But a September 18, 2026 White House proclamation restricts entry for certain H-1B specialty-occupation workers, and returning may involve separate petition, visa-screening and border-admission decisions. Whether a particular trip is risky depends on the worker’s petition, travel dates, visa stamp and circumstances.
What the proclamation restricts—and what it does not
On September 18, 2026, President Donald J. Trump signed Proclamation 11069, extending for 12 months a restriction first imposed by Proclamation 10973. The extension takes effect September 21, 2026, and is stated to run through September 21, 2027. It concerns entry into the United States, not a general prohibition on current H-1B holders departing.
The proclamation says entry for certain H-1B specialty-occupation workers is restricted unless their petitions are accompanied or supplemented by a $100,000 payment, subject to limited discretionary national-interest exceptions. It directs the Department of Homeland Security to restrict decisions on unpaid petitions for workers who are outside the United States and tells the State Department to verify payment during visa processing. It also addresses people who enter or attempt to enter after the effective date and people who must seek admission to effectuate petition approval. The exact effect on an individual depends on the petition, timing, location and any applicable exception.
“The entry into the United States of aliens as nonimmigrants to perform services in a specialty occupation under section 101(a)(15)(H)(i)(b) of the INA (8 U.S.C. 1101(a)(15)(H)(i)(b)), is restricted, except for those aliens whose petitions are accompanied or supplemented by a payment of $100,000”.

That is the proclamation’s wording; it should not be read as proof that every current H-1B worker must pay $100,000 to travel. The proclamation describes a payment tied to covered petitions and provides for limited discretionary exceptions. A worker should establish whether the specific petition and situation fall within its terms before making plans.
Why returning can involve more than one decision
A visa stamp lets you seek admission; it does not guarantee it
A visa is used to travel to a U.S. port of entry and request admission. The Department of State says, “A visa also allows you to request permission to enter the United States. A visa does not guarantee entry into the United States.” A Customs and Border Protection officer decides whether to admit the traveler at the port. Visa issuance, petition status and the admission decision are distinct steps.

New visa applications involve screening and possible delay
Department of State guidance updated December 3, 2025, says online-presence review applies to H-1B visa applicants and H-4 dependents and instructs applicants to set social media profiles to public. This is consular screening guidance; it does not by itself mean an applicant will be denied a visa or is barred from traveling.
Some visa applications may undergo administrative processing. If you need a new visa stamp, that process can affect when you can return, so avoid assuming that an interview or visa issuance will happen by a particular date.

Check these factors before booking international travel

Documents and steps for a return trip
- Review your visa and petition details. Determine whether you have a valid visa stamp, whether you will need a new one, and whether your petition or travel timing may bring the proclamation into play.
- Check the correct consular post. If a new visa is required, confirm interview availability and current processing guidance with the relevant embassy or consulate. Department of State guidance generally points applicants to a post in their country of nationality or residence, subject to the stated designated-post situation.
- Prepare the listed travel documents. The State Department’s Temporary Worker Visas guidance identifies a passport, DS-160 confirmation, fee receipt if required, and the I-129 petition receipt number or I-797 notice. An officer may request additional documentation.
- Plan for screening and admission separately. Follow the State Department’s online-presence instructions if applying for an H-1B or H-4 visa, and remember that a visa does not guarantee admission at the border.
These are general process points, not a determination that a specific traveler qualifies for entry. A case-specific review should use the traveler’s petition and visa facts.
What the proclamation’s reported figures do—and do not—show
The White House proclamation reports that more than 700 petitions had made the $100,000 payment. It also says large IT staffing and outsourcing firms reduced combined H-1B registrations from 24,946 to 2,055, a 92 percent decrease. The proclamation reports that beneficiaries with at least a U.S. master’s degree represented 45.1 percent of FY 2026 registrants and 66.1 percent of FY 2027 registrants; it says job offers corresponding to the two highest wage levels represented approximately 46.3 percent of FY 2027 selections, compared with 17.8 percent at the lowest wage level.

These are figures presented by the White House in support of its policy account. They are not, by themselves, an independent evaluation of the proclamation’s effects or evidence that a particular worker’s trip will be affected.
