Filing a Belated ITR for AY 2026–27: Which Losses Can You Carry Forward?

A belated ITR may be filed by 31 December 2026 unless assessment finishes earlier, but it may not preserve loss carry-forward rights that depend on a timely return.

You can file a belated income-tax return (ITR) for AY 2026–27 by 31 December 2026, or before your assessment is completed, whichever comes first. But filing late can cost you the right to carry forward certain losses: where the Income-tax Act, 1961 requires a timely loss return, a belated return generally does not qualify. The Income-tax Act, 2025 preserves eligible old losses; it does not restore losses that failed the earlier law’s filing conditions.

Is your AY 2026–27 return actually belated?

AY 2026–27 covers income earned in FY 2025–26. The applicable original filing deadline depends on your taxpayer category and any extension that applies to it. For example, on 28 September 2026, the Central Board of Direct Taxes (CBDT) extended the original return deadline for taxpayers subject to audit from 31 October to 21 November 2026. That extension is for the specified audit category, not every filer. The Press Information Bureau published the announcement at its CBDT due-date notice.

If your applicable original deadline has passed, the Income Tax Department says you may file a belated return under section 139(4) by 31 December 2026, or before completion of assessment, whichever is earlier. The Department’s AY 2026–27 return FAQ lists a section 234F late-filing fee of ₹1,000 where total income does not exceed ₹5 lakh and ₹5,000 in other cases.

Why a belated return can block loss carry-forward

Filing a return late and carrying a loss forward are separate questions. Sections 139(3) and 80 of the Income-tax Act, 1961 require a loss return to be filed by the due date under section 139(1) for losses subject to that condition. If you miss that due date, filing a belated return does not generally preserve the carry-forward claim for those losses. The Income Tax Department’s set-off and carry-forward FAQ specifically says that a loss return filed belatedly without meeting those conditions cannot be carried forward.

This is why the original deadline matters even if the belated-return window is still open: the latter may allow you to submit a return, but it does not make that return timely for loss provisions that require filing by the original due date.

How the rules differ by loss type

Losses do not all offset the same income, and their carry-forward rules are not interchangeable. The table distinguishes the old-law treatment relevant to losses determined before 1 April 2026. Timely filing is a condition where sections 139(3) and 80 apply; confirm the specific loss and any exception against the governing provision and your facts.

Loss type Income it may offset when carried forward Carry-forward period Timely loss return
House-property loss House-property income under the old section 71B framework. Not stated in the Department FAQ cited here; check the applicable provision and assessment history. The Department’s FAQ describes the old-law set-off treatment; confirm the filing condition for the specific loss.
Business loss Business income only under old section 72. Generally eight assessment years immediately following the assessment year in which the loss was first computed, subject to statutory qualifications. Sections 139(3) and 80 generally require filing by the section 139(1) due date for carry-forward.
Short-term capital loss Capital gains, subject to old section 74 restrictions. Not stated in the Department FAQ cited here; check the applicable provision and assessment history. Confirm the filing condition for the specific loss under sections 139(3) and 80.
Long-term capital loss Long-term capital gains under old section 74; it cannot be treated as a general offset against other income. Not stated in the Department FAQ cited here; check the applicable provision and assessment history. Confirm the filing condition for the specific loss under sections 139(3) and 80.

The Department’s examples clarify the categories: a house-property loss from AY 2024–25 may be adjusted against house-property income in later years, while a long-term capital loss may be set off against long-term capital gains. Its FAQ also states that a belated loss return for AY 2024–25 that failed sections 139(3) and 80 cannot be carried forward. These are old-Act examples; they do not turn a late return into a timely one.

What changes under the Income-tax Act, 2025?

The Income-tax Act, 2025 applies from 1 April 2026. AY 2026–27 and earlier years remain governed by the Income-tax Act, 1961 for filing and relevant proceedings. Section 536 of the 2025 Act preserves eligible losses determined before the transition in their original character and under the old law’s manner and limits. The Department’s loss FAQ makes clear that the transition does not revive a loss whose belated return failed the 1961 Act’s conditions. The official Income-tax Act search is the place to check statutory provisions, including the general business-loss carry-forward rule.

What to check before filing

  1. Identify the original deadline that applies to you. Use your filing category and any applicable extension; do not assume the audit-category extension applies to everyone.
  2. Separate the late-filing deadline from the loss deadline. The belated-return window runs to 31 December 2026 unless assessment is completed earlier, but that does not satisfy a timely-filing condition for a loss.
  3. Classify each loss by income head and year. House-property, business, and capital losses have different set-off rules and may have different carry-forward limits.
  4. Check the loss’s filing and assessment history. Confirm whether a return claiming the loss was filed by its applicable original due date, whether the loss was determined, and whether its carry-forward period remains open.
  5. Calculate the section 234F fee if applicable. The Income Tax Department’s AY 2026–27 FAQ lists ₹1,000 for total income up to ₹5 lakh and ₹5,000 above that threshold.

This is general information, not a determination of a particular return. The sources cited here do not establish that an updated return restores a loss carry-forward claim; do not assume it does without checking the applicable provisions and your circumstances. A belated return may also affect interest, refunds, deductions, or other tax matters not covered here.
