A U.S. farm business may be able to recover federal excise tax paid on diesel used for qualifying farm work—but only when the tax was paid, the fuel was used for an eligible purpose, and the claimant is entitled to claim it. A machine’s location on a farm, or the fact that it runs on diesel, is not enough. For 2025, the main routes are an annual credit on Form 4136 or, for eligible users with at least $750 to claim, a quarterly refund using Form 8849 and Schedule 1.
What determines whether farm diesel qualifies?
Eligibility turns on three linked questions: whether federal fuel excise tax was paid, whether the fuel was used for a qualifying farming purpose, and whether the person making the claim is entitled to recover that tax. The IRS explains these rules in Publication 225 and the Form 4136 instructions. This article covers U.S. federal rules, using 2025 tax-year materials available as of October 9, 2026; it does not cover state fuel-tax programs.
As an Amazon Associate I earn from qualifying purchases.
- Tax paid: Undyed diesel sold for highway use generally includes federal excise tax collected at sale. If it is later used for a qualifying nontaxable farm purpose, the tax may be recoverable.
- Qualifying use: The work must fall within the IRS definition of farming purposes. Merely owning farm equipment or using a vehicle on farm property does not establish eligibility.
- Right to claim: The claimant must be entitled to claim the tax on the fuel. Who purchased the fuel and who bore its cost can matter, especially when a custom operator performed the work.
There is no single universal per-gallon recovery rate that applies to every farm claimant and use. The claim depends on fuel type, tax paid, gallons used for eligible purposes, and the rules for the tax year. Do not estimate a credit by applying a generic rate to all fuel purchases.

Which farms and activities can qualify?
Farms covered by the IRS definition
IRS Publication 225 describes farming broadly. Its examples include livestock, dairy, fish, poultry, fruit, fur-bearing animals, truck farms, orchards, plantations, ranches, nurseries, ranges, and cattle feed yards. A greenhouse may count when it is used primarily to raise agricultural or horticultural commodities. For this purpose, fish farming is growing or raising fish; simply catching or harvesting fish is not the same activity.

Work that may count as farming
Fuel used in carrying on a trade or business of farming may qualify when it powers work such as:
- Cultivating soil, or raising or harvesting agricultural or horticultural commodities.
- Raising, shearing, feeding, caring for, training, or managing livestock, bees, poultry, fur-bearing animals, or wildlife.
- Operating, managing, conserving, improving, or maintaining the farm, including its tools and equipment.
- Handling, drying, packing, grading, or storing a raw commodity, when the applicable production test is met: more than half of the commodity must have been produced by the taxpayer.
- Certain tree operations that are incidental to farming.
The activity matters more than the machine name. A tractor used to cultivate a field and the same tractor used for a personal project may involve different tax treatment. Farm ATVs likewise qualify only to the extent their fuel is used for farming; separately identify any nonfarming portion.
Work and travel that do not become farming use
Fuel used off the farm does not qualify under the farm-for-farming-purpose category simply because the trip serves the business. Highway transportation of livestock, feed, crops, or equipment remains highway use. Personal lawn mowing is not farming. Nor do processing, packaging, freezing, or canning operations qualify as the listed farming purposes.

Some stationary business machines, forklifts, bulldozers, and earthmovers may instead fall under a separate off-highway business-use category if that category’s requirements are satisfied. That is not the same as claiming farm fuel used for farming, and ordinary personal or recreational off-highway use does not qualify. Classify the actual use before choosing a claim category.
How do dyed and undyed diesel differ?
Undyed diesel is generally sold with federal highway excise tax collected. If the fuel is put to qualifying nontaxable farm use, the eligible portion of that tax may be recovered through a credit or refund. The IRS’s 2025 guidance distinguishes this from dyed diesel, which is sold for nontaxable use without that federal tax being charged in the same way. Because the tax generally was not paid on dyed diesel, there ordinarily is no paid federal excise tax on that fuel to recover through this claim.
Dyed diesel must not be used for taxable highway driving. A truck that is used both on the farm and on public highways should not be fueled with dyed diesel for that mixed use. Keep fuel and use records that distinguish farm equipment from highway vehicles and separate any eligible gallons from other consumption.

| Fuel or situation | What the 2025 IRS materials establish | Practical implication |
|---|---|---|
| Undyed diesel used for qualifying farm work | A credit or refund may be available for the federal excise tax paid, subject to the use and claimant rules. | Document the gallons used for eligible farm purposes and determine the appropriate filing route. |
| Dyed diesel | Sold for nontaxable use without the tax that is ordinarily recovered on taxed fuel; it must not be used for taxable highway driving. | Do not assume a federal tax refund is available when the tax was not paid, and do not use it in a mixed-use highway truck. |
| Gasoline used on a farm for farming purposes | The IRS table allows a credit, but not a refund, for this use. | Use the credit route rather than requesting a quarterly refund for that gasoline use. |
| Aviation gasoline, kerosene, or other fuel categories | The IRS table distinguishes these fuels, but the specific treatment for each is not established here. | Check the current Form 4136 instructions and the relevant fuel-use category before filing. |
The IRS also notes that the 2025 LUST tax—$0.001 per gallon—is generally not eligible for the fuel credit or refund. As a result, a valid recovery commonly will be less than all taxes associated with the fuel purchase.

Owners, operators, and tenants of farms may qualify when the other conditions are met. A custom operator’s work does not automatically transfer the right to claim fuel tax to either the operator or the farmer. For certain qualifying work, such as soil cultivation, the farmer may be able to claim fuel used by a custom operator; special rules apply when the custom service is fertilizer or pesticide application. Who bought or bore the cost of the fuel also can affect the claimant.
Before filing, establish who paid for the fuel and who is claiming the tax. A contract, invoice, or payment record may help clarify the arrangement, but the relevant IRS rules—not the label on a service agreement—determine entitlement. If the parties’ records do not clearly show who bore the fuel cost or how many gallons were used for a qualifying activity, seek tax advice rather than have both parties claim the same tax.

Should you use Form 4136 or Form 8849?
The two routes differ in timing and minimum claim size. The annual credit is claimed with the income tax return for the year the fuel was used. The quarterly route requests a refund after a quarter closes. Do not claim the same fuel tax through both routes or through another claim that is not allowed alongside it.
| Route | Form and timing | Amount and key restriction |
|---|---|---|
| Annual credit | Form 4136 filed with the income tax return for the year of fuel use. | Available for any eligible amount; do not use it for amounts already claimed on Form 8849 or another disallowed duplicate route. |
| Quarterly refund | Form 8849 with Schedule 1, filed after the quarter or quarters included in the claim. | For 2025, the claim must be at least $750. A smaller amount may be carried into a later quarter. The 2025 Farmer’s Tax Guide says to file by the last day of the quarter following the final quarter included in the claim. |
The $750 minimum and filing deadline above are from Internal Revenue Service 2025 materials; check the current instructions for the period being claimed. A taxpayer with less than $750 to recover can generally wait and carry the amount into a later quarter, or consider the annual credit route if otherwise eligible. Gasoline used on a farm for farming purposes is credit-only under the IRS table and cannot be requested as a quarterly refund.
There is an additional coordination issue for a business that reports excise-tax liability on Form 720. The Form 4136 instructions say the claimant may have to offset that liability with credits before claiming a Form 4136 credit or a Form 8849 refund. Reconcile any Form 720 liability and credits before choosing a filing route. Never report the same fuel tax as both a credit and a refund.

How to prepare a claim without losing track of eligible gallons
- Identify the tax year and fuel. Start with the year the fuel was used, not just the date a refund is sought. Separate fuel types and determine whether federal excise tax was paid. Use the instructions for the relevant tax year.
- Classify each use. For every vehicle, machine, or equipment group, record the work performed. Mark qualifying farm use separately from highway travel, personal activity, processing, or other nonqualifying use. For mixed-use equipment, calculate only the farming portion.
- Confirm who is entitled to claim. Match purchase records and payments to the owner, operator, tenant, or custom-service arrangement. Resolve custom work and fuel-cost responsibility before assigning gallons to a claimant.
- Calculate eligible gallons and tax. Use a separate gallon count for each nontaxable use and apply the correct treatment for the fuel and tax year. Do not include the generally ineligible $0.001-per-gallon LUST tax in the recovery amount.
- Select the filing route. Use Form 4136 with the income tax return for an annual credit, or Form 8849 with Schedule 1 for an eligible quarterly refund that meets the applicable threshold. Check prior claims and any Form 720 liability to prevent duplicate or improperly coordinated claims.
- Retain supporting records. Keep the fuel and use records that support the gallons, activity, claimant, and amount. The 2025 Form 4136 instructions require retention for at least three years from the later of the return due date or the date filed.
Useful records include fuel invoices or receipts, purchase dates, supplier names and addresses, gallons bought and used, the purpose of use, a list of vehicles and equipment, and ownership evidence. A receipt showing a large diesel purchase establishes a purchase, not how many gallons were used for qualifying farming. A use log that links equipment, date, activity, and gallons gives the claim a clearer evidentiary trail.
What errors can reduce or jeopardize a claim?
- Claiming fuel solely because a vehicle is on the farm: Classify actual activity, and separate highway trips from qualifying farm use.
- Counting every gallon in a mixed-use vehicle or machine: Include only the farming portion and maintain a defensible allocation.
- Using dyed fuel on a highway trip: Dyed diesel is for nontaxable use and must not be used for taxable highway driving.
- Claiming tax that was not paid: Determine whether the federal excise tax was paid on the fuel; dyed diesel is sold for nontaxable use without that tax being charged in the same way.
- Requesting a quarterly refund below the threshold or for gasoline farm use: For 2025 the quarterly minimum is $750, and gasoline used on a farm for farming purposes is credit-only.
- Duplicate claims or unclear claimant identity: Reconcile Form 4136, Form 8849, any Form 720 liability, and custom-operator arrangements before filing.
- Weak gallon records: Keep records that connect the fuel purchase to the specific eligible use and claimant rather than relying on total fuel expenditures alone.
The IRS Fuel Tax Credit guidance warns: “An incorrect claim can result in a penalty of $5,000.” That warning makes careful classification and documentation important, particularly when a vehicle has both farm and highway use or a custom operator is involved.
How does the credit affect business income?
If the business deducted the full fuel cost, including the excise tax, as a business expense that reduced income tax, the excise tax credit or refund generally must be included in gross income. The year in which it is included depends on whether the taxpayer uses the cash or accrual accounting method. A taxpayer who claims a fuel credit should check the income-tax treatment as well as the excise-tax form, so that recovering the tax does not leave the related deduction unadjusted.

Use the current IRS instructions for the tax year of the fuel use. The applicable materials can change, and the 2025 rules cited here should not be assumed to govern a later year unchanged. Publication 225 explains the farming-purpose rules; Form 4136 instructions cover the annual credit and supporting records; and Form 8849 with Schedule 1 is the quarterly refund route. This federal overview cannot determine eligibility for a particular taxpayer or resolve state fuel-tax treatment. When the claimant, custom-service arrangement, fuel tax paid, or mixed-use gallon allocation is uncertain, consult a tax professional before filing.
