Canada’s NDP Pushes to Ban Surveillance Pricing, Calling It “Unfair” and “Creepy”

The NDP called for a federal ban on surveillance pricing, proposing to prohibit businesses from using personal data to raise individual prices online and in stores. The motion was a proposal, not proof that a ban became law.

Canada’s New Democratic Party (NDP) called for a federal ban on surveillance pricing on April 13, 2026. Its proposal would target businesses using personal data to raise the prices individual customers pay, both online and in stores. It is a political proposal, not evidence that such a ban is now law: the House of Commons recorded the motion, and an NDP MP later said the party’s unanimous-consent motion was blocked.

What the NDP proposed

NDP Leader Avi Lewis announced a motion asking the federal government to prohibit what the party calls “surveillance pricing.” The House of Commons Order Paper recorded it as motion M-30 on April 14, 2026. Its wording called for a ban where corporations use personal data to increase the prices consumers pay, in-store and online.

The NDP’s examples of personal data include income, location, browsing history and previous purchases. The party’s concern is that a business could use such information to estimate what a particular customer might pay and set that customer’s price accordingly. Those are the party’s examples and policy framing; they do not establish that every retailer collects or uses all those data points.

Lewis characterized the practice as “unfair,” “a rip-off” and “downright creepy” in the NDP’s April 13 announcement. Those words express his view of the practice, rather than a finding by Parliament or a regulator.

Did the proposal become law?

The available parliamentary records show political action, not enactment of a prohibition. On April 16, an NDP MP told the House that the party’s request for unanimous consent on its motion had been blocked by the Liberals. A motion expressing the House’s opinion is not itself a statute, and the records cited here do not show the proposed ban becoming law.

For readers, the practical distinction is straightforward: the NDP asked the federal government to act, but this announcement does not establish that businesses are now legally prohibited from using personal data to set individualized prices.

What “surveillance pricing” means—and what it does not

Personal-data-driven price increases

The NDP uses “surveillance pricing” for personalized pricing in which a company uses information about a person to decide what that customer may be willing to pay, with the proposal aimed at using personal data to increase the price. Its motion covers online and physical-store purchases.

Not every algorithmic price change

“Algorithmic pricing” is a broader term for prices set or adjusted with computational rules or models. A price that changes because of an algorithm is not automatically surveillance pricing: the distinction in the NDP motion is the use of personal data to increase an individual consumer’s price. The Competition Bureau’s separate work considers algorithmic pricing and competition more generally.

Why the policy debate is broader than a ban

The Competition Bureau published a report on January 22, 2026, summarizing feedback from its consultation on algorithmic pricing and competition. The consultation ran from June 10 to August 4, 2025. The Bureau’s summary includes calls for rules to address anticompetitive conduct without stifling innovation.

There are competing claims about personalized pricing. In a submission to the Bureau, the Chamber of Progress argued that it can give lower prices to consumers who might otherwise be priced out of a market. That is a stakeholder argument, not a Bureau finding or a generally established effect. UFCW Canada National President Barry Sawyer, quoted in the NDP announcement, argued that algorithmic and predatory pricing can increase what people pay at checkout. His statement is also an attributed position, not an independent measurement of how prevalent the practice is.

Any eventual rule would have to answer practical design questions, including:

  • Would it cover all algorithmic price changes, or only price increases based on personal data?
  • Would the rule apply online, in physical stores, or both?
  • Which kinds of information would count as personal or sensitive data?
  • How would it distinguish individualized price increases from conventional discounts and promotions?
  • How would regulators balance consumer protection, competition and innovation?

The NDP proposal and the Bureau’s consultation provide context for those questions, but the sources cited here do not establish a final statutory design.

What consumers should take away

  • The NDP’s motion targets the use of personal data to raise individualized prices; it is not simply a call to ban every price adjustment made with an algorithm.
  • The proposal called for federal action covering both online and in-store pricing.
  • The motion’s appearance in parliamentary records, and the NDP’s report that its unanimous-consent request was blocked, do not show that a federal prohibition took effect.
  • Claims about possible consumer benefits or harms should be read with their sources and attribution in mind: the Chamber of Progress and UFCW Canada expressed stakeholder positions, not settled findings about the practice’s overall effects.
