is not simply another name for the appellant’s appeal. The rules identify Form 116 for a memorandum of cross-objections in the specified new-Act context. Whether a party should appeal or file cross-objections, and what requirements apply, depend on the party’s procedural position and the governing provisions.

The existence of these forms does not by itself establish a complete filing checklist. The available information does not establish a universal current ITAT limitation period, filing fee, attachment list, defect-cure period, or hearing procedure. Those details must be confirmed from the applicable legislation, rules, and current Tribunal directions for the specific appeal rather than guessed or copied from a different legal track.

Use ITAT’s filing and case-information tools carefully

ITAT provides an e-filing portal, case-status functions, and a judicial order-search facility. The e-filing dashboard can show filing details, defects, documents, and petitions. The judicial portal offers searches by appeal number and order date. These facilities help parties follow a proceeding and find orders, but the available information does not establish that checking a portal replaces compliance with a filing requirement or a formal direction in a case.

  1. Confirm the case identity. Record the tax year, the order under challenge, the parties, and the appeal stage before searching or filing.
  2. Determine the governing Act. Apply the transition provisions to the tax year and procedural status; do not select a form solely because a filing occurs in 2026.
  3. Read the current directions. ITAT’s “What’s New” page listed a Practice Note dated 30 September 2026 for e-filing appeals, uploaded on 7 October 2026. Read the actual note and the applicable rules for the filing in question; the listing alone does not disclose its substantive requirements.
  4. Check the portal’s case information. Use the e-filing dashboard for available filing details and defects, and the judicial portal to search for orders when you have suitable case identifiers.
  5. Verify operational requirements. Confirm the current deadline, fee, required documents, method of curing any defect, and hearing arrangements from authoritative current materials before acting. These details are not established by the notice listing alone.

What the Tribunal considers—and what a reader should prepare to establish

The result depends on the particular order and appeal, not just the fact that a refund is at stake. A taxpayer evaluating a case should be able to explain what decision is being challenged, which parts of it are disputed, and how the requested relief relates to the tax determination. The evidence and grounds in the matter, the governing Act, and the Tribunal’s order all matter to the outcome.

The Department’s description of appellate powers also points to procedural possibilities such as additional grounds and a remand report. These are not guarantees that new material will be accepted or that a matter will be sent back; they are powers described at a high level. A party should not assume that a particular request will be entertained in the same way in every proceeding.

Where the 1961 Act governs, section 254(2), as reproduced in the Patna Bench order, concerns rectification of mistakes apparent from the record. Rectification is distinct from treating a refund-status or bank-credit problem as a new appeal. The order also notes notice protection where a proposed rectification would worsen the assessee’s position in specified ways. For exact application, consult the official text and the order relevant to the case.

What happens after ITAT

ITAT is generally the final stage within the tribunal hierarchy, not necessarily the final possible judicial stage. The ordinary route continues to a High Court where a substantial question of law arises, and then may proceed to the Supreme Court. The question of whether further appeal is available is separate from whether the taxpayer agrees with the ITAT outcome; the stated route is conditional, not an automatic second review of every factual disagreement.

A favorable ITAT result may affect the assessment and any consequential refund, but the actual financial consequence follows from the order and the applicable law. The available sources do not establish a universal formula or time frame for the resulting payment, interest, or implementation. Readers should distinguish the legal result in the appeal from subsequent administration of any amount due.

A practical decision path for a refund-related dispute

  1. Find the source of the problem. Is the amount disputed because of a tax order, or is an expected payment delayed, uncredited, or affected by bank details?
  2. Identify the operative order. For a merits dispute, determine which assessment or appellate decision caused the reduction, demand, or refusal and whether the first appeal stage has been completed.
  3. Map the timeline. Establish the relevant tax year and whether the proceeding was pending or otherwise covered by the transition when the 2025 Act took effect on 1 April 2026.
  4. Use the right legal track. Confirm whether the 1961 Act or 2025 Act governs, then verify the section, form, deadline, and supporting requirements from current authoritative materials.
  5. Assess the requested relief against the record. Explain how the challenged determination should change and what consequence that change may have for tax payable or refundable. Do not assume that a refund request is decided separately from the underlying order.
  6. Follow the case through official channels. Use ITAT’s available e-filing and case-information tools, and read current practice directions rather than relying on an old checklist.

For a case-specific conclusion, the decisive details are the tax year, order type, procedural stage, transition status, and actual relief sought. Because filing mechanics can vary with the governing law and current directions, a taxpayer facing a live deadline or consequential refund question may need advice from a qualified Indian tax professional familiar with the applicable track.
