For the potential maximum, both spouses must qualify individually: each needs an eligible ownership share, must contribute to the interest repayment, and must meet the applicable property, loan and tax-regime rules. The ₹2 lakh limit is per eligible taxpayer, not an automatic allowance for every couple with a joint loan.
When can both spouses claim home-loan interest?
For Assessment Year (AY) 2026–27, the Income Tax Department’s guidance allows up to ₹2 lakh per eligible taxpayer for qualifying interest on borrowed capital for a self-occupied home under the old tax regime. In principle, two eligible spouses could therefore claim a combined ₹4 lakh. The total claimed, however, cannot exceed the qualifying interest actually paid, and each person’s claim must reflect that person’s ownership share and contribution to interest repayment. The department’s self-occupied house-property guidance and co-owner guidance describe these conditions.
Marriage or joint-borrower status alone does not create two deductions. The official co-owner guidance reviewed does not establish that being a borrower without being an owner and making qualifying contributions is enough to claim the deduction.
What each spouse must establish
Check each person’s facts separately rather than dividing the interest or deduction equally by default. The Income Tax Department says co-owners’ shares must be definite and ascertainable for their house-property income to be assessed separately, and that a co-owner’s interest deduction is based on their contribution to interest repayment.

- Ownership: Confirm both spouses are named owners and identify each person’s definite, ascertainable share.
- Contribution: Establish how much interest each spouse actually contributed to repaying. Do not assume a 50:50 split unless the ownership and payment records support it.
- Loan and property eligibility: Check the purpose and date of the borrowing, when purchase or construction was completed, and whether the home is self-occupied or let out.
- Tax regime: Check which regime each spouse uses for AY 2026–27 and what deductions that regime permits.
- Supporting records: Compare the title documents, loan paperwork, lender’s interest certificate and payment records with each spouse’s individual return.
How the ₹2 lakh self-occupied interest limit works
The ₹2 lakh maximum is not available for every home loan. The department’s guidance sets it for qualifying acquisition or construction loans taken on or after 1 April 1999, where purchase or construction is completed within five years from the end of the financial year in which the capital was borrowed, and the taxpayer furnishes the required interest certificate. Certain other cases, including borrowing for repairs, have a ₹30,000 maximum instead. The law frames the limit as an aggregate for the taxpayer’s qualifying self-occupied properties. These are individual limits. If one spouse’s eligible interest contribution is below ₹2 lakh, that spouse cannot claim the unused amount from the other spouse’s limit. Nor can the couple’s combined claim exceed the qualifying interest paid.

What changes under the new tax regime?
The department’s AY 2026–27 comparison lists Section 24(b) interest for let-out property under the new regime, while listing self-occupied home-loan interest and Section 80C deductions among the old-regime deductions. A couple seeking the possible ₹4 lakh self-occupied interest deduction must therefore account for the regime each person uses; do not assume the old-regime deductions apply under the new regime. Is home-loan principal a separate tax benefit?
Eligible housing-loan principal can count under Section 80C for AY 2026–27 under the old regime, but it shares a combined ₹1.5 lakh limit with other eligible Section 80C payments. It is not a separate, additional ₹1.5 lakh home-loan allowance. The department’s AY 2026–27 guidance lists the shared limit, and its Section 80C text sets out the statutory provisions.

Section 80C also has a transfer rule: in specified circumstances, transferring the house before five years have expired from the end of the financial year in which possession is obtained can reverse prior deductions. Check the statute and your circumstances before relying on these deductions.
How pre-construction interest is claimed
Eligible interest paid before acquisition or construction is not claimed all at once. The department says it is allowed in five equal annual instalments, starting in the previous year in which the property is acquired or constructed. This framework applies to self-occupied, let-out and deemed let-out property, subject to the applicable provisions. See the department’s self-occupied house-property guidance.

How the calculation differs for a let-out home
Let-out property follows a different house-property calculation from the self-occupied ₹2 lakh case. The department describes actual interest as deductible in computing income from a let-out property, alongside rental-income computation and the applicable standard deduction. If the computation produces a house-property loss, the guidance reviewed allows up to ₹2 lakh of that loss to be set off against other income during the year; an unabsorbed loss may be carried forward for eight years, subject to the rules. Section 80EEA is not a general extra deduction for newly sanctioned loans: the department’s guidance requires a loan sanctioned from 1 April 2019 through 31 March 2022, as well as other conditions, including a stamp-duty value not above ₹45 lakh and first-home ownership eligibility. Section 80EE also has a historical 2016–17 sanction window and other conditions. These provisions should not be treated as broadly available for current new loans. What ₹4 lakh means for your tax bill
A deduction reduces taxable income; it does not reduce tax payable by the same amount. The actual tax effect depends on each spouse’s individual tax computation. Before claiming, match each person’s ownership share and documented interest contribution to the eligible interest, property rules and tax regime for the relevant assessment year.
