The dispute began with a fatal food-allergy incident alleged to have occurred at Raglan Road Irish Pub and Restaurant in Disney Springs. Disney’s withdrawal changed the proposed forum; it did not establish fault or decide the claims.
What happened in the lawsuit
Jeffrey Piccolo filed the case as personal representative of the estate of his wife, Kanokporn Tangsuan, in Orange County, Florida. The defendants are Great Irish Pubs Florida, which operates Raglan Road, and Walt Disney Parks and Resorts U.S., Inc. The case number is 2024-CA-001616-O.
According to the complaint, Tangsuan had severe dairy and nut allergies. On October 5, 2023, she dined at Raglan Road with Piccolo and a family member, and the party requested allergen-free food. The complaint alleges that she later suffered a fatal anaphylactic reaction. Those are allegations in the case, not a finding that either defendant was legally responsible.
The Associated Press reported that Piccolo sought damages exceeding $50,000. That is the amount sought, not a court award.

Why Disney sought arbitration
On May 31, 2024, Disney filed a motion asking the court to compel arbitration and stay the lawsuit. In its filing, Disney argued that Piccolo had accepted arbitration terms through a Disney+ trial and a later park-ticket purchase. Disney asked the court to apply those agreements to the claims against Walt Disney Parks and Resorts U.S.
Piccolo opposed the motion on August 2, arguing that the agreements should not govern the estate’s wrongful-death claims arising from a separate restaurant visit. The filings describe competing positions; neither the motion nor the opposition was a ruling on whether the agreements applied.

Who operated the restaurant?
Disney’s motion described Raglan Road as independently owned and operated by Great Irish Pubs Florida and said Disney leased the property. The complaint alleged an agency relationship and asserted a basis for Disney’s responsibility, including reliance on Disney’s descriptions of allergy accommodations. These are disputed positions, and the restaurant should not be described as Disney-owned or Disney-operated on the basis of these filings.
Disney’s withdrawal and what it means
On August 19, 2024, Disney Experiences chairman Josh D’Amaro announced that Disney would waive arbitration and allow the lawsuit to proceed in court. He said: “At Disney, we strive to put humanity above all other considerations. With such unique circumstances as the ones in this case, we believe this situation warrants a sensitive approach to expedite a resolution for the family who have experienced such a painful loss.” Disney presented the decision as a sensitive approach to the family’s loss, not as an admission of liability.

Procedurally, the announcement ended Disney’s attempt to require arbitration in this case. It did not settle the lawsuit, decide negligence, determine damages, or establish that the complaint’s allegations were true. The available materials do not confirm a final ruling on responsibility or a trial date.
Court versus arbitration: the issue in this case
Court litigation and arbitration are different ways to resolve a dispute. A court case proceeds through the public court system, while arbitration is a private process before an arbitrator. Disney’s motion asked the judge to direct the dispute into arbitration under agreements it said Piccolo had accepted; Piccolo argued those terms did not reach the estate’s claim about the restaurant incident. Disney later withdrew that request rather than obtain a decision on the dispute.

This case therefore does not establish that Disney+ subscribers generally give up the right to sue Disney affiliates over unrelated events. The attempted reach of the terms was contested, and the court did not resolve that legal question in the materials described here.
