Yes. California’s AB 1340 gives drivers for covered transportation network companies, including Uber and Lyft, a state-law framework to organize and bargain over work conditions. Governor Gavin Newsom signed the bill on October 3, 2025, and it took effect January 1, 2026. The California Public Employment Relations Board (PERB) later certified the California Gig Workers Union (CGWU) as the statewide bargaining organization on September 9, 2026. That certification authorizes representation and bargaining; it does not mean every driver joined or that a contract has been reached.
What AB 1340 changes for California rideshare drivers
The Transportation Network Company Drivers Labor Relations Act, AB 1340, is codified at California Business and Professions Code sections 7470–7470.21. It establishes a process for covered drivers to form, join, and participate in driver organizations regarding terms and conditions of work, while also protecting a driver’s right to refrain. PERB administers the Act’s certification, representation, and bargaining procedures. PERB’s Act overview describes the framework.
When he signed the measure, Newsom’s office described it as giving more than 800,000 California rideshare drivers a legally protected choice to unionize and bargain collectively over wages, benefits, and working conditions. That is the governor’s office’s stated scope figure, not a count of active drivers eligible in a particular representation process. The October 3, 2025 signing announcement also quoted Newsom: “That’s the difference between chaos and competence.”
Where the process stands now
PERB certified a statewide bargaining organization
On September 9, 2026, PERB certified CGWU to represent a statewide unit of drivers working for covered transportation network companies. PERB said the certification was based on evidence that at least 30 percent of active TNC drivers authorized CGWU to represent them. PERB currently identifies Uber Technologies, Inc. and Lyft, Inc. as covered companies. PERB’s certification notice says the certified organization may represent all drivers in the unit and bargain with covered companies over terms and conditions of work.

Certification is not the same as individual membership or a contract
The 30 percent figure is the authorization evidence PERB cited for certification; it does not mean every driver individually joined CGWU. Certification gives CGWU authority to represent the statewide unit in bargaining, but PERB’s notice does not report a negotiated labor contract. A contract and its terms would be a separate outcome of bargaining. Drivers retain the statutory right to refrain from participating in a driver organization.
What happens next
The Act requires a 10-day application window each quarter for entities seeking or renewing designation as a TNC driver organization. PERB’s inaugural 2026 window ran January 20–29. Its rulemaking page lists proposed regulations with a November 3, 2026 comment deadline, so implementing rules remained under consideration as of that date.

For drivers, the practical distinction is between having a legal avenue to organize, a representative being certified, and an eventual bargaining agreement. The law and certification establish the first two stages; they do not, by themselves, establish the pay, benefits, or other terms that might result from negotiations. The cited state sources do not provide a measured estimate of effects on driver earnings or rider prices.
