The practical impact will fall first on automakers, suppliers, software developers, and manufacturers planning future vehicles. The key deadlines are Model Year 2027 for covered software and certain manufacturers’ vehicle sales, and Model Year 2030 for covered Vehicle Connectivity System hardware.

The short version
- Software restrictions: Begin with Model Year 2027 vehicles.
- Covered-manufacturer restrictions: Begin with Model Year 2027 vehicles, including certain vehicles built in the United States.
- VCS hardware restrictions: Generally begin with Model Year 2030 vehicles. Hardware without a model year faces a January 1, 2029 deadline.
- Initial scope: Passenger vehicles under 10,001 pounds.
- What is not banned: The rule does not automatically prohibit every connected car, autonomous-driving feature, Chinese-made component, or existing vehicle.

What Biden actually proposed—and what became law
The policy developed in stages:

Therefore, “Biden’s proposed smart-car ban” is accurate only when describing the September 2024 proposal. In current coverage, the more precise description is the Biden-era connected-vehicle rule or the Commerce Department connected-vehicle rule.

The final Federal Register rule is the primary source for the legal definitions, prohibitions, and examples.
Why Washington treats connected cars as a national-security issue
Commerce says modern vehicles can collect and transmit substantial information about drivers, owners, passengers, roads, and vehicle use. Because vehicles communicate with external networks and may increasingly control important driving functions, the department says foreign-adversary-linked technology could create several risks:
- Access to sensitive information about individuals and their movements.
- Collection of information about roads, facilities, and critical infrastructure.
- Remote interference with vehicle systems.
- Supply-chain vulnerabilities in software-defined vehicles.
These are the government’s stated risk assessments and policy rationales. They are not a finding that every affected automaker has spied on American drivers or that every vehicle using a covered technology is unsafe. Commerce’s explanation appears in its final-rule announcement.

Vehicle Connectivity System hardware
Vehicle Connectivity System, or VCS, hardware is equipment that enables a vehicle to communicate externally. Examples identified by Commerce include:
- Telematics control units.
- Cellular modules.
- Bluetooth modules.
- Wi-Fi modules.
- Satellite communications modules.
This is not a ban on every electronic component in a vehicle. Batteries, displays, sensors, semiconductors, and infotainment parts are not automatically prohibited merely because they were manufactured in China. The analysis turns on whether the item is covered VCS hardware and whether the relevant foreign nexus and transaction are present.
VCS software
Software that controls or enables covered external connectivity can also fall within the rule. That means a vehicle does not need to be autonomous to raise a compliance issue. A connected vehicle with China- or Russia-linked software may be covered even if it has no self-driving capability.
Automated Driving System software
Automated Driving System, or ADS, software is software integrated into a system that enables highly autonomous vehicle operation without a driver. The rule does not ban all driver-assistance technology. Cameras, radar, machine learning, adaptive cruise control, lane assistance, and similar features are not automatically prohibited simply because they use sophisticated software.

The relevant questions are whether the software falls within the rule’s ADS definition and whether it has the required China or Russia connection. The same distinction applies to connected-vehicle software: the rule targets specified systems and relationships, not the broad concept of a “smart car.”
Why a vehicle built in the United States can still be affected
Final assembly location is only one part of the analysis. A U.S.-built vehicle may still require review if:
- A covered connectivity module was supplied by a China- or Russia-linked entity.
- Covered software was designed or developed by a relevant foreign entity.
- A supplier remains responsible for software maintenance or servicing.
- Licensing agreements or contractual rights create a continuing relationship.
- The connected-vehicle manufacturer itself has the required nexus to China or Russia.
In other words, the important question is not only “Where was the vehicle assembled?” It is also “Who designed, supplied, controlled, licensed, maintained, or serviced the relevant technology?”
The final rule’s examples contemplate issues involving foreign software-development teams, subsidiaries, licensing arrangements, servicing obligations, and joint ventures. Companies must therefore examine corporate and contractual relationships—not merely the country printed on a component’s packaging. See the final rule for those examples.
Which automakers and suppliers face the greatest exposure?
The highest-risk categories include:
- Chinese or Russian vehicle manufacturers seeking access to the U.S. market.
- Global automakers using covered China- or Russia-linked connectivity or autonomous-driving software.
- U.S. manufacturers whose vehicles incorporate covered hardware or proprietary software from a relevant entity.
- Suppliers with engineering, licensing, maintenance, or servicing relationships that create a continuing foreign nexus.
It would be misleading to publish a blanket list of affected automakers or models without examining each vehicle’s technology and corporate arrangements. A company’s country of incorporation does not necessarily determine whether every vehicle or component it sells is prohibited.
Similarly, a Chinese battery is not automatically covered VCS hardware, and a vehicle assembled in Mexico or the United States is not automatically exempt. Model-specific conclusions require a review of the relevant systems, parties, dates, and authorizations.
What the deadlines mean
Model Year 2027: software and covered manufacturers
Beginning with Model Year 2027, the rule restricts the import or sale of connected vehicles containing covered VCS or ADS software linked to China or Russia.

It also restricts sales of new connected vehicles by connected-vehicle manufacturers with a sufficient China or Russia nexus, even when those vehicles are manufactured in the United States. This manufacturer-based restriction is why American assembly alone does not resolve every compliance issue.
Model Year 2030: VCS hardware
The main restriction on importing covered VCS hardware begins with Model Year 2030 vehicles. Covered hardware without a model year faces a January 1, 2029 deadline.
The staggered schedule gives manufacturers more time to redesign physical systems, but software-related compliance arrives earlier. In practice, software provenance, licensing, servicing, and development relationships may become the first bottleneck.
Vehicle scope
The final rule initially applies to passenger vehicles under 10,001 pounds. Commerce said commercial vehicles, including trucks and buses, would require separate rulemaking because of the complexity of their supply chains. The passenger-vehicle deadlines should not automatically be applied to every commercial vehicle.
What automakers must do
The rule turns sourcing and software architecture into regulatory-compliance matters. Automakers and suppliers may need to:
- Map the technology: Identify every VCS hardware item and relevant VCS or ADS software component in each vehicle platform.
- Trace provenance: Record who designed, developed, manufactured, supplied, licensed, maintained, and serviced each covered system.
- Review corporate relationships: Examine ownership, control, jurisdiction, subsidiaries, joint ventures, and contractual rights.
- Redesign where necessary: Replace or isolate covered technology before the applicable model-year deadline.
- Revalidate the vehicle: Requalify cybersecurity, safety, telecommunications, and software systems after a supplier or architecture change.
- Improve records: Maintain model-level and, where required, vehicle-series documentation supporting compliance.
- File required declarations: Applicable importers and manufacturers may need annual Declarations of Conformity.
- Seek guidance or authorization: Use BIS processes when a transaction is uncertain or otherwise restricted.
BIS administers these filings and requests through its Compliance Application and Reporting System (CARS). The system supports Specific Authorization applications, Declarations of Conformity, advisory-opinion requests, and Approved Supplier Applications.
Expected effects on automakers, suppliers, and consumers
Supply-chain redesign
Manufacturers may need to replace China- or Russia-linked connectivity modules, software, engineering services, or maintenance arrangements. Hardware redesign can require new telecommunications certifications, cybersecurity testing, vehicle integration work, and production requalification.

Higher compliance and engineering costs
Likely cost pressures include supplier requalification, software rewriting or porting, contract changes, duplicate regional architectures, additional documentation, and expanded supplier audits. The rule does not establish a single industry-wide dollar cost, so claims about a specific price increase would be speculative.
Less supplier flexibility
A supplier outside China or Russia may still need careful examination if its covered technology was developed, supplied, or maintained by an entity subject to Chinese or Russian jurisdiction or direction. That can reduce the number of suppliers available for inexpensive connectivity systems.
Potential effects on competition
The rule may protect U.S. and allied suppliers from direct competition with China-linked vehicle technology. It may also raise costs, slow feature launches, reduce access to lower-cost components, and make it harder to use one global vehicle-software platform.
The Government Accountability Office reported that Commerce recognized possible effects on connected-vehicle supply chains and the ability of U.S. automakers to compete internationally. That is a report of Commerce’s analysis, not an independently measured estimate of the eventual economic impact. See the GAO report.
Limited immediate effect on most drivers
For most American buyers, the immediate impact is likely to be indirect. At the time of the proposal, Chinese-owned vehicle brands had limited direct access to the U.S. market because of existing trade barriers and tariffs. The rule is principally a preventive supply-chain measure, not a consumer-facing order to stop using existing connected vehicles.
Consumers could eventually see fewer China-linked vehicle options, higher costs for some connectivity systems, changes to autonomous-driving features, or longer development timelines. That does not mean ordinary drivers will suddenly lose connected services or be required to scrap their cars.

The rule is broad, but it is not an automatic prohibition in every circumstance. BIS provides several mechanisms for transactions that qualify:

- General Authorizations: Apply to specified lower-risk transactions and limited use cases if all conditions are met.
- Specific Authorizations: Companies can ask BIS for permission to conduct an otherwise prohibited transaction.
- Advisory opinions: Parties can ask BIS whether a planned transaction falls within the rule.
- Approved Supplier Registry: Eligible suppliers may seek inclusion for covered hardware or software under General Authorization No. 3.
- Temporary-import and limited-use authorizations: BIS has listed active authorizations and amendments for particular circumstances.
These are not automatic exemptions. A company must satisfy the applicable conditions, and a company seeking a Specific Authorization must receive BIS approval before conducting the otherwise prohibited transaction. How this differs from TikTok
The comparison with TikTok is understandable but incomplete.
The similarity: Both policy debates involve potential access to Americans’ data and concerns about companies subject to foreign-government influence. Both rely on national-security authorities rather than ordinary consumer-protection rules.
The difference: TikTok concerns a social-media platform, its ownership and data practices, and the influence of its recommendation algorithm. The connected-vehicle rule regulates specified hardware, software, embedded systems, and transactions in physical vehicles.
TikTok restrictions are framed around access to an app and platform. The vehicle rule operates through supply-chain controls, model-year deadlines, manufacturer tests, declarations, and authorizations. It can affect a vehicle made in the United States if its manufacturer or covered technology has the relevant China or Russia nexus.
What the rule does not do
It does not automatically:
- Ban every “smart car” or connected vehicle.
- Ban every Chinese-made part.
- Ban every electric vehicle.
- Ban all autonomous-driving or driver-assistance features.
- Require current owners to stop driving or scrap their vehicles.
- Disable every existing vehicle with a China-linked component.
- Make every vehicle assembled in China illegal in the United States.
- Apply the passenger-vehicle deadlines automatically to all trucks and buses.
The focus is on specified future imports, sales, and technology transactions involving covered VCS hardware, VCS software, ADS software, and manufacturers or entities with the required foreign nexus.
A practical checklist for analyzing a vehicle or supplier
- Is the vehicle a passenger vehicle under 10,001 pounds?
- Is the transaction an import, sale, transfer, software transaction, or hardware import?
- Is the vehicle connected under the rule’s definitions?
- Does it contain covered VCS hardware or VCS/ADS software?
- Who designed, developed, manufactured, or supplied the technology?
- Is any relevant entity owned by, controlled by, or subject to the jurisdiction or direction of China or Russia?
- Are there continuing licensing, maintenance, or servicing rights?
- Is the vehicle Model Year 2027 or later?
- Is the hardware Model Year 2030 or later, or is it a non-model-year unit after January 1, 2029?
- Does a General Authorization, Specific Authorization, advisory opinion, or Approved Supplier route apply?
Bottom line for U.S. automakers
The most important effect of the Biden-era rule will happen behind the showroom: supplier qualification, software provenance, contract reviews, vehicle architecture, compliance records, and decisions about which technology can be used in future U.S.-market vehicles.

This is not a blanket ban on smart cars or a retroactive order aimed at current owners. It is a targeted national-security and supply-chain rule that makes China- and Russia-linked connectivity and autonomous-driving technology a central design and sourcing issue for vehicles entering the U.S. market.
