How to Appeal a Medicare Part B Income-Related Premium Surcharge

Find the right way to challenge a Medicare Part B IRMAA: correct IRS data, request a new determination after a qualifying life event, or appeal SSA’s decision.

If your Medicare Part B premium includes an income-related monthly adjustment amount (IRMAA) that seems too high, first identify why: Social Security may have used incorrect tax information, your income may have fallen after a qualifying life-changing event, or you may disagree with another part of its decision. Each reason has a different route. Correct disputed IRS income data with the IRS; ask Social Security for a new initial determination when a qualifying event lowered your income; or request reconsideration to challenge a Social Security determination. The right form, evidence and deadline depend on which issue applies.

What an IRMAA is—and what you can challenge

Medicare’s income-related monthly adjustment amount, or IRMAA, is an amount added to the standard premium for Part B and, where applicable, prescription drug coverage. Social Security (SSA) determines whether it applies using modified adjusted gross income (MAGI) and tax filing-status information received from the Internal Revenue Service (IRS). The determination ordinarily uses a tax return from an earlier year, so the income on the notice may not reflect what you earn now.

An IRMAA notice is not necessarily wrong just because your income has since dropped. The question is whether SSA used the correct tax information for its determination, whether a qualifying event allows it to consider a later income year, or whether SSA made another error. A later retirement, for example, may support a request if it meets SSA’s criteria and the income change supports a lower amount; the fact of retirement alone does not guarantee a reduction.

IRMAA is tied to a particular premium year, tax year, MAGI and filing status. Keep those details together when you compare a notice with tax records or make a request. The standard Part B premium and the income tiers change over time, so a figure for one year should not be used to evaluate another.

What may be wrong Route to consider What it addresses
SSA received incorrect MAGI or filing-status information from the IRS Ask the IRS to correct the source information; contact SSA as appropriate and provide evidence concerning the determination Disputed tax data. SSA directs beneficiaries to the IRS to correct income information it received from that source.
Your income fell after a qualifying life-changing event Request a new initial determination, commonly using Form SSA-44 A request for SSA to consider the qualifying event and more recent income information.
You disagree with SSA’s determination for another reason, or want the determination formally reviewed Request reconsideration online or with Form SSA-561-U2 An appeal of SSA’s determination.

These are distinct procedures, not interchangeable names for the same appeal. SSA policy allows a person to request a new initial determination and reconsideration at the same time. If you qualify to seek a new initial determination, you may still insist on reconsideration of the existing decision. If you are uncertain which route fits, use the instructions on your notice and ask SSA about the available options rather than assuming one request automatically replaces the other.

When a new initial determination may fit

SSA-44 is intended for a beneficiary whose income went down after a qualifying life-changing event. SSA lists events that include:

  • Marriage or divorce.
  • The death of a spouse.
  • Work stoppage or a reduction in work hours.
  • Loss of income-producing property because of a disaster or another event beyond your control.
  • Certain cessations or reorganizations of a pension plan.
  • Certain employer settlements.

The event must be one SSA recognizes, and the event and income information must support a lower determination. A decrease in income without a qualifying event may not meet the SSA-44 criteria. Likewise, a qualifying event by itself is not enough if the relevant income information does not support a lower IRMAA.

Use the income year that applies to your request

For a 2026 IRMAA determination, the SSA-44 edition dated 12-2025 identifies tax year 2024 as the usual IRS income reference, or 2023 if the 2024 return was not available. That is a year-specific example, not a permanent rule for later premium years. Check the form and your notice to confirm which premium year and income year apply in your case.

When requesting a new determination, report the income information SSA requests for the relevant period and explain the event that changed your income. Do not assume that your current monthly income can simply be substituted for the tax-year information. SSA evaluates the request under its rules and the evidence you provide.

How to request a new initial determination with SSA-44

  1. Read the IRMAA notice. Note the premium year, the income year SSA used, the filing status and MAGI shown, the reason for the determination, and the instructions for contacting SSA. Keep the notice; it helps identify whether you are asking SSA to consider a life event or disputing an existing determination.
  2. Confirm that the event fits. Compare what happened with SSA’s qualifying-event categories. Identify when it occurred and how it reduced income. If the reason is only that your tax return is wrong, address that source-data issue with the IRS rather than treating SSA-44 as a general-purpose tax correction form.
  3. Complete the current SSA-44. The form is titled “Medicare Income-Related Monthly Adjustment Amount – Life-Changing Event.” Use the edition and instructions applicable to your request; the current edition identified here is dated 12-2025. Supply the event and income details requested, and make the tax year and premium year clear.
  4. Attach supporting documents. Include evidence of the qualifying event and the related income reduction. Depending on the facts, SSA identifies such evidence as an employer letter or a death certificate. A signed federal tax return may be needed for the relevant year if you filed one. Include only documents that support the information in your request, and follow the form’s instructions about evidence.
  5. Submit the request through an SSA channel. SSA accepts SSA-44 online or by fax or mail with supporting evidence. It also offers phone and appointment assistance. Use the current submission directions on the form or SSA notice, and retain a copy of what you submit and confirmation or other proof of delivery.
  6. Respond to follow-up requests. SSA may ask for additional proof based on your circumstances. Read any request carefully, provide the specific information requested, and keep copies of your response.

If SSA used the wrong tax information

If you believe the MAGI or filing-status information SSA received from the IRS is incorrect, SSA says to correct the information with the IRS. Gather the tax return or other tax records that show the discrepancy and contact the IRS about the underlying information. Do not assume that submitting SSA-44 alone will correct the IRS record or resolve a dispute about what the IRS reported.

You can also contact SSA as appropriate and provide evidence about the disputed determination. Keep the two issues separate in your explanation: what information you believe is wrong at the IRS, and what SSA determination you want addressed. If you also have a qualifying life-changing event or want a formal review of SSA’s decision, consider the separate procedures described here; one route does not necessarily settle the others.

How to request reconsideration

Reconsideration is the formal appeal route when you disagree with SSA’s determination. It is different from asking SSA to make a new initial determination based on a qualifying event. SSA offers an online appeal with electronic document submission, Form SSA-561-U2 (“Request for Reconsideration”), or contact with a local SSA office. Follow the directions on your determination notice for the available submission method and any case-specific instructions.

  1. Identify the decision and the specific disagreement. Refer to the IRMAA notice and state what you believe SSA got wrong. For example, identify a disputed fact or calculation rather than only saying that the premium is unaffordable.
  2. Assemble the records that support your position. This may include tax documents, the notice, and evidence relevant to the disputed fact. If the issue is an IRS data error, pursue correction with the IRS as well; reconsideration does not itself correct the source tax record.
  3. Submit the online appeal or SSA-561-U2. Include the information requested and attach relevant records. Keep a complete copy of your submission and any delivery confirmation.
  4. Watch for SSA’s response and follow its instructions. A reconsideration decision may explain further review options. If you continue to disagree, use the next-step instructions and timing in that decision notice.

Know the reconsideration deadline

SSA policy generally requires a reconsideration request within 60 days after you receive the IRMAA determination notice. SSA presumes you received the notice five days after its date unless you show that it arrived later. Because the deadline is measured from receipt under that rule, note the notice date and when it actually arrived, and keep evidence if delivery was delayed.

SSA may consider a late appeal if you show good cause. Do not rely on that possibility as an extension: file promptly, explain the reason for any delay, and provide supporting information. The 60-day reconsideration deadline does not govern a request for a new initial determination based on a qualifying event. These separate clocks are another reason to identify which procedure you are using.

What happens after reconsideration

If you disagree with the reconsideration decision, SSA policy describes a further appeal to an administrative law judge using Form HA-501-U5, “Request for Hearing by Administrative Law Judge.” Follow the instructions and deadline stated in your reconsideration decision notice. The notice for your case controls what to do next; do not assume that the initial 60-day reconsideration timeframe also supplies the deadline for a later hearing request.

Effective dates, premium changes and refunds

Under 20 CFR § 418.1230, a new initial determination based on a significant reduction in more recent-year MAGI after a qualifying event is generally effective January 1 of the year you make the request. The regulation also provides exceptions, including limited circumstances in which SSA may determine the preceding year. The effective date in your case depends on the applicable facts and rules, so use SSA’s decision notice to confirm when any revised amount applies.

If you have already paid premiums at the higher amount, whether and how those payments are adjusted depends on SSA’s determination and its effective date. Do not assume that filing a request immediately changes deductions or guarantees a particular refund. Review the decision notice for the result and any adjustment SSA makes.

Documents to gather before you contact SSA

A complete file makes it easier to state the issue accurately and answer follow-up questions. Before submitting a request, assemble:

  • The IRMAA determination notice and any later SSA notices about the same premium year.
  • The premium year, tax year, MAGI and filing status shown on the notice, along with the tax records relevant to a disputed figure.
  • If seeking a new initial determination, the date and type of qualifying event and documents supporting it, such as an employer letter or death certificate when relevant.
  • Income information for the year SSA asks you to document, including a signed federal return if one was filed and requested or applicable.
  • A clear explanation of the specific outcome you are asking SSA to review, and a record of when and how you submitted the request.

SSA may request additional evidence depending on the circumstances. Use the notice and current form instructions to determine what is needed for your particular case; the examples above are not a complete document list for every situation.

2026 premium context: do not reuse figures across years

SSA’s published 2026 premium schedule lists a standard monthly Part B premium of $202.90 and additional IRMAA amounts that vary by MAGI tier and filing status. The $202.90 figure is the 2026 standard premium, not the total a beneficiary with IRMAA necessarily pays. The exact surcharge depends on the applicable tier and filing status, and the schedule for another premium year may differ.

When checking a notice, use SSA’s schedule for that notice’s premium year rather than carrying forward 2026 figures. Likewise, pair any tax-year reference with the premium year it supports: for the 2026 determination, the SSA-44 edition dated 12-2025 points ordinarily to 2024 income, or to 2023 if the 2024 return was unavailable. Your own notice and the form instructions determine the relevant facts.

Common mistakes that can delay or misdirect a request

  • Using SSA-44 for every disagreement. SSA-44 is for a qualifying life-changing event that may lower income; it is not a universal appeal form.
  • Assuming retirement automatically lowers IRMAA. The event and income evidence must meet SSA’s requirements and support a lower result.
  • Sending an IRS-data dispute only to SSA. SSA directs beneficiaries to the IRS to correct MAGI information received from the IRS. Address the source record and separately consider any SSA review you need.
  • Confusing the new-determination request with reconsideration. They serve different purposes. If appropriate, SSA policy allows both to be requested at the same time.
  • Missing the reconsideration window while gathering documents. The general deadline is 60 days after receipt; file promptly and follow up with evidence as directed rather than waiting past the deadline without explanation.
  • Using the wrong year’s thresholds or premium amount. Verify the premium year and the tax year on the notice before comparing amounts.

A practical route-selection checklist

  1. Write down the premium year, notice date, date received, tax year, MAGI and filing status shown on the notice.
  2. Ask what kind of error you are alleging: incorrect IRS data, a qualifying income-reducing event, or another disagreement with SSA.
  3. For incorrect IRS data, seek correction from the IRS and keep evidence of the discrepancy.
  4. For a qualifying event and lower income, review the current SSA-44 and submit the event and income evidence using an SSA channel.
  5. For a disagreement with the SSA determination, file reconsideration online or with SSA-561-U2, generally within 60 days after receipt.
  6. Keep copies, delivery records and responses; follow the decision notice if you need further review or if SSA changes the premium.

An appeal or new initial determination request is a request for SSA to review the facts, not a guarantee of a lower premium. The outcome depends on the applicable procedure, tax information, qualifying-event rules, evidence and premium year.
