Whether you can legally trade a prediction market contract depends on where you are, what the contract asks, how it is structured, and whether the operator is authorized under the rules that apply there. Calling something an “event contract” or a “prediction market” does not settle whether regulators treat it as a derivative, a bet, or both.
The examples below explain why you need to check the exact contract and your local financial-market and gambling rules. They are not a complete survey of every jurisdiction or a legal determination for your circumstances.

What determines whether a prediction market is legal where you live?
Start with the place where you are physically located and the relevant country, state, province, or other subnational jurisdiction. Then consider the contract itself and the legal entity operating the platform. One platform can offer contracts that raise different legal issues, and rules may distinguish retail customers from other participants.
Regulators may assess an event contract under financial-market law, gambling law, or both. The European Securities and Markets Authority (ESMA), for example, says classification as a financial instrument depends on the event question; a contract may also qualify as a bet under national gambling legislation. Canadian regulators have likewise distinguished securities and derivatives treatment from gambling treatment.

Platform access, an app-store listing, or the platform’s own label does not establish that a contract is lawful for you to trade. Nor does authorization in one country automatically apply elsewhere.
What the rules say in several jurisdictions
These are examples, not a complete global legal map. Regulatory positions and court cases can change, so check the relevant authority’s current notices and the platform’s current restrictions before trading.
United States
The Commodity Futures Trading Commission (CFTC) says on its consumer page that “Prediction markets are federally regulated and under federal law can operate in all 50 states.” That is the agency’s description of its position, not an uncontested court holding that every contract is lawful in every state. The CFTC advises customers to use registered entities and read the rules for the specific market and contract.

The relationship between federal and state authority is contested. In February 2026, the CFTC filed an amicus brief in a Ninth Circuit case asserting exclusive jurisdiction over CFTC-registered commodity derivative markets, including prediction markets. In April 2026, it filed lawsuits challenging actions by Arizona, Connecticut, and Illinois against CFTC-registered designated contract markets. Those filings show the CFTC’s position and ongoing litigation; they do not resolve every state-law dispute nationwide. Check current case status, state regulator notices, the platform’s location restrictions, and the exact contract.
In a March 16, 2026 advance notice of proposed rulemaking, the CFTC said event contracts may fit Commodity Exchange Act definitions of swaps or futures, and that a market offering swaps or futures to the general public must register with the CFTC as a designated contract market. The notice requests comment; it is not a final rule. It also describes shared CFTC and Securities and Exchange Commission jurisdiction over mixed swaps and security futures, while the SEC has sole jurisdiction over security-based swaps. The legal category therefore depends on the product rather than a single label for all event contracts.
The CFTC’s 2026 notice said designated contract markets certified approximately 1,600 event contracts for listing in 2025, compared with an average of approximately five contracts annually from 2006 through 2020. These are certified listings, not trading volume, user counts, or proof that every listing is approved under every state’s law.

European Union
On July 3, 2026, ESMA reminded firms to assess whether event contracts fall within existing national product-intervention measures on binary options. Where a contract qualifies as a financial instrument, ESMA says it is a derivative and, because it has a binary outcome, falls within the scope of existing national measures prohibiting the marketing, distribution, or sale of binary options to retail clients. ESMA also says distribution of event contracts that qualify as financial instruments requires investment-firm authorization in the EU, even if they are distributed only to non-retail clients. Check the competent authority and applicable rules in your member state; a contract may also be treated as a bet under national gambling law.
Great Britain
A UK Parliament answer dated September 8, 2026 says a prediction market would require a Gambling Commission licence to operate in Great Britain. If approved, it would be classified as a “Betting Intermediary” and regulated under the Gambling Act 2005. That statement is expressly about Great Britain; do not assume it answers the rules for every other UK jurisdiction.
Canada, including British Columbia
On August 27, 2026, the Canadian Securities Administrators and the Canadian Investment Regulatory Organization (CIRO) said sports- and entertainment-based event contracts should not be regulated under securities and derivatives legislation. They said they were still assessing the regulatory status of other event-contract types. Their notice also said two CIRO dealer members had been authorized to facilitate a limited set of event contracts, subject to terms and possible future restrictions.

British Columbia’s Independent Gambling Control Office (IGCO) separately said that, under the province’s current legislation, products based on sports or entertainment outcomes are gambling and must be regulated under the Criminal Code of Canada and provincial gaming legislation. The IGCO identified BCLC’s PlayNow.com as the only permitted commercial online gambling site in British Columbia and said other online gambling websites accessible to BC players, including sites offering sports or entertainment event contracts, operate illegally in the province. This is a British Columbia position, not a conclusion about all of Canada.

- Pin down your location. Identify your country and relevant state, province, territory, or other jurisdiction. Check rules tied to your physical location as well as residency if the regulator or platform distinguishes between them.
- Identify the exact contract. Note whether it concerns sports, elections, economics, politics, entertainment, or another event. Do not assume that every contract on the same platform has the same legal classification.
- Find the actual operator. Check the legal entity named in the customer agreement. Search the relevant financial-market and gambling regulators’ registers, warnings, and enforcement notices. A brand name, marketing description, app listing, or authorization from another country is not enough. The CFTC advises customers to use registered entities and verify that an app is linked from the trading website.
- Confirm that this customer and product are eligible. Check whether your customer type, the specific event contract, and the method of distribution are allowed. EU readers should check national binary-options measures; readers in Great Britain should check Gambling Commission licensing; British Columbia readers should consult the IGCO’s specific direction.
- Read the contract specification. Confirm the wording of the question, the resolution source and deadline, how settlement works, who makes the determination, and what happens if information is disputed, delayed, or unavailable. The CFTC says customers are entitled to transparent contract rules and settlement details.
- Check costs and exit terms. Review trading fees, commissions, penalties, withdrawal terms, counterparty arrangements, and whether you can close a position before settlement. Do not assume there will be enough liquidity for an easy exit.
- Find the protections and complaint routes. Check how funds are held and accessed, how disputes are handled, and which regulator or exchange accepts complaints. For US customers, the CFTC identifies the broker, designated contract market, National Futures Association, and CFTC as possible complaint routes.
- Pause if the legal answer is unclear. Ask the relevant regulator or a qualified lawyer in your jurisdiction before funding an account. Using a VPN or false location details to get around platform restrictions is not an established lawful workaround.
How to assess the contract’s risks and protections
Read the settlement terms as carefully as the market price. The CFTC’s consumer guidance says: “You are entitled to timely, transparent information about event contracts, including trading rules and contract terms (e.g., payout, prices, and how settlement determinations will be made, who decides, and how).” Check whether those details are clear enough to understand what outcome triggers payment and how a disputed outcome is handled.
Review the total costs and the possibility of losing the full amount at risk. The CFTC advises trading only with risk capital and warns that users dealing with unregistered entities operating outside the United States may have little or no protection. Its consumer guidance also recommends checking fees, account terms, and settlement information.

Some contract designs have particular manipulation concerns. In an August 12, 2026 staff advisory about “mention market” contracts—where settlement turns on whether a person says or mentions words, attends or appears at an event, or otherwise interacts with another person—the CFTC staff wrote: “These contract types present a heightened risk of manipulation because their settlement turns on the discrete conduct of a person that may be neither independently generated nor externally verifiable.” This warning concerns those specified contract types, not every event contract.
If you are comparing an event contract with a sportsbook
Do not assume the two products are legally or economically equivalent. Compare the regulator that authorizes the operator, how the product is classified, whether the specific event and customer type are permitted, how outcomes are settled and disputes handled, the fees and ability to close a position, and the available customer protections and complaint channels. The applicable answers may differ even when two products concern the same real-world event.
