How Much Does It Cost to Break a Lease? Costs, Fees, and Tenant Rights

Breaking a lease has no universal price. Your costs depend on the lease, local law, notice, reason for leaving, and how quickly the home is re-rented.

There is no single U.S. price for breaking a lease. Depending on your lease, location, reason for leaving, notice, and whether the home is re-rented, you may owe an agreed buyout, rent for some or all of a vacancy, permitted reletting costs, and other accrued charges. A legal right to terminate early can change what you owe.

What costs can you owe when you break a lease?

Your total depends on the lease and law where the rental is located. Common cost categories include:

  • An early-termination fee or buyout: If your signed lease offers an early-exit option, check its amount, notice requirements, and other conditions.
  • Rent while the unit is vacant: Depending on local law and the lease, rent may remain due until the lease ends or a replacement tenant takes possession.
  • Reletting expenses: Where allowed, a landlord may charge reasonable costs associated with preparing and re-renting the unit. Whether a particular charge is valid depends on applicable law and the facts.
  • Other amounts already owed: Unpaid rent, contractually owed charges, and damage beyond ordinary wear may be part of the final accounting. These are distinct from a lease-break fee.

Do not assume that a buyout and continuing rent are automatically added together. The lease option you select and local law determine whether they can both apply.

How to estimate your lease-break cost

Use this as a way to organize the possible charges, not as a universal legal formula:

Possible total = applicable buyout or fee + rent or other liability allowed for the relevant period + permitted, supported reletting costs and accrued charges − credits or refunds required by the lease or law.

To get a useful estimate, gather your state and city, signed lease and addenda, monthly rent, planned move-out date, notice already given, reason for leaving, any early-termination option you plan to use, and whether and when a replacement tenant starts a new tenancy. Without those details, no one can calculate a reliable individual total.

Do you have to pay rent after you move out?

Moving out does not necessarily end your rent obligation. The lease and local law determine when liability ends, and a replacement tenant’s start date may matter where the landlord must mitigate losses by trying to re-rent the home.

Texas example

The Texas State Law Library’s guidance on ending a lease says that, in the ordinary early-move-out situation it describes, a tenant without a statutory early-termination right generally owes rent until the lease ends or a new tenant is found. It also describes the landlord’s duty to try to find a suitable replacement. This is Texas guidance, not a nationwide rule.

Can a landlord charge a lease-break fee?

Possibly, if the lease and applicable law allow it. Start with the signed agreement: look for an early-termination, buyout, or liquidated-damages clause, and read its conditions carefully. Do not assume that a fee written into the lease is valid in every situation or jurisdiction.

Florida example: a conditional statutory option

Florida’s 2026 statute on landlord remedies when a tenant abandons a dwelling unit describes an option for a tenant to elect an agreed early-termination fee or liquidated damages, subject to statutory requirements. Under that option, the amount is capped at two months’ rent, and an early-termination fee is subject to a notice condition of no more than 60 days. The cap and notice condition apply only when the statute’s requirements are met; they are not a national fee limit.

Reletting costs should not be treated as automatic penalties

In its Texas guidance, the Texas State Law Library quotes the Tenants’ Rights Handbook published by the Texas Young Lawyers Association and the State Bar: “The reletting fee must be a fair amount to cover actual expenses and cannot be unfairly inflated (you cannot be “penalized” for breaking a lease).” That statement is specific to the Texas context; rules elsewhere may differ.

Will you lose your security deposit?

Not automatically. A deposit is generally handled through the final accounting under the law where the property is located. Depending on local rules and the circumstances, some unpaid rent or other permitted deductions may affect the amount returned.

The Berkeley Rent Board’s guidance for Berkeley, California notes that in some lease-breaking situations a deposit and possible unpaid rent are at stake, and describes potential rent claims for the rest of the lease or until re-rental. This is local guidance and should not be read as the rule for every California rental or every U.S. lease.

Could you have a legal right to end the lease early?

Some statutes allow early termination in defined circumstances. Texas guidance identifies certain family-violence and military-related situations. Other jurisdictions may recognize different circumstances and impose specific deadlines, notice, or documentation requirements. Check the law for the place where the rental is located before relying on an exception; qualifying for a right and following its process both matter.

Which path should you compare?

If your lease offers a buyout, compare it with the ordinary early-move-out rules that apply where you live. Check the actual financial and timing terms rather than assuming one route is always cheaper.

Re-rental Whether rent also remains due depends on the option’s terms and governing law. Where mitigation rules apply, the landlord’s efforts and the replacement tenant’s start date can affect rent exposure.
Legal limits A fee cap or statutory option may apply only in a particular jurisdiction and under specified conditions. Local law determines applicable duties, charges, and possible defenses or rights.

Where to check the rules

Lease-breaking rules are location-specific. The Texas State Law Library provides a Texas overview, Florida’s statute states Florida rules, and the Berkeley Rent Board explains local guidance for Berkeley. For your own situation, read the lease and check official tenant resources for the state and city where the unit is located. If a disputed bill is substantial or a deadline is close, a local tenant legal-aid organization or landlord-tenant lawyer can assess the lease and applicable law.
