Twelve tenants at a Marine Parade apartment complex in Cottesloe were reportedly told to leave within seven days after the property’s agent said an engineering assessment had classified the building as uninhabitable. Residents disputed the urgency and challenged the move. News reports published in March 2025 describe a court hearing, but do not establish its outcome or the building’s current condition.
What happened at the Marine Parade complex?
PerthNow reported that on 14 February 2025, David George and 11 other tenants received notice to leave within seven days. The complex was described as a beachfront block built in the 1950s. The account was published on 6 March 2025, after tenants had raised objections to the short timeframe and difficulty finding replacement accommodation. PerthNow’s report describes residents’ experiences; it does not quantify conditions across the wider rental market.
Why did the agent say residents had to leave?
PerthNow reported that renovation work was underway to remove asbestos lining around the eaves and upgrade aluminium windows when engineers were called in. The article said the assessment identified problems with corner columns supporting steel lintels and timber veranda beams. Real estate agent Chris Shellabear said the engineering report classified the building as uninhabitable and that immediate vacation notices were necessary. He said: “We had no option.”
The engineering report itself is not available in the reports reviewed here. Its findings and the building’s safety status therefore cannot be independently confirmed from those accounts.

What did the tenants say?
George disputed the need to move so quickly, saying: “There’s nothing wrong with the building. And if there are safety issues, they can be mitigated.” He also asked “who gets to decide what an inhabitable building really is?” Those remarks reflect his position; they are not an independent safety assessment. PerthNow also reported stress among residents and difficulty securing alternative accommodation.
What happened in court?
According to a 14 March 2025 report, George and four other residents attended a pre-trial hearing at Fremantle court on 12 March after refusing to return their keys within the notice period. George had legal representation and hoped the group would be able to present evidence. The report said a directions hearing was expected on 13 March; it did not report a ruling or final resolution. The March report does not establish what happened after that hearing.
