Disney did not buy all of Fubo, and no court ruled that the deal solved broader competition concerns. Instead, Disney combined Fubo with specified Hulu + Live TV assets, gained approximately 70% of Fubo’s voting interest, and settled Fubo’s lawsuit over a planned sports-streaming venture. The case ended; the antitrust allegations were not decided on their merits.
What Disney’s Fubo deal actually did
Announced on January 6, 2025, the transaction combined Fubo with specified assets from Hulu’s linear live-TV business. It closed on October 29, 2025. In its post-closing disclosure, FuboTV Inc. said Disney, through its indirect ownership of Hulu, held approximately 70% of Fubo’s voting interest.
The deal did not transfer the whole Hulu streaming library or Disney+ to Fubo. The contributed assets related to Hulu + Live TV’s linear multichannel subscription service, including assets and contracts for negotiating and administering carriage agreements. FuboTV Inc. remained the public company, and FUBO continued trading on the New York Stock Exchange. Fubo’s October 29, 2025 SEC filing describes the closing and post-deal structure; its annual report details the scope of the Hulu Live assets.
Announced financial terms are not all confirmed payments
In the January 6, 2025 announcement, Disney, Fox, and Warner Bros. Discovery agreed to an aggregate $220 million payment to Fubo. Disney also committed to a $145 million term loan in 2026, and the agreement included a $130 million termination fee under specified circumstances. These were announced terms; they should not be read as confirmation that every payment or commitment has since been completed. The same announcement put the two services’ combined North American subscriber base at over 6.2 million at that time—not as a current subscriber count. Fubo’s announcement provides the terms.

Why Fubo sued Disney, Fox, and Warner Bros. Discovery
Fubo filed suit on February 20, 2024, in the U.S. District Court for the Southern District of New York. It alleged that a planned sports-streaming joint venture among Disney, Fox, and Warner Bros. Discovery—later known as Venu Sports—would harm competition in sports-network licensing and live pay television. Fubo also challenged network-bundling and carriage-pricing practices, and in an amended complaint alleged a market for “skinny sports bundles.” Those were Fubo’s allegations, not findings that the practices violated antitrust law.
Fubo brought claims under Section 1 of the Sherman Act, Section 7 of the Clayton Act, and New York antitrust law. On August 16, 2024, the district court granted Fubo a preliminary injunction blocking the planned joint venture while the case proceeded. A preliminary injunction is temporary relief, not a final ruling on whether the defendants violated antitrust law.

How the settlement ended the case—and what it did not decide
Alongside the January 2025 deal announcement, the parties agreed to settle. Fubo’s case was dismissed with prejudice, and the preliminary injunction was extinguished; the appeal was dismissed by stipulation and so ordered on January 8, 2025, according to Disney’s SEC filing.
That procedural outcome ended this particular lawsuit and removed the court order blocking the planned venture. It did not amount to a court finding that Disney’s majority ownership of Fubo cured competition concerns, nor did it adjudicate Fubo’s allegations on the merits. “Makes the antitrust problem go away” is therefore accurate only in the narrow sense that the deal accompanied a settlement ending Fubo’s case—not as a legal conclusion about the market.

What the deal means for subscribers choosing a live-TV service
Fubo and Hulu + Live TV were described as distinct services that would remain separately available after closing. Fubo’s materials characterized Fubo as sports-first and Hulu + Live TV as more entertainment-oriented. The January 2025 announcement also described a planned Fubo Sports & Broadcast service with Disney networks including ABC, ESPN, ESPN2, ESPNU, SEC Network, ACC Network, ESPNEWS, and ESPN+. Those were announced arrangements, not confirmation of current availability or a current channel lineup.
The closing disclosure said FuboTV Inc. had nearly six million paid subscribers at closing. It also reported that UBS estimated the company was the sixth-largest U.S. pay-TV company as of June 30, 2025; that is an attributed estimate, not a government ranking or an independently measured finding.

Compare the services using current, local details
Before switching or changing a household budget, check each service’s current monthly price, local-channel coverage, sports and regional sports network availability in your market, entertainment channels, device support, and add-on or bundle terms. The deal materials do not establish current prices or lineups, and they do not resolve whether a particular regional sports network, such as Bally Sports, is available in a given market.
Fubo co-founder and CEO David Gandler said in the January 6, 2025 company announcement, “This combination enables us to deliver on our promise to provide consumers with greater choice and flexibility.” That is the company’s stated view of the deal, not independent evidence that subscriber choice increased or prices fell.
