Short answer: An e-way bill penalty usually follows when goods move in breach of the GST Act or Rules—for example, without a required e-way bill, without required conveyance information, with an expired bill, or with documents that materially conflict with the actual consignment. The safest workflow is to generate the bill before dispatch, reconcile the invoice or challan with the goods and parties, complete Part B when required, update vehicle details after a conveyance change, monitor validity, and carry the prescribed documents. If an officer intercepts the consignment, section 129 provides notice, a hearing opportunity and release through prescribed payment or equivalent security. CBIC has also identified a narrow set of minor errors that should not, by themselves, lead to section 129 proceedings when both the supporting document and a valid e-way bill are present.
When an e-way bill penalty can arise
India’s GST e-way bill system is a control on the movement of goods, not merely an invoice-upload facility. Rule 138 generally requires the prescribed information to be furnished before movement of a consignment whose value exceeds ₹50,000, subject to statutory and notified exceptions. The threshold must be tested using the value definition in the rule; do not substitute a different commercial subtotal simply because it appears on an internal quotation or order.

The central rules are set out in the CBIC CGST Rules, 2017 Part A and the CBIC e-way bill rules page. State or Union territory notifications, the nature of the goods, the route and the type of movement can change whether an exception applies. Confirm those factors for each dispatch rather than treating ₹50,000 as an automatic rule for every shipment.
What a compliant movement requires
Generate the bill before the journey starts
The required information must be furnished before movement begins. A bill generated after a vehicle has left may not cure a contravention that already occurred. Build generation into the dispatch release process, with a timestamp and user record so the team can show when the document was created.

Make the bill describe the real consignment
The invoice, bill of supply or delivery challan, the e-way bill, the goods loaded, the consignor and consignee, and the conveyance should tell the same story. Reconcile GSTINs, legal names and addresses, document number and date, item descriptions, quantities, taxable value, tax, origin, destination and vehicle details. A material mismatch can be treated differently from a typographical error covered by CBIC’s limited clarification.
Complete Part B for road transport when required
For road movement, Part B conveyance information is generally needed for a valid e-way bill, subject to specified exceptions. Enter the correct vehicle number or other permitted transport details before movement. If goods are transferred to another vehicle, update the conveyance information before the next leg where the rule requires it; do not continue on an old vehicle entry merely because the bill number is unchanged.
Carry the prescribed documents
The person in charge should carry the invoice, bill of supply or delivery challan and the e-way bill number or a physical or electronic copy in the form permitted by the rules. A document that can be produced quickly reduces disputes about whether the consignment is supported, although it does not excuse a substantive mismatch.

Common violations and the control that prevents each one
| Risk | Why it matters | Control before release |
|---|---|---|
| No e-way bill when one is required | CBIC states that section 129 proceedings may be initiated when goods have the prescribed transport document but no e-way bill. | Check value, movement type, goods, route and current exceptions; generate the bill before loading or dispatch. |
| Part B or vehicle details missing | A road-movement bill can be invalid where required conveyance information is absent or stale. | Confirm the vehicle actually assigned, enter its details and update them after a vehicle change before further movement. |
| Invoice and e-way bill disagree with the load | Officers assess the documents against the goods, parties and journey they find in transit. | Use a two-person check of GSTINs, addresses, document number, items, value, origin, destination and vehicle data. |
| Validity expires during transit | Rule 138 provides distance-based validity and specific extension rules. An expired bill does not automatically remain usable because the journey started on time. | Calculate validity at dispatch, allow for the planned route and delays, and check current rules for any route- or goods-specific extension. |
| Assuming every typo is harmless | CBIC’s protection covers only named minor discrepancies and conditions. It is not a blanket waiver for incorrect goods, parties or values. | Keep the supporting document and bill together, identify whether the exact error fits Circular 64/38/2018-GST, and correct material data before movement. |
These controls reflect Rule 138 and CBIC Circular No. 64/38/2018-GST, dated 14 September 2018. Read the official circular alongside the current rules; a circular’s examples should not be broadened beyond their wording.
Penalty and detention under section 129
Section 129 applies when goods are transported or stored in transit in contravention of the GST Act or Rules. The officer can detain or seize the goods and conveyance, issue a notice identifying the tax and penalty proposed, and pass an order after giving the person concerned an opportunity to be heard. The following figures come from CBIC’s official CGST Act compilation dated 31 August 2021. Because statutory text and amendments can change, verify the current consolidated Act before calculating an amount for a live case.
| Situation | Tax and penalty for taxable goods | Alternative for exempt goods | Release alternative |
|---|---|---|---|
| Owner comes forward | Applicable tax plus a penalty equal to 100% of that tax. | An amount equal to 2% of the value of the goods or ₹25,000, whichever is less. | Equivalent security in the prescribed form and manner may be furnished instead of payment. |
| Owner does not come forward | Applicable tax plus a penalty equal to 50% of the value of the goods reduced by the tax paid. | An amount equal to 5% of the value of the goods or ₹25,000, whichever is less. | Equivalent security in the prescribed form and manner may be furnished instead of payment. |
“Owner comes forward” is therefore not a cosmetic distinction: it changes the statutory penalty basis. The correct classification depends on the facts presented to the proper officer and the applicable current law.

Payment of the amount specified in the notice concludes the proceedings for that notice. If the amount is not paid within 14 days of detention or seizure, section 130 proceedings may be initiated. The period can be shortened for perishable or hazardous goods, or goods likely to lose value. For the Act text and chapter context, consult the official CGST Act compilation and obtain current legal advice where a detention is disputed.

What to do when a vehicle is stopped
- Produce the documents promptly. Provide the invoice, bill of supply or delivery challan and the e-way bill number or permitted copy, plus the vehicle and driver information requested.
- Identify the exact discrepancy. Ask that the notice state whether the issue is an absent bill, missing Part B data, an expired bill, an incorrect vehicle, a document mismatch or another rule contravention.
- Preserve the evidence. Retain the e-way bill history, invoice version, loading records, dispatch timestamp, vehicle-change record, communications and proof of tax payment. Do not overwrite the original document while trying to correct a later error.
- Use the hearing opportunity. Submit a focused written explanation addressing each alleged discrepancy and attach the matching records. Distinguish a genuine clerical error from a change in goods, value, parties or route.
- Choose payment or security deliberately. Compare the amount demanded with the section 129 route applicable to an owner who has come forward, and assess whether furnishing equivalent security is available in the prescribed form.
- Act faster for time-sensitive cargo. Perishable, hazardous or rapidly depreciating goods may face a shorter period before section 130 action, so escalate the matter immediately rather than waiting for the 14-day period.
When a typo may not trigger section 129
CBIC Circular 64/38/2018-GST addresses situations in which both a specified invoice or other document and an e-way bill are present. It says section 129 proceedings may not be initiated for certain limited errors, including:
- Spelling mistakes in the consignor’s or consignee’s name when the GSTIN is correct.
- Certain PIN-code errors when the correct addresses are stated and the error does not extend the e-way bill’s validity.
- Certain consignee-address errors where the locality and other identifying details are correct.
- A one- or two-digit error in the document number.
The circular does not protect a consignment with no required e-way bill, nor does it turn an incorrect vehicle, wrong goods, wrong tax value, false parties or a materially different destination into a harmless typo. The protection also depends on the circular’s factual conditions. Keep the invoice and e-way bill together so the officer can see that the underlying transaction is identifiable.

Validity, vehicle changes and journey planning
Check the distance-based validity
Rule 138 sets validity by distance and specifies how that period is counted. At dispatch, record the planned route, expected hand-offs and likely delay points. Check the current rule for extensions or special treatment for particular goods and routes; do not rely on an old internal chart.
Update a conveyance transfer
When a truck is replaced, the new conveyance details should be entered in the e-way bill system before the goods continue, where the rule requires an update. A breakdown, trans-shipment or change of carrier is precisely when the dispatch control should pause and verify the new number.

Do not reuse an expired bill
If the bill expires while the consignment is still moving, stop and determine whether a lawful extension or a new document is available under the current rules. Continuing on an expired bill can create a new exposure even if the original bill was correctly generated.

A dispatch-team procedure that is easy to audit
- Classify the movement: sale, stock transfer, job work, return, exhibition, repair or another category; identify whether an exception is claimed.
- Calculate value under Rule 138: use the rule’s definition and document the calculation, including tax and any components the rule requires.
- Validate source documents: match legal names, GSTINs, addresses, document number and date, items, quantity, value and tax to the goods loaded.
- Generate before movement: complete the required Part A information and retain the bill number and generation time.
- Complete conveyance data: enter Part B or the permitted transport details, check the vehicle number character by character and record the driver or carrier hand-off.
- Run a release check: confirm the origin, destination, route, distance-based validity and whether the physical or electronic documents are with the vehicle.
- Monitor exceptions: use an alert for delays, vehicle changes and approaching expiry; escalate any correction that changes goods, parties, value or destination.
- Close the trip: retain delivery proof, the final vehicle details and the original invoice/e-way bill versions according to the business’s GST record-retention policy.
Practical examples
Example: no bill, correct invoice
A truck carries a consignment above the applicable threshold with a valid invoice but no e-way bill. The invoice does not substitute for the e-way bill. CBIC’s clarification specifically distinguishes this situation from minor errors where both documents exist, so section 129 proceedings may be initiated.
Example: one-digit document-number error
The invoice and e-way bill are available, GSTINs and addresses identify the same parties, and the document number differs by one digit. That fact pattern can fall within the circular’s limited minor-error example. The team should still present the original records and should not assume the result is automatic if other data conflicts.
Example: vehicle changed after a breakdown
The goods, invoice and e-way bill are otherwise correct, but the truck breaks down and the load is moved to another vehicle. Before the next leg, update the conveyance details as required. Continuing with the old vehicle entry leaves a preventable inconsistency visible at interception.

Questions to resolve before relying on an exception
- Is the movement covered by a statutory or state/UT-notified exception, and is the exception still in force for this route and goods category?
- Does the value calculation follow Rule 138 rather than an internal accounting convention?
- Are both the prescribed document and e-way bill present, and do they identify the same goods and parties?
- Is the alleged discrepancy one of the precise examples in Circular 64/38/2018-GST, with all of its conditions satisfied?
- Has the current consolidated CGST Act and any applicable IGST or state/UT provision been checked before quoting a penalty or deadline?
