To cancel a GST registration in India, an eligible taxpayer generally applies online in FORM GST REG-16, clears the required returns and dues, and tracks the application using its ARN. The 57th GST Council recommended phased automatic processing and other changes, but the cited official material does not establish that those proposals have taken effect. The steps and proposals below reflect a PIB FAQ posted 9 October 2026 and the Council’s 8 October 2026 release.

When can you apply to cancel GST registration?

The Government of India’s GST cancellation FAQ lists these grounds for a taxpayer-initiated application:

  • You have completely discontinued or closed the business, or transferred the whole business.
  • The business’s constitution has changed in a way that results in a new PAN.
  • The business has amalgamated, demerged or been disposed of.
  • You are no longer liable to be registered under GST.

The FAQ says to apply within 30 days of the event that warrants cancellation. It states that no such deadline applies in the case of the death of a sole proprietor. Because circumstances can affect the applicable legal route, check the operative rules and portal instructions if your case is unusual.

How do you submit an application?

The PIB FAQ directs applicants to the GST Portal. Complete the form with the reason for cancellation, requested effective date, closing-stock details and associated tax liabilities. Verify the filing using DSC or EVC; the portal generates an ARN that you can use to track the application.

  1. Log in to the GST Portal and go to Services > Registration > Application for Cancellation of Registration (FORM GST REG-16).
  2. Enter the cancellation reason and requested date, and provide the closing-stock and liability details requested in the form.
  3. Verify and submit using DSC or EVC.
  4. Keep the generated ARN and use the portal to track the application.

Returns and dues to address before filing

According to the FAQ, automatic acceptance requires all returns due on or before the application date to be filed and any due tax, interest or penalty not stayed by a court, Tribunal or Appellate Authority to be paid. If you furnished GSTR-1 or IFF outward-supply details for a period, the FAQ says you must file GSTR-3B for that period before applying.

What automatic processing did the 57th Council recommend?

The 57th GST Council’s 8 October 2026 release describes proposed amendments to the CGST Act and Rules. It recommends a two-phase approach to automatic acceptance of cancellation applications, subject to filing pending returns and paying dues. The ₹2.5 lakh monthly ITC figure distinguishes the proposed Phase 1 categories; it is not a general limit on eligibility to cancel registration.

Phase Who would qualify Proposed handling
Phase 1 Applicants who have not passed on ITC exceeding ₹2.5 lakh in any month since registration; and applicants who exceeded that amount in a month but filed GSTR-10 within the specified time. Automatic acceptance after pending returns are filed and dues are paid. The PIB FAQ says the first category would receive system acceptance through FORM GST REG-38. It describes the second category’s Phase 1 process as involving GSTR-10.
Phase 2 All applicants, once the specified return and payment conditions are met. Automatic acceptance for all applications; the Council also recommended amending REG-16 to capture GSTR-10 details directly.

These are recommendations, not confirmation of a live process. The cited Council release and FAQ do not establish a commencement date, notification number or actual portal rollout. Check later Gazette notifications, CBIC rule amendments and GST Portal advisories before relying on either phase.

How do taxpayer applications differ from officer or system action?

A taxpayer-initiated REG-16 application is distinct from cancellation initiated by an officer or by a system process. The trigger, form and applicable deadlines may differ; do not assume that a proposal for one route changes the rules for another.

Proposed changes to officer-initiated cancellation grounds

The FAQ says the Council recommended omitting four grounds from Rule 21:

  • Taking input tax credit contrary to Section 16 or related rules.
  • Violating Section 171.
  • Violating Rule 86B.
  • Reporting outward supplies in GSTR-1 or GSTR-1A for one or more periods in excess of those declared in GSTR-3B.

The Council release describes amendments it recommended; these sources do not establish that Rule 21 has already been amended.

Suspension and revocation are separate issues

The PIB FAQ describes a proposed system-cancellation and revocation route for specified non-compliance, including six consecutive months without filing returns or failure to furnish bank-account details required under Rule 10A. It says that, after curing defaults, a taxpayer would apply for system-based revocation in FORM GST REG-21 within 180 days. Treat this as the FAQ’s description of a proposal, not as proof that the route is currently in force.

A separate excerpt of CBIC Rule 23 describes an existing officer-cancellation revocation route: apply in REG-21 within 90 days of service of the cancellation order, subject to a possible extension. If non-filing led to cancellation, the excerpt requires the relevant returns and payments. The 90-day period and the FAQ’s proposed 180-day period refer to different routes and should not be combined. Verify the current consolidated rule before acting.

An excerpt of CBIC Rule 21A states that when a taxpayer applies for cancellation, registration is deemed suspended from the application date or requested cancellation date, whichever is later, while proceedings are pending. It also addresses suspension in officer-initiated situations and restrictions during suspension. Confirm the current consolidated text for case-specific use.

What should you verify before relying on a Council proposal?

A Council recommendation is not, by itself, evidence that an amendment is operative. For the phase, eligibility, form or deadline relevant to your case, check for a subsequent notification, the current consolidated CGST Rules and an applicable GST Portal advisory. In particular, do not assume that the proposed automatic acceptance or 180-day revocation process is available merely because it appears in the October 2026 FAQ.
