Yes, you can prepare a Chapter 7 or Chapter 13 bankruptcy filing yourself with online tools or official forms, but software does not automatically file your case or decide whether a chapter is right for you. The U.S. Courts publish the forms, and some bankruptcy districts offer their own online preparation tools. Availability and filing steps vary by district, so check your local bankruptcy court’s instructions before relying on any service.
What bankruptcy software does—and what it does not
Bankruptcy preparation software can guide you through questions and produce bankruptcy documents. The official forms themselves come from the federal judiciary. A court’s online tool may help you prepare those forms, but completing an online interview is not necessarily the same as submitting a petition to the court.
You remain responsible for giving complete, accurate information, using the current forms, following local procedures, and confirming that the court has received and filed what it requires. Do not assume that a program’s calculation establishes your eligibility or that pressing a final button starts your case.
Chapter 7 and Chapter 13 require different forms and decisions
Chapter 7
Chapter 7 is subject to a means test that can affect whether an individual consumer debtor may receive relief under that chapter. The U.S. Trustee Program identifies Form 122A-1, Form 122A-1Supp, and Form 122A-2 as the Chapter 7 means-test forms. The calculations use information about your finances and may also draw on Census Bureau and IRS data. If disposable income calculated under the rules exceeds applicable thresholds, the U.S. Trustee, creditors, or other parties may seek dismissal. A software result is not a definitive legal eligibility decision.

Chapter 7 also has forms that do not apply in the same way to Chapter 13, including the Statement of Intention. Consult the official forms catalog and the instructions for each form rather than assuming a program has covered every requirement.
Chapter 13
Chapter 13 reorganizes debts through a repayment plan. It may let a debtor catch up certain past-due secured payments, including overdue home payments, through that plan. The U.S. Trustee Program identifies Form 122C-1 and Form 122C-2 for Chapter 13 income calculations; for certain debtors, those calculations help determine plan obligations. Chapter 13 also has its own commitment-period, disposable-income, and plan forms.

These chapters are not interchangeable software settings. The right chapter depends on your circumstances and the applicable law, not simply on which interview or form set seems easier.
Ways to prepare a filing yourself
| Option | What it provides | Does it file the case? | What to verify |
|---|---|---|---|
| Official U.S. Courts forms | Federal forms for individual debtors, including petitions, schedules, statements, and chapter-specific documents. | The forms themselves do not submit a case. | Use the current versions and instructions, and check your district’s submission requirements. |
| A court-provided online preparation tool | Some districts provide an online process for self-represented debtors. The Central District of California’s eSR tool is one example; its court says no software download or purchase is needed. | Not necessarily. In the California example, the user must also send required documents and the fee to the court. | Whether your district offers a tool, who may use it, what it prepares, and what you must submit afterward. |
| Commercial document-preparation software | Potentially a guided preparation service, but the official sources cited here do not establish current product names, prices, district coverage, or features. | Do not assume so. Confirm directly whether the service only prepares documents or actually submits them. | Coverage for your district and chapter, current forms, local filing instructions, support and refund terms, and how the service flags issues needing legal advice. |
| Bankruptcy attorney | Legal advice and representation tailored to your circumstances. | An attorney can handle filing steps as part of representation; confirm the scope of any engagement. | Fees, included services, and whether the attorney handles your chapter and district. |
How to check whether a tool fits your case
- Identify your bankruptcy district. Filing procedures and available court tools are local. Find the bankruptcy court for the district where you will file and read its current instructions.
- Confirm chapter coverage. Check whether the service prepares Chapter 7, Chapter 13, or both, and whether it addresses the distinct forms and calculations for the chapter you are considering.
- Check forms and local requirements. Compare the documents the tool prepares with the current U.S. Courts forms catalog and your court’s instructions. Ask how the service handles district-specific requirements.
- Find out what “filing” means. Ask whether the provider transmits documents to the court or merely prepares them for you. If you must submit anything yourself, confirm the delivery method, deadline, fee, and required supporting documents with the court.
- Review support and limits before paying. Verify the total cost, support availability, refund terms, and what happens when your answers indicate a potentially complicated legal issue. The official sources discussed here do not verify commercial providers’ current offerings or terms.
- Keep proof and confirm receipt. Follow the court’s instructions and verify directly with the court that all required items were received and the case was filed.
Preparing documents is not the same as having a bankruptcy case
The Central District of California’s eSR instructions illustrate why the distinction matters. Its workflow asks users to gather financial records, answer questions about property, income, and debts, and complete a declaration. The user must then provide additional documents and the filing fee. The court warns that the petition will not be filed unless required items are received, and that the automatic stay does not take effect until a case number is issued.

Those details apply to that district’s process, not automatically to courts elsewhere. Use your own court’s current instructions to determine what counts as filing and when a case number is issued. Do not rely on a software confirmation screen as proof that a case has been filed or that a stay is in effect.
When self-representation may be a poor fit
Filling out forms is only part of a bankruptcy case. Chapter choice, eligibility calculations, property, debts, and plan obligations can involve legal consequences that a document-preparation flow cannot resolve for you. The Central District of California Bankruptcy Court cautions: “Bankruptcy has serious long-term financial and legal consequences and hiring a competent attorney is strongly recommended.” This is the court’s general warning, not an individualized assessment of your case.

If you are unsure whether to file, which chapter to use, how to report an asset or debt, or how a proposed Chapter 13 plan would work, consider getting legal advice before submitting documents. The U.S. Trustee Program advises people seeking help to contact their local bankruptcy court or state bar association about reduced-fee or pro bono bankruptcy assistance.

The federal forms catalog includes the individual voluntary petition, schedules, statement of financial affairs, and chapter-specific documents. The U.S. Trustee Program’s guidance identifies different Form 122 series for Chapter 7 and Chapter 13. Form versions and instructions can change: the official Chapter 7 means-test form page identifies an update dated April 1, 2025, and an effective date of April 1, 2022.
